Northstar Corridor Update
At the NCDA meeting held on September ~7t~ an update was .presented on the 2002 budget.
An overview of the recommendations of the Commissioner of Transportation was
presented. The Commissioner has assured the NCDA that MnDOT will provide the
necessary $2.5 million match for the federal funding for 2002. The Authority also discussed
the status of legislation affecting Northstar Corridor and strategies for lobbying the
legislature in 2002.
MnDOT is moving forward with the construction of the Park and Ride facility. They plan to
have buses running by October 1't. Additional information is available at their web site,

The Northstar Corridor Development Authority met in regular session on June 7, 2001, in the Board Room at
the Sherburne County Government Center, Elk River, Minnesota.

I. The meeting was called to order at 4:42 p.m. by Chairperson Betsy Wergin.
A motion was made by John Norgren, seconded by Patrick Cairns, and carried unanimously to
approve the agenda of Thursday, June 7, 2001 with the following changes: the addition of 7a)
Resolution passed by the National American Legion in support of the Northstar Corridor; 7b) letter
received from Congressman Oberstar; 7c) request for Mn/DOT personnel descriptions; and 7d) next
NCDA meeting date.
A motion was made by Duane Grandy, seconded by Woody Bissett and carried unanimously to
approve the meeting minutes of May 3, 2001, as presented.
Executive Committee Report:
a) Paul McCarron provided an update on the legislative session.
b)
A motion was made by Steve Billings, seconded by Ewald Peterson and carried unanimously to
recommend that the NCDA members (Sherburne County, Benton County, Anoka County
Regional Railroad and Hennepin County Regional Railroad) increase their individual
contributions to the Northstar project of 10% (resolutions adopted in 1999) of the revised total
capital project costs of $261,000,000. Mr. McCarron noted that capital costs have increased
due to changes to specs of the vehicles (new FRA regulations and additional vehicles),
increased cost of stations (platforms and enclosed shelters); Mn/DOT financial policies
(inflation factors and contingencies) and the delay in implementation of the project. Mr. Bissett
asked what Congressman Oberstar would have to say about the increased estimated costs. Mr.
McCarron noted that Congressman Oberstar would want to know that the project has enough
financial backing to continue in its development.
Ken Stevens presented a report on the completion of the preliminary engineering design.

John Himle, Himle Horner, reviewed the results of a survey they conducted of 600 randomly
selected households (May 18-24, 2001) along the Northstar Commuter Rail Corridor. The following
key findings were discussed:
a) Residents were concerned about congestion
b) Will take more than just highway improvements
c) Strong local support for Northstar Com~xmter Rail
d) Strong support among all political party affiliations
e) Residents perceive multiple uses for Northstar
Mary Richardson noted that, as directed in NCDA Resolution #2001-01, NCDA staff have prepared
the documents necessary to transfer the Northstar Corridor Commuter Rail Project to Mn/DOT. Ms.
Richardson reviewed a draft report on the status of the Northstar Corridor Commuter Rail Project,
the Risk and Liability Assessment Report and the Preliminary Financial Program Audit dated June 7,
200l.
The NCDA presented a Certification of Appreciation to Tim Yantos, Northstar Corridor Rail Project
Director, for his dedication, leadership and tenacity in working to make rail a reality in the Northstar
Corridor.
Discussion was held on the future role of the Northstar Corridor Development Authority. The
Authority expressed their desire to continue to receive all meeting notices and agendas. Mr. Billings
asked if the future role of the NCDA should be to concentrate on other multi-modal issues. Mr.
Yantos noted that staffwill be meeting with individual members to discuss what the members' feel
the NCDA's future role should be.
Betsy Wergin notified the members that the American Legion l0th District passed a Resolution at
their convention in support of the Northstar Corridor project.
A letter from Congressman Oberstar was distributed congratulating the NCDA on their work on the
Northstar Corridor Project.
Position descriptions are available of Mn/Dot personnel who will be working on the NCDA project.
The Executive Committee will review the descriptions and make a summary available at the August,
2001 NCDA meeting. Members interested in receiving a complete copy of all descriptions should
contact Mary Richardson, Richardson, Richter & Associates.
The next meeting is scheduled for August 2, 2001, at 4:30 p.m. at the Sherburne County
Government Center.

PROPOSED STRATEGY:
1. Ignite local support
We must educate, keep informed, and ask the public to request that their
legislators fund the Northstar commuter rail or the region will suffer
consequences. Increased involvement by NCDA members will be critical to this
effo~.
Develop Statewide Transportation Coalition
Many agree that transportation funding as a whole (not just Northstar) was
inadequately addressed by the 2001 Legislature. The Northstar funding is most
likely to be achieved through bonding, which requires a super majority of 60%.
To get that 60%, we need to align ourselves with other people seeking bonding
money and other interested parties to build a statewide coalition.
Establish Strong, Cooperative CRCCC Oversiqht of Proiect
This oversight will be necessary to ensure that the project stays on track and to
avoid escalating costs due to delays. For project advocacy to succeed, the
technical work and the BNSF negotiations must continue to progress in a timely
fashion.
Actively Pursue Federal Funding
This element of the strategy will involve providing support to our congressional
delegation and working with Mn/DOT to ensure that all FTA requirements are
met.
IMPLEMENTATION ACTIVITIES:
1. Develop materials for public information and public involvement in the Northstar
Corridor. Examples include newsletters, brochures, project updates, website,
action kit for citizen advocates, media, etc.
Undertake coalition-building activities with transportation/transit stakeholders.
Examples include developing a stakeholder database, involving business
interests and e-mail updates.
Develop significant information or involvement initiatives. Examples include
participation at State Fair, a demonstration event, corridor-wide mailing, etc.

Work in close coordination with Mn/DOT on project management activities. This
strategy will involve active staff participation as advisors in project development
activities and communicating actively the local expectations and perspective.
FUNDING STRATEGY:
1. To move forward to activate the structure to issue bonds for the local share in
appropriate increments with an initial issuance of $3 million. The proposed uses
of these funds include:
1. $2.5 million to match proposed $10 million FY2002 federal appropriation
2. Up to $500,000 for NCDA implementation activities
To work with Mn/DOT to develop a funding strategy for the use of state and
federal appropriations made for Northstar Corridor individually and as a part of
the Twin Cities Transitways, in 1999, 2000 and 2001.

2002 NCDA Budget
Please note that the 2002 Budget is on the agenda for the September 6th NCDA
meeting. At its meeting on August 23, the Executive Committee approved the proposed
2002 Budget and is recommending that the NCDA approve the budget at its September
meeting. The proposed budget includes a line item for $2,5000,000 for final design and
right-of-way acquisition. The intent of the Executive Committee was to provide the local
match for the $10,000,000 that is currently in the House Transportation Bill in Congress.
Immediately following the August 23, 2001 NCDA Executive Committee Meeting, the
CRCCC met and was informed by Mn/DOT's Chief of Staff, Margo LaBau, that Mn/DOT
intends to provide the necessary $2.5 million match for the federal funding. On
Wednesday, August 29th, Commissioner Elwyn Tinklenberg, in a phone conversation,
assured NCDA Chair Betsy Wergin of his intent that Mn/DOT provide the $2.5 million.
As a result of these Mn/DOT assurances, it is recommended that the proposed 2002
budget be amended to remove the line item for final design and right-of-way acquisition.
The total proposed budget would be reduced from $3,250,000 to $750,000. A revised
budget is attached for your consideration.

Subject: Plan B Implementation: Contract with Himle Homer
At its July meeting, the Executive Committee approved Plan B which
outlines an approach to keep the Northstar Corridor Rail Project on track
and to secure funding in 2002 (see Agenda Item #2a). In order to
implement Plan B, the Executive Committee approved a funding strategy
that includes an amount of up to $500,000, to be provided by member
county regional railroad authorities or counties. This amount is
approximately the same amount provided in the 2001 budget for public
information and involvement, prior to the transition of the project to
Mn/DOT.
In January of 2001, the NCDA retained Himle Horner to provide consulting
assistance for public information and involvement activities, following an
RFP procurement process. In June, the Himle Horner agreement was
assigned to Mn/DOT as a part of the transition of the project to Mn/DOT.
Staff are recommending that the NCDA enter into a new agreement with
Himle Homer. The contract amount proposed is up to $500,000. The
scope of services will include items identified in a draft strategy developed
by Himle Homer to implement Plan B.
Action Requested:
The Executive Committee recommends that the
NCDA approve a contract with Himle Horner and
direct staff to negotiate the scope and contract
amount up to a maximum of $500,000.

Preliminary Engineering Contract for Stations, Maintenance Facility, etc.
with URS/BRW
All of the work specified within the referenced contract scope of services has been
completed. The Preliminary Engineering package has been assembled, reviewed by
Mn/DOT, approved for submittal to FTA by the NCDA, and relevant portions submitted
to station cities for review and comment. The Preliminary Engineering documents dated
June 1, 2001 were submitted to FTA on that date.
URS/BRW and particularly Paul Danielson, Project Manager, have worked diligently to
produce a quality product in a timely manner. While the contract completion date of
March 31,2001 was not met, there were many extenuating circumstances, which are
well documented in the required monthly Status of Design reports. Upon review of the
project schedule and deliverable dates included within the contract together with review
of the extenuating circumstances, it is concluded that the schedule, as reasonably
adjusted, has been met.
In a July 6 letter to T. Yantos, URS/BRW documented expenditures in excess of the
contract amount in the amount of $104,760. Subsequent discussions have resulted in a
reduction in that amount to $21,978.89, which requires a contract increase of $22,490
for a total contract amount of $1,020,189. Note that the work under this contract was
completed prior to the assignment date. Mn/DOT has requested that this contract not
be assigned to them, and that NCDA act to close out the contract*.
Acceptance of the final invoice will closeout the contract for Preliminary Engineering
with URS/BRW.

Action Requested:
The Executive Committee recommends that the NCDA
rescind its resolution 2001-5 assigning the URS/BRW.
Preliminary Engineering contract to Mn/DOT and authorize
the Chair to execute an amendment to the contract
increasing the contract amount by $22,490.00.
NOTE:
Since the Executive Committee meeting on August 23, 2001, Mn/DOT has
requested that the NCDA not act to rescind Resolution 2001-$ relating to
the assignment of the URS/BRW Agreement. Mn/DOT has requested that
the assignment of the contract proceed as originally contemplated,
because URS/BRW has incurred further expenses under the PE contract,
after the June 1 assignment date. Such expenses will be paid by
Mn/DOT, and consequently the URS/BRW contract should be assigned.

Dear Ms. Wergin:
Recently, the NCDA and its co-defendants defeated a lawsuit filed by residents in Northeast
Minneapolis who objected to procedures for locating a commuter rail station in that community. As
litigation counsel representing the NCDA in that case. I want to be sure that the Executive
Committee understands the nature of the lawsuit and the extremely favorable outcome achieved.
A four-count lawsuit was brought against the NCDA, the Mirmesota Department of
Transportation and the City of Minneapolis by certain residents suing through their townhome or
condominium associations. These plaintiffs objected to the possible location of a commuter rail
station in the vicinity of their residences. The lawsuit sought an injunction preventing the ongoing
planning of the commuter rail station until the planning agencies had returned to "square one," in
order to "comply" with laws and procedures allegedly violated. Specifically, these residents
contended that procedures under environmental statutes had not been followed. They also argued
in their complaint that provisions of the Commuter Rail Transportation Act had been violated,
especially procedures that required the approval or input of each city regarding proposed commuter
rail station locations.
Our strategy at the outset was to nip this lawsuit in the bud. The first step in that process was
to confront plaintiffs' counsel with the fundamental weakness in his case: residents cannot resort
to litigation to influence or thwart an open and ongoing planning process. However, plaintiffs'
counsel refused to abandon his lawsuit.

Accordingly, the three agency defendants assembled a joint motion for summary judgment,
seeking the dismissal of this lawsuit at the outset. We wanted to protect our clients from the burdens
and inconveniences of responding to discovery and giving depositions. We also wanted to prevent
plaintiffs from using the pendency of this lawsuit as "leverage" to achieve their preferred policy
objectives. We insisted that discussion of the merits of station location belongs in the planning
process, not in the courts.
The cooperation among the agency defendants could not have been better. Counsel for each
agency made contributions to our brief in support of the motion for summary judgment. However,
there is no question that the most important overall contributor to the success of this effort was an
individual who was both "client" and "lawyer": Mary Richardson. Mary patiently instructed defense
counsel about the esoteric world of commuter rail in Minnesota. The education she provided to us
was essential to the development of our legal arguments. I am particularly grateful for her
willing-ness to read early drafts of our motion and provide appropriate additions and corrections.
Our motion had immediate impact, because the plaintiffs voluntarily dismissed their claims
based on environmental law noncompliance. However, plaintiffs continued to oppose our effort to
dismiss the case by emphasizing that the planning agencies were intentionally circumventing the
process established by the Legislature for locating commuter rail stations.
Judge Larson' s order dismissing all of plaintiffs' claims must be viewed as a total victory.
Not only did the defendants win on all issues, there is very little content in that opinion which would
serve as a consolation prize for the plaintiffs.
I would be pleased to discuss any aspect of this case in greater detail. Please understand that
this victory does not prevent these plaintiffs or others from bringing lawsuits once final decisions
have been made, although some of the content of the summary judgment motion might be helpful
to defeat any subsequent claims by these plaintiffs. In fact, Judge Larson's opinion will be helpful
in any future dispute where it becomes necessary to explain the statutory context of commuter rail
planning.

Subject: Vehicle Procurement
Recommendation:
The CRCCC recommends that Mn/DOT release a request for proposals (RFP) for the
hiring of a consultant to evaluate various options for the procurement of vehicles for the
Northstar Commuter Rail project. Specifically, the CRCCC recommends that the
Project Team evafuate vehicle procurement options with analysis and options relating to
cost, noise, air quality, safety, regulatory compliance and overall performance.
Background Information:
The CRCCC understands the FRA regulatory requirements are changing for vehicles
and want to ensure compliance with all applicable standards. Additionally, the CRCCC
understands that there is a long lead time in vehicle manufacturing. In order to keep the
Northstar project on track, the CRCCC believes that background issues should be
resolved as soon as possible so that the Project is in a position to order vehicles as
soon as funding becomes available.

Finance Issues: Accounting of State and Federal Funding Appropriated
for the Northstar Project
Recommendation:
In order to plan for the financing of the local 'share of the Northstar Commuter Rail
Project and to ensure a complete understanding of Mn/DOT's financing plan, the
CRCCC requests that Mn/DOT provide an accounting of all state and federal funds that
have been appropriated for the Northstar Corridor, individually and as one of the Twin
Cities Transitways. The accounting should document all funds received for the project
beginning in 1999 through 2001 and should identify expenditures made to date, the
remaining balances of all amounts appropriated, and a budget for the proposed use of
any remaining funds. It is also requested that Mn/DOT identify the sources of the
match for the federal funds identified below.

8' Section 1. Minnesota Statutes 1998, section 297A.25, is
9 amended by adding a subdivision to read:
10 Subd. 84. [COMMUTER RAIL'MATERIALS AND
11 EQUIP~4]ENT. ] Purchases of materials, supplies, and equipment used
12 or consumed in t~e construction,.equipment, or improvement of a
13 conunuter rail transportation system .operated under sections
14 174.80 to 174.90, are exempt from the taxes imposed under this
15 chapter and from any sales and use tax imposed by a local unit
16 of government notwithstandinq any ordinance or'charter
i7 provision. This exemption includes railroad cars and engine~
18 and related equipment and applies regardless of whether the
19 materials, supplies, or equipment are purchased by the city or
20 by a construction manager or contractor.
21 Sec. 2. [EFFECTIVE DATE.]
22 Section 1 is effective for purchases after June 30, 2000.

7 BE IT ENACTED BY THE LEGISLATURE OP THE STATE OF MINNESOTA:
8 Section 1. Minnesota Statutes 1998, section 297A.15, is
9 amended by adding a subdiuision to read:
10 Subd. 8. [REFUND; APPROPRIATION; COMMUTER ~AIL'~UEL. ] If.
11 fuel described in section 297A.25, subdivision 7, Clause (6),. is

~urchased by the operator of the commuter rail system, a refund
equal to the taxes paid on the fuel must be paid to the operator
of the commuter rail system. The tax must be imposed and
collected as if the sales were taxabie and the rate under
16 section 297A.02, subdivision 1, a~plied. An application for
17 refund must be submitted by the operator of the commute'r rail
18 system and must include sufficient information to permit the
19 oonunissloner to verify the sales taxes paid. The amount
20 Kequired to make the refunds is annually appropriated to the
21 commissioner. Interest must be paid on the refund at the rate
22 in section 270.76 from 60 days after the date the refund claim
23 is filed with the commissioner.
24 Sec. 2. Minnesota Statutes 1998, section 297A.25,
25 subdivision 7, is amended to read:

sale of and storage, use or consumption of the following
petroleum products are exempt:
(1) products upon which a tax has been imposed and paid
under the provisions of chapter 296A, and no refund has been 'or
will be allowed because the buyer used the fuel for nonhighway
use;
(2) products which are used in the improvement of
agricultural land by constructing, maintaining, and repairing
drainage ditches,' tile drainage systems, grass waterways, water
impoundment, and other erosion control structures;
(3) products purchased by a transit system receiving
financial assistance under' section 174.24 or 473.384;
[4) products used in a passenger snowmobile, as defined in
section 296A.01~, subdivision 39, for off--highway business use as
part of the operations of a resor~.as provided under section
296A.16, subdivision 2, clause '(2);
(5) products purchased by' a state or a political
subdivision of a state for use in motor vehicles exempt from
registration under section 168.012, subdivision 1, paragraph
(b): or
16) products purchased for use as fuel for a conunuter rail
system operating under sections 174.80 to 174.90, provided that
the tax must be paid on these purchases and a refund of the faa
applied for as provided in section 297A.15, subdivision
Sec. 3. [EFFECTIVE DATE.]
Sections 1 and 2 are effective for purchases after June

Recommendation:
The CRCCC recommends that Mn/DOT release a request for proposals (RFP) for the
hiring ora consultant to evaluate various options for the procurement of vehicles for the
Northstar Commuter Rail project. Specifically, the CRCCC recommends that the
Project Team evaluate vehicle procurement options with analysis and options relating to
cost, noise, air quality, safety, regulatory compliance and overall performance.
Mn/DOT Response:
As recommended, Mn/DOT is preparing an RFP for the hiring of a consultant to develop
a vehicle procurement strategy. Mn/DOT staff will work with Ken Stevens in the
preparation of this RFP. It will cover, in addition to the topics mentioned specifically in
the CRCCC recormrtendation above, analysis and options relating to:
· Federal Transit Administration procurement rules and regulations
· Federal Railroad Administration regulations (such as buff strength)
· Vehicle procurement, maintenance, and operations for future corridors of a
commuter rail system
