A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DENYING A PREMISES PERMIT TO THE ZIMMERMAN
FIRE RELIEF ASSOCIATION
WHEREAS, the City of Elk River has received a letter from the Zimmerman Fire Relief
Association requesting the City Council adopt a resolution approving a premises permit in
order to conduct charitable gambling at the American Legion Post 112, located at 525
Railroad Drive in Elk River; and
WHEREAS, Elk River City Code Section 38-164 (b) (2), "Restrictions on Issuance of
Premises Permit," states a premises permit can't be issued unless the physical site fox the
organization's headquarters are located within the city or a city contiguous to Elk River; and
WHEREAS, the Zimmerman Fire Relief Association fails to meet the requirements of Elk
River City Code because their organizational headquarters are located in the City of
Zimmerman, a city that is not contiguous to Elk River.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River, Minnesota as follows:
1. The request for a resolution approving a premises permit to the Zimmerman Fire
Relief Association is denied.
