SUBJECT: Special Assessment Issues
5.4. Consider Resolution A1proving Assessment Roll for Unpaid
Garbage Collection Services
Attached is a listing of property owners with unpaid garbage collection
services as of September 1, 1995, and a Resolution approving the
assessment roll. The total to be assessed to the property owners is
$12,459.67. This is very comparable to the 1994 assessments of
$12,635.90. No public hearing is required prior to adoption of the
assessment resolution levying assessments for unpaid garbage
collection services. Notification was sent to these property owners
• giving them adequate time to bring their balance current to avoid
being assessed.
5.5. Consider Resolution Approving Assessment Roll for Elk Hills
Drive and Dodge Avenue Improvements
The second attachment is a resolution adopting the assessment roll for
the Elk Hills Drive/Dodge Avenue assessments. As you will recall, the
property owners have signed agreements waiving their rights to a
public hearing and waiving their rights to object to the amount of the
assessments, therefore eliminating the need for a public hearing on
this project. The assessments total $211,000, of which $145,000 is to
be assessed against the Elk River Retail Center. A listing of the
assessments is attached to the assessment resolution.
5.6. Consider Resolution Approving Assessment Roll for Country
Crossing Business Center
The final attachment is the resolution adopting the final assessment
roll for the Country Crossing Business Center improvements. Once
again the property owner has signed an agreement waiving his rights
• to a public hearing and his rights to object to the amount of the

assessments. This assessment project includes improvements on
• 183rd Avenue, Business Center Drive, and water, sewer, and storm
sewer improvements to the Country Crossing Business Center plat.
The total amount to be assessed against the properties is just over
$528,000. A memo from Terry Maurer which further explains the
assessments is attached.
Staff Recommendation
The City Council is asked to approve the three attached resolutions which
levy assessments for unpaid garbage collection services, the Elk Hills
Drive/Dodge Avenue improvements, and the Country Crossing Business
Center improvements.

• A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING AND LEVYING ASSESSMENTS
FOR UNPAID GARBAGE COLLECTION SERVICES AS OF
SEPTEMBER 1, 1995
WHEREAS, Minnesota Statutes Section 433.015 authorizes the City to
annually levy an assessment equal to such unpaid cost as of
September 1 of each year for garbage collection services at an
interest rate not to exceed 6% and a penalty not to exceed 10%;
and,
WHEREAS, the City's ordinance Section 602.12 Subdivision 3, authorizes
the City to levy an assessment against property for garbage
collection equal to the unpaid charges as of September 1; and,
WHEREAS, all customers and property owners with delinquent balances
as of September 1, 1995, have been given adequate notice of
this pending assessment and have been given opportunities to
pay prior to this assessment being levied; and,
• WHEREAS, State law does not require a public hearing or notice before
levying such assessments.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Elk River that the parcels and amounts listed on Exhibit A, attached hereto
are correct and made a part hereof, are to be levied at an interest rate of 6%
per annum with a 10% penalty, and certified to the Sherburne County
Auditor.
Passed and adopted by the City Council of the City of Elk River this 30th day
of October 1995.

A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
WHEREAS, upon due notice properly made as required by law, the Elk River City Council has
met and heard and passed upon all objections to the proposed assessment for the
Dodge Avenue improvement and has determined the amount to be assessed against
each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. Final assessment roll, a copy of which is attached hereto and incorporated herein by this
reference, is hereby accepted and adopted and shall constitute the special assessment
against the lands therein named. Each such tract of land in the assessment roll is hereby
found to be benefitted by the improvement in an amount not less than the amount of the
assessment levied against it.
2. Such assessment shall be payable in equal annual installments, including both principal and
interest, amortized in such amount annually as is required to pay the principal with interest
as 5 % over a period of five years.
3. The owner of any property so assessed, may, at any time prior to certification to the
County Auditor of the assessment or the first installment thereof, pay to the City Treasurer
the whole of the assessment on such property, with interest accrued to the date of payment;
except that no interest shall be charged if the entire assessment is paid within 30 days after
the adoption of this Resolution. Prepayment may also be made after the certification of
the assessment or first installment thereof by paying to the City Treasurer/Auditor the
entire amount of the assessment remaining unpaid with interest. In the case of a payment
made before November 15, interest will be calculated through December 31 of the next
succeeding year.
4. The City Administrator shall transmit to the County Auditor a certified duplicate of the
attached assessment roll to be extended on the property tax lists of the County. Such
assessment shall be collected and paid over in the same manner as other municipal taxes.

Dear Council Members:
The street and utility improvements on 183rd Street and Business Center Drive were added
to the Western Area by change order. This change order was initiated by the Developer,
who signed a petition and waiver of his rights to appeal any assessment. Now that the
improvements are complete, it is time for the assessments to be levied against the
appropriate property.
CIVIL ENGwEERING: The petition signed by the Developer requested that the assessments be spread as follows:
