SUBJECT: Park Dedication Fees
Consider Resolution 95 -_, amending the park dedication fees which will be
effective 1/1/96 and 1/1/97.
Background
• In 1992, the Park and Rec Commission recommended to the City Council a
resolution to adjust the park dedication fees on an annual basis by $50 for a
three -year period. The last adjustment setforth in the resolution was made
on 1/1/95 and therefore, if the Park and Rec Commission would like to see an
increase in the park dedication fees on the first of January, 1996, a new
resolution will need to be forwarded to the City Council.
Analysis
As the Park and Rec Commission is well aware, demands are continually
being placed on the development of the park and recreation system. Park
dedication funds are a primary source for both acquiring land and
purchasing recreational equipment for the parks throughout the community.
As residential development continues throughout the community the
demands for recreational development will continue to increase and the
financing of these improvements is an issue the city will have to continuously
contend with.
In an attempt to keep pace with development and necessary park
improvements, the Park and Rec Commission is asked to consider the
attached resolution which would increase the park dedication fees for single
. family and multi - family development by $100 per lot annually, for the next

two years. The commission may also want to consider whether an increase in
the commercial park dedication should be included at this time. To assist the
commission in considering this matter, I have attached a survey of other
communities to give you an idea of the park dedication fees for residential,
commercial and industrial. This survey was conducted in December 1993 so
the information may be out of date.
Recommendation
The Park and Rec Commission is asked to consider the attached resolution as
presented or amended according to the desire of the Park Commission,
whereby this resolution can then be forwarded to the City Council for their
consideration.

negotiation. He stated that a portion of this property will be dedicated for ball fields.

Planning Fees
Consider adjusting planning application fees.
Overview
On an annual basis, staff conducts a survey of surrounding and other similar
developing communities to assess their fee structure as compared to Elk
• River's. When considering an increase in application fees, staff reviews the
following:
• How does Elk River's fees compare to the surrounding and similar
communities?
• Which applications generally demand the greatest amount of staff time to
review, prepare reports and administer?
The last time planning application fees were adjusted was January of 1994.
Since that time, it has become clear the applications which generally demand
the greatest amount of staff time are:
• Subdivisions (preliminary and final)
• Conditional use permits
• Site plan review
Therefore, the fees for these applications are proposed to be increased as
follows:

A special note should be made regarding the increase in preliminary plat
fees. This fee is being adjusted to maintain a base fee; however, include a
per lot fee. This is an attempt to try and make application fees for
preliminary plats proportional to the size of the actual development.

Fees for services are based on the direct cost of administration and
enforcement for the licensed service. The city annually reviews its fees to

currently paying. In this case, the City is recommending a below average
increase so as not to dramatically raise the fee in one year.

Neither Councilmember Holmgren, who is our City Representative on the
Community Recreation Board, nor I could attend the Monday, December 11,
1995, Community Recreation Board meeting. There was no quorum present
for this meeting, so no official business took place.
Attached for your review is the Community Recreation Board 12/11/95
agenda, agenda detail page, the November 13, 1995 minutes, and the
November/December staff report - all of which was scheduled to be discussed
last week at the Community Recreation Board meeting. This item is on the
Council agenda as an update, but is listed as a consent agenda item;
however, Councilmember Holmgren and I would be happy to try to answer
any questions that the Council may have regarding current Community
Recreation activities.

1 Budget Committee '96 budget amendment recommendation: The committee has met and will present their recommendation. The
committee was directed to amend the budget to accommodate the change as a result of the staff performance recommendation with no
increase to the original total administrative budget.
2. Personnel Committee recommendation of secretarial benefits: The '96 budget allows for this increase. To date this position has been
part -time. The committee has met and will report their recommendation.
3) Recreational programming development • At our long range planning meeting we determined that we should study some other
communities that have a history of providing recreational services in a community where Community Education also exists. Jeff A. has
come'to the conclusion that each community is unique and has its own history of evolution and relationship to CE. It is clear that there
is much potential for recreation and CE programming in this community and that it will be best that we pursue development of new
initiatives rather than concern ourselves with duplication of Comm. Ed. activities. Currently staff are working closely with CE staff in the
area of program planning. We also Co- sponsor activities with CE. Community Recreation staff will continue to communicate with CE
about all programming initiatives. It has been suggested in the past that perhaps a joint,meeting with the CE Advisory Board may be in
order to further clarify each organizations objectives and how each organization can continue to closely communicate and serve the
residents of the 728 area and surrounding communities.
4) Comm. Education Community Festival: At the Novemebr Recreation Board meeting, Elk River City Administrator Pat Klaers asked if
we could place this item on our agenda. In recent weeks the Community Education program has decided to discontinue the Festival.
Community Education Director Charlie Blesener will be at this meeting to explain the Festivals' history and reason for the decision to
discontinue.
5.) Joint Powers Agreement Update: JA will present the necessary changes as part of our continued evolution.

B.1) '96 Budget Update: JA reported that Livonia will participate in '96. JA also reported that Dayton
• is excited about opportunities that exist for our program to begin serving them locally.
JA also reported that the budget committee will be meeting to make the necessary budget
amendments and to begin discussion on development of a fund balance policy. JA will set this
meeting.
JA also suggested that the personnel committee meet to determine the benefits package for the
secretarial position. JA will set this meeting.
B. 2) Overview of '96 Goals: JA reviewed the list as presented with your meeting agenda
information. JA also added that development of an improved participant / residency record keeping
system is being worked on.

Community Recreation Board
Staff Report
Programming:
- Current / Recent Activities: Mens VB, Women's VB, Sr. High Intramural VB, Open Gyms, Indoor
Walking, Open Weight Room, Special open gyms on non - school days.
The Winter / Spring brochure goes to print on Dec. 6th and will be delivered on Dec. 27th. The
recently past weeks have been busy planning.
A sampling of activities planned are: skating lessons, gymnastics, open gyms, numerous special
events, non school day activities, intramural basketball ( for Jr. & Sr. High ), adult volleyball, adult
basketball, youth volleyball, cheerleading clinic, youth down hill skiing, pillow polo, "Start Smart".
Several are new offerings!
We have also been instrumental in working with Henry Sandbulte (a Dayton Park and Recreation
Commissioner) to organize an intramural basketball program for the Dayton area. We will also be
doing some "cross scheduling'.
We also supervise skating rink warming house staff for the following communities: Otsego, Elk River
(2 sites), and Dayton. The warming houses will be opening soon. In the process of hiring, training,
and scheduling supervision.
• Miscellaneous Updates:
- Youth Needs: As reported last month as well, The Elk River Mayor, is interested in having the
Community Recreation Board program work with the Community Youth Task Force (Rita Johnson),
and Pam Black (a teen program specialist with Comm. Ed. ) to develop a plan to increase
opportunities for teens ( specifically grades 7 -9). The mayor also asked us to consider how other
community organizations could support these same efforts as well. ( not necessarily in the form of
only funding, but human resources as well). The Mayor would like to hear our proposal the first part
of 1996.
- Youth Association Co -o. This group involves representatives from Youth Baseball, Youth Soccer,
and Girls Youth Softball ( outdoor programs ). JA has arranged for this group to meet with the Elk
River Park Commission for the purpose of providing input to determine what types of fields should be
a part of the planned development scheduled for construction to begin in spring of 1996.
JA has also helped them to coordinate their registration plans.
- Oak Knoll Maintenance aclreement: Oak Knoll athletic complex was developed in cooperation by
ISD 728 and t` +e city of Elk River. Maintenance responsibilities have been unclear and have lead to
some frustration. It was reported last month that JA was soon to be meeting with Mike Hanlon (ISD
is 728 Athletic Director) to clarify the understanding. We met on Dec. 5th and have worked through
most of the issues. This understanding and communication will continually need to be worked on.
-Office Chanaes: We are nearly settled. Some signage, and other minor details still in progress.
- JA supervision change: JA has met with Ron Black and Phyliss Boedigheimer to discuss her nev
role, relationship, and communication process between her and JA, and the Recreation Board. Tirt
was also spent discussing various aspects of our program. Phyliss has a very good understanding of
our objectives and is also very familiar with community based recreation programs from her
experience with the city of Champlin.
- Intern: Chris Majcin: Has completed his work with us on Dec. 8th. The following tasks/ projects were
his focus: field and planned development inventory, residency identification system, (still needs some
work) personnel guideline / orientation manual, marketing data base, tri -fold brochure.
I have also asked Chris to write a report on his experience with us. I will share that report when
available.
- Misc. Projects:
- Slide show presentation is in development. Plan to present it at our January meeting and to : "take
on the road ". This will also be an opportune time to "polish" our message about all benefactors of our
work and responsibilities and the value it all provides to the community
More consistent use of Community Newsletters, and development of our own newsletter.

SUBJECT: Budget and Tax Levy Resolution
In September the City Council adopted its proposed maximum budget and
tax levy resolution. The Truth in Taxation public hearing was held on
December 11, 1995, in order receive public input on the proposed budget and
tax levy for 1996. The budget is proposed in the amount $4,094,750. This is
a 9.71% or $362,500 increase over the adopted 1995 budget. Almost all of the
increase in expenditures is related to personnel issues.
The net tax levy for 1996 is proposed in the amount of $2,570,439. The
proposed net levy is $347,092 more than the adopted 1995 net levy. Almost
all of the net levy increase is for general fund purposes. The majority (82.8 %)
of the net tax levy is for general fund activities.
Attached for your consideration is a resolution that approves the budget and
tax levy for 1996.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION AUTHORIZING THE PROPOSED TAX LEVY FOR
CALENDAR YEAR 1996
WHEREAS, the Elk River City Council has reviewed the City's anticipated
expenditures for all funds in 1996; and,
WHEREAS, the Elk River City Council has considered projected revenues for
all funds in 1996; and,
WHEREAS, revenues from sources other than property taxes are not sufficient
to meet anticipated expenditures of all funds.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River that the proposed General Fund Budget in the amount of
$4,094,750 is hereby adopted.
BE IT FURTHER RESOLVED by the City Council of the City of Elk River that
the following amounts be levied as property taxes payable in 1996.

Background
Mr. Engstrom is making this request to annex a portion of his property into
the City of Elk River to further clarify an issue regarding Mr. Engstrom's
address. This item was presented to the Big Lake Town Board on October
12, 1994, for the Board's consideration. Since that time, Mr. Engstrom has
recently brought it to the City's attention that he would like to have this
action finalized sometime yet this year. City Attorney, Peter Beck has
prepared a resolution for orderly annexation that Mr. Engstrom presented to
the Big Lake Town Board and approved on December 13, 1995.

•
The City of Elk River's western limits currently bisect the eastern two feet of
Mr. Engstrom's home. This annexation would include an area of
approximately 4,000 square feet basically surrounding Mr. Engstrom's home.
Recommendation
It is recommended the City Council consider adopting the joint resolution for
orderly annexation as drafted.

MINNESOTA MUNICIPAL BOARD
PURSUANT TO M.S. 414.0325
JOINT RESOLUTION
FOR ORDERLY ANNEXATION
The Township of Big Lake and the City of Elk River hereby jointly agree to the following:
1. That the following described area in Big Lake Township is subject to orderly
annexation pursuant to Minnesota Statutes 414.0325, and the parties hereto designate this
area for orderly annexation, to wit:
The South 80.00 feet of the North 680.00 feet of the East 50.00 feet of the
• Northeast Quarter of the Southeast Quarter of Section 13, Township 33,
Range 27, Sherburne County, Minnesota.

2. That the Town Board of the Township of Big Lake, and the City Council of
the City of Elk River, upon passage and adoption of this resolution and upon acceptance by
the Municipal Board, confer jurisdiction upon the Municipal Board over the various
provisions contained in this Agreement.
3. That the 4,000 square foot property to be annexed abuts the City of Elk River
and includes a single family home which is presently partially located within the City of Elk
River.
4. That annexation of the property identified in Paragraph No. 1 above is
therefore in the best interest of the area proposed for annexation and the aforementioned
property will be immediately annexed to the City of Elk River.

5. That upon annexation, the property annexed shall be zoned Rl -a, Single
Family Residential.
6. Both the Town of Big Lake and the City of Elk River agree that no alteration
of the stated boundaries of this agreement is appropriate. Furthermore, each party agrees
that no consideration by the Municipal Board is necessary. Upon receipt of this resolution,
passed and adopted by each party, the Municipal Board may review and comment, but shall,
within thirty (30) days, order the annexation in accordance with the terms of this joint
resolution.

motion to accept the fire report for September. Supervisor Thomas seconded. All voted in favor.

Business from the Clerk
a. Arne Engstrom- Appeal Resolution - Mr. Engstrom submitted a resolution to the board
requesting his residence be moved back into Elk River. Currently, the boundary between Elk
River and Big Lake Township bisects the Engstrom home with the larger portion in Big Lake
Township. Mr. Engstrom has requested his residence be officially moved back into Elk River by
redrawing the township line around his residence. Supervisor Hofer moved to accept the
resolution supporting the Engstrom residence moving back to Elk River. Supervisor Thomas
seconded the motion. Vote for: 4, against: 0, Supervisor Alfords abstained.
b. Kathy Peterson -Mans - Ms. Peterson was not able to attend the meeting, but is interested in
working with the township to obtain maps that she could give as part of her welcome basket to
new residents of Big Lake.
c. James Hendrickson -CUP. - Mr. Hendrickson has requested a special use permit to comply
with county ordinances in the Mississippi Special Use District. Mr. Hendrickson would like to
operate an automobile service station in section 35, next to the River Inn. He would also have a
towing service that would be available 24 hours. No more than 20 cars would be kept in an
enclosed area for not longer than 90 days. Supervisor Sanford made a motion to recommend
approval of the conditional use permit. Supervisor Hofer seconded the motion. All voted in
favor and the motion passed.
d. Everett Munter-C.U.P. - Mr. Munter would like to build a 30' x 54' pole building on his
property in Riverdale Estates (Lot 8, Block 1). The building is 1620 sq. ft. and would be used for
storage. Mr. Munter has a little over 3 acres and the nearest neighbor would be approximately
150'. A motion was made by Supervisor Alfords to approve the conditional use permit for the
1620 sq. ft pole building subject to approval of the neighbors. Supervisor Hofer seconded the
motion. All voted in favor. The motion passed.
e. November 8 1994- Election - Clerk Munsen submitted a list of certified election judges to the
board. Supervisor Thomas moved to appoint the judges as presented to work on November 8,
1994. Supervisor Sanford seconded the motion. All voted in favor and the motion passed.
Clerk Munsen requested arrangements be made to clean the church (precinct 1) after the election.
The board gave approval. Options, Inc. will be contacted to handle the cleanup.
f. Informational Items
1) Don Follett from Minnegasco would like to address the board to discuss future plans in Big
Lake Township. Clerk Munsen distributed a township agreement resolution that Minnegasco
uses in most townships. Mr. Follett would like to attend the October 26, 1994, meeting to answer
any questions regarding this resolution.

WHEREAS the residence at 20800 Meadowvale Road, Elk River, formally
NW 1/4 of SW 1/4 of Section 18, Elk River has been moved by
Sherburne County Assessors Office to NE 1/4 of SE 1/4 of Section
13, Big Lake, because of a request by a County Commissioner
candidate to the Auditor, for a formal survey of residence, which
found bisects the home with the larger portion in Big Lake
Township.
• WHEREAS as the residence has been thought to be in Elk River since
its construction in 1899 and remained in that Township and later
City until changed in December, 1993 tax assessment, where upon I
brought it to Assessors attention that I preferred to remain in
Elk River, was told since more then half was in Big Lake, we had no
choice except to move our assessments.
WHEREAS as I will be petitioning Sherburne County to change
taxation from Big Lake Township to the City of Elk River.
THEREFORE, I humbly request supporting Resolution to move my
residence formally and officially back within Elk River by
redrawing the Township line around my residence.

real estate agreement for the ice arena project. This agreement essentially
provided for the transfer of land from the school to the city for the site where
the second ice arena is scheduled to be built.
It is anticipated that sometime on Monday, December 18, 1995, the city will
receive notification from the Minnesota Amateur Sports Commission,
regarding the status of our Mighty Ducks Ice Arena Grant Proposal. I will be
providing the City Council with a verbal update on the status of our grant
proposal Monday evening.

The enclosed maps have been revised in accordance with the discussion that
occurred at last Monday's meeting. A final draft of the Comprehensive Plan
with the necessary corrections based on the changes in the various maps has
also been included.
The following is a summary of the changes that have been made in all three
documents:
Urban Service Boundary Map
• The map has been modified by removing an area in the shape of the state
of Nevada. The area is bordered by County Road 12 on the north,
Fillmore Street on the east, 165th on the south, and Tyler Street
alignment on the west.
• In addition, the area between County Road 12 and 13 and east of
Cleveland Street has also been removed.

• The area north of Sax Foods to 197th Avenue has been amended to a land
use designation of HB (Highway Business). The depth of this area is 850
feet measured from the east right -of -way of Highway 169.
• The industrial land use at the intersection of County Road 12 and 13 has
been modified per Mr. Deschene's request. The residential areas within
the urban service area have a land use designation of MR (Medium
Density Residential) and the areas outside the urban service boundary
will maintain the land use designation of LR (Low Density Residential).

Attached for your review is the October 30, 1995 memo regarding the Cass
property that I have previously provided to the City Council. The
attachments to this October 30, 1995 memo are not included, but are
available upon request. The Planning Commission reviewed this land
purchase proposal at its November 26, 1995 meeting and recommended
approval.
The Council should be familiar with this land purchase proposal as it has
been discussed at a number of Council meetings. A brief presentation is
scheduled for the December 18, 1995 meeting and staff will be available to

The land is to be used for recreation purposes, WWTP sludge purposes and
the balance will be sold for single family home sites. In the future (15 or 20

SUBJECT: Cass Property
The city has had a long - standing goal of obtaining land and developing an
active recreation field complex. The focus has mainly been on youth fields for
soccer and baseball, but the need also includes adult softball. Another
different goal of the city that relates to this proposal is the ultimate need to
obtain more land for the disposal of Wastewater Treatment Plant (WWTP)
sludge material.
The city has been looking for suitable land for the development of youth
recreation fields for a number of years and the city has basically been
unsuccessful in its attempts to locate available land. In the last year or so,
• the Jack Cass property has become available, and this land appears to meet
our needs for the future development of youth recreation fields and for
providing additional land for the disposal of WWTP sludge.
The property under evaluation is 115.65 acres in the southeast part of the
community. This land is directly south of the 120 acres that the city obtained
a few years ago for the disposal of WWTP sludge. It is believed that this site
will be outside of the ultimate city sewer and water district and that Elk
River municipal utilities may very well never reach this property. (Please
see the attached maps.)
The City Council reviewed this proposed land purchase at its 9/25/95 meeting
and directed me to pursue a purchase agreement for its consideration. The
proposed purchase agreement calls for the land to be purchased for $2650 per
acre or $306,472.50. This price is 6 percent higher than the $2500 per acre
market value opinion that is in the appraisal that the city had completed for
this property. This price is also about 2.47 percent above the average of the
adjusted sales rate of $2586 per acre that was used to determine the
recommended value. This appraisal was completed by Riverside Appraisals
in July, 1995.
I had very little chance of getting Mr. Cass to accept the $2500 per acre
amount, but I believed I had a reasonable chance to get Mr. Cass to accept

�- the $2586 per acre amount. This belief was in spite of the fact that Mr. Cass
had offered the land to the city for $2650 per acre which was substantially
lower than his original price of $3000 per acre. I was not successful in
getting Mr. Cass to agree with our logic and accept the $2588 per acre
amount, but I was successful in arranging an appropriate timing for payment
of the property. Under the terms of the purchase agreement, the city will pay
$10,000 earnest money in October (50 percent returnable if the project is not
approved), an additional $50,000 at the end of December, 1995, and the
balance of approximately $246,500 to be paid on March 15, 1996. The
payment of the balance in March, with zero interest, will make the city a few
thousand dollars based on the interest revenue we will derive from our
investments on a quarter of a million dollars. Interest revenue for three
months is roughly half the difference between the $2650 asking price and the
$2586 average sales rate that was identified in the appraisal.
In general terms, the city hopes to use approximately 25 acres of the site for
the development of youth recreation fields and parking areas in the next few
years. The fields would be located on the northwestern side of the property.
This area is somewhat limited due to the location of the wetlands and the
abandoned judicial ditch No. 1. Nonetheless, we should be able to get at
least four soccer fields, four youth baseball fields, and parking space into this
area. Also in 1996, we plan to designate approximately 40 acres of the site
for WWTP sludge disposal. Due again to the location of the wetlands and the
abandoned judicial ditch No. 1., 30 of this 40 acres would be usable for
disposal of sludge. This area is located in the southwest part of the property.
Once this area has been fully utilized for sludge disposal, the land would
then become available for the development of recreation fields. This would
happen in about 15 to 20 years. Finally, most of the balance of the property
in the northeastern part of the site is proposed to be platted and put on the
market for single family home sites. This area is less usable for sludge
purposes or recreation field purposes, and it is believed that residential sites
could be marketed and sold in order to recapture some of the original
purchase price of the property. (Only the north central part of this future
residential area could be used for recreation fields if the approach to market
residential sites is rejected by the City Council.) The balance of the property,
approximately 10 acres south and east of the recreation fields, would be
retained by the city as wetlands.
If this project moves forward, approximately eight recreational fields will
immediately be developed. Additionally, sludge land is available for eight
more fields in 15 to 20 years. Finally, there is sludge land immediately north
of this site that also will have reached its maximum usage in 15 or 20 years
that also could then be developed into recreation fields. This availability of
land could give the city an active athletic complex of approximately 25 fields
that could meet our long term needs as a community. Again, this area would

40 be outside of the city sewer and water district and therefore would not be
taking prime real estate out of the tax base.
An additional note about this area is that the draft long range transportation
plan calls for a north /south connector in the Jarvis and 165th location to
hook up to Fillmore at 175th Avenue and eventually to County Road 12 and
13. This north /south link would make this area of the community much more
easily accessible to all of our residents.
If this approach for use of this property is accepted by the City Council, it is
planned that the city would finance this purchase with WWTP funds,
revenue from the future residential sites, and park dedication monies. Since
the WWTP is going to use approximately 40 acres of the land for sludge
purposes for 15 to 20 years, this department would pay the going rate or
about $107,700 for this property. The city would then have to use some
internal funds to finance the balance of the purchase, but would hope to
recapture most of this approximately $200,000 through the selling of some
residential building sites. An opinion by local real estate agent Mel Beaudry
indicates that the city could recapture approximately $200,000 through the
selling of six residential properties. This would be an approximately 7 acre
residential site in the corner of Joplin and 165th, an approximately 14 acre
site immediately south of this property, and for residential sites of
approximately 4 acres each along 165th, immediately west of the 7 acre site.
All of these residential sites would touch on the abandoned judicial ditch and
wetlands area and therefore limits the usability of this property for city
purposes. Please see the attached letter from Mr. Beaudry dated 8/28/95,
and please note that the estimates for lot sizes are low as the total residential
area exceeds 40 acres.
With the selling of some land for residential lots and the funding from the
WWTP, it appears that the city will recapture most of its purchase price. It
may not recapture all of the expenses related to this project due to the cost to
plat the property, sell the land, the environmental analysis, soil surveys, etc.,
and other work that has been and will need to be completed. Nonetheless,
the actual outlay from the city's park dedication fund will be somewhat small
for the obtaining of land for the development of recreation fields. The
expenses related to the development of the recreation fields is another issue
that needs to be explored and analyzed in detail if this project is to move
forward. It is assumed that some of the development activities would be
contracted out while some of the other development work would be completed
by our city park and street crew. The funding for the development of the
fields would have to come mainly from the park dedication fund, but could
also come from the youth organizations that would be utilizing the fields.

The city has had soil borings and the soil analyzed for the future building
sites and every indication is that the six building sites are suitable for the
construction of a home. The city has an appraisal and real estate opinion
completed for this property. The city has a recommendation from the Park
and Recreation Commission from its 4/19/95 meeting that supports this
purchase. The city has had a wetlands analysis completed which shows that
any wetlands impacted by this project can be mitigated on site. The city has
had a phase one and phase two environmental audit completed for this
property and it appears that there are no contaminants or environmental
issues that would restrict the city's use of this property. It should be noted
that the city will request the residential lots to have deep wells constructed
in order to minimize the nitrates that are in the soils from years and years of
farming this area.
The City Council should note the property that the city hopes to sell for real
estate purposes is currently in the 2.5 acre residential zone of the city. This
potentially could change with the adoption of the Comprehensive Plan
update and with any zoning code or subdivision changes that may go along
with the updated Comp Plan. Additionally, if this area is ultimately viewed
as land that may be serviced by municipal sewer and water, this may change
the scenario and the opinion of staff on the desirability of this transaction. If
this project moves forward, the City Council ultimately would have to
• approve a plat for this property that may include a service drive or common
driveway easements in order to limit the access onto 165th. Additionally, the
city may want to identify building location pads for the lots to be sold and/or
the type of structures that could be constructed on the property. These are
decisions for the future if this project moves forward. The same is true as to
deciding whether or not the city should be the real estate agent selling these
properties or if we should just contract this out to professionals in the
industry and have them market and sell the sites for the city.
There are many reasons for the city to move forward with this project
including the need for recreation fields, the need for additional sludge land,
and the need for the city to be creative financially so that it is not a burden
on the taxpayers or any of our funds to pursue the development of recreation
fields. Some reasons to not do this project include the concerns over the
future zoning, lot size requirements, and sewer and water in this area. Also,
there is a concern about the city getting into the real estate business, but it
should be noted that this is not the primary purpose for this land acquisition,
but simply a by- product that the city is going to take advantage of in order to
recapture some of its expenditures.
The City Council needs to make a preliminary decision as to whether or not
• we want to pursue this project. By authorizing the execution of the purchase
agreement, the city runs the risk of losing $5,000 if we do not finalize this

purchase. If we enter into this purchase agreement, the land acquisition is
• scheduled for a public hearing before the Planning Commission in November
and the City Council on December 18, 1995. A public hearing for the
acquisition of property by a municipality is required by state law. The City
Council may dispense with this requirement if it finds by a two -third vote
that the proposed acquisition has no relationship to the Comprehensive Plan.
Following the scheduled December 18, 1995, City Council public hearing on
this land acquisition, we will need to reach a final decision on whether or not
this land acquisition and project is worth pursuing and finalizing. The
purchase agreement calls for a decision and the exchange of funds on
December 26 with the balance to be paid on March 15, 1996.
Staff recommends approval of the project as discussed on 9/25/95 and as
outlined above.

SUBJECT: Acquisition of Park Land from the
Shiely Company/ Public Hearing
The purchase of park land from the Shiely Company involves approximately
30 acres of dry subtype oak forest identified as naturally significant by the
Minnesota Department of Natural Resources. The purchase of this property
will also preserve significant geological features of moraine, which is one of
the highest points in Elk River. Additionally, the purchase of this property
will provide approximately 2.5 kilometers of recreational trail for wildlife
watching, environmental education, hiking, and skiing. There is a map
attached to this memo showing the location of the property.
The second attachment to this memo is a copy of the revised Comprehensive
Park Plan. You can note that where the property in question is located, a
trail was identified. This trail is a link in an important future east /west trail
corridor tying into the railroad hiking trail, Woodland Trails Park, and Top
of the World Park. The Park and Recreation Commission has recommended
the city purchase this property for park purposes.
The Planning Commission is also recommending the city purchase this
property. They felt the purchase of this parcel is consistent with the
Comprehensive Plan (Master Park Plan). It accommodates an east /west trail
corridor identified in the park plan, preserves significant natural amenities,
and creates recreational opportunities.
The Planning Commission is further recommending the city uses the
$45,500 natural and scenic grant from the he Department of Natural
Resources that has been approved, and park dedication fees to fund the
purchase. Staff is proposing a maximum purchase price (grant and park
40 dedication) of $91,000. This price is consistent with the appraisal that was
done.

Mike Niziolek reviewed the grant proposal to acquire 30 acres of dry subtype oak •
forest from the J.L. Shiely Company to be used as an off -road trail system through
park land. He stated that the total cost of the site acquisition is $90.000. The
grant will cover half of this amount ($45.000) contingent on the city paying the
other half ($45,000).
The City Council discussed funding of the site acquisition. Mayor Duitsman
indicated that the funds would have to come from the Pork and Recreation fund
and stated that there is not enough money in that fund to cover all the requests
and needs at the present time.

Councilmember Dietz indicated his concern regarding the need for ballfields in
the City of Elk River.
Mayor Duitsman opened the public hearing.
Phil Johnson stated that the area is very beautiful and that he is in favor of the
city acquiring the land.
Charles Blood, 12263 Ridgewood Drive, indicated he supports the city purchasing
the property. He indicated that the city needs to preserve its forest and wildlife
land.
Councilmember Farber indicated his support toward the city matching the grant
fund money.
Robin Tuttle stated that the applicant of the grant must address how the
matching funds would be acquired.
Mayor Duitsman indicated that any funding needed will be competing with
athletic fields. He further indicated that he can support moving forward with the
grant application, but the issue of funding must be brought back to the Park and
Recreation Commission for a recommendation to the City Council.
There being no further comments from the public, Mayor Duitsman closed the
public hearing.

Overview
The subject property was originally platted as Elk Park Center Addition and
consisted of numerous lots between Freeport Avenue and Jackson Avenue.
The proposed plat is a replat of Lots 1 and 4, Block 2, which is located in the
area where Cub Foods is now being constructed. The replat involves the
adjustment of one lot line and the creation of one additional lot. This request
is being brought forward to accommodate some of the minor changes that
have occurred with building locations as part of the Cub Foods site plan.

This replat of Elk Park Center could have been accommodated through the
administrative subdivision process; however, as Kraus- Anderson has done in
the past with the replatting of the north end of the PUD, an actual plat has
been prepared for recording with the County. The advantage of recording an
actual plat clearly simplifies the legal descriptions as a lot and block
description as opposed to a metes and bounds description. The new lot that
is being created exceeds the minimum lot size of one acre and is being platted
to accommodate a separate tenant if Cub Foods decides not to make their
future expansion to the south. Once again, the adjusted property line on the
north side corresponds with the reconfiguration of Cub Foods and a potential
tenant that may be occupying space north of Cub Foods.
Recommendation
It is recommended the City Council consider the following:
Approve preliminary plat request by Kraus- Anderson for Elk Park Center
4th Addition; and,

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
ELK PARK CENTER 4TH ADDITION
CASE NO. P 95 -7
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property "; and
WHEREAS, a preliminary and final plat of the Property was approved by
the City Council on December 18, 1995; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including , but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.

D. The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse
impact on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.

Overview
Elk River AutoMall is actually making two applications before the City. The
first for an administrative subdivision to divide the existing parcel into two
separate lots and a variance because one of the lots will have a lot area less
than the one acre minimum. The existing auto mall lot has an area of 3.76
acres at the present time. The proposed administrative subdivision would
divide that acreage into a 2.91 acre site and a .85 acre site. The primary
reason one of the lots will not meet the minimum acreage requirement is due
to the need to provide the required number of parking stalls on each parcel.
Given the configuration and distribution of parking on the entire auto mall
site, the southerly parcel ends up being .85 acres in size.
• This variance request is similar to other requests that have been approved
such as Freeport Financial Center, Elk Park Center, and the Elk River Retail

• Center. The important issue here is that the variance and administrative
subdivision will not allow the property owner any special privileges or
further development opportunity by having the variance granted. Both
applications are being brought forward to facilitate an ownership issue with
the auto mall.
Please refer to the attached report to the Planning Commission for additional
information.
Planning Commission Recommendation
The Planning Commission reviewed this item at their November public
hearing and recommended approval of the variance request with the findings
outlined in the staff report.
Recommendation
It is recommended the City Council approve the .15 acre variance request to
the minimum lot size of one acre in the C3 commercial zoning district for the
Elk River AutoMall based on the following findings:
• 1. That the special conditions and circumstances which exist are peculiar
to the auto mall development and that it is a unified development
with common parking and driveways that for all practical purposes
will function as one development.

Analysis
The Elk River Auto Mall consists of approximately 22,000 square feet of
building area. This building area is divided into two separate structures, one
of which has approximately 16,500 square feet and contains three of the auto
repair businesses. The southerly free standing building has approximately
6,500 square feet and contains one auto related use and a proposed medical
related business. The entire auto mall is accessed via Carson Street which is
a private street serving all of the businesses north of Main Street including
Pizza Hut, SuperAmerica, and Burger Time.

When the auto mall was proposed before the Planning Commission and City
Council the project consisted of one parcel. Elk River Auto Mall LLC is now
requesting to divide .85 acres off the south end of the project allowing the
southerly free standing building along with its required parking to be sold
separately. A variance of .15 acres from the minimum lot size of one acre is
necessary in order to accomplish the proposed subdivision and transfer of the
southerly portion of the existing auto mall.
Minimum Lot Size
As mentioned above the minimum lot size in the C3 (Highway Commercial)
zoning district is one acre in lot area and 100 feet in width. The existing auto
mall has a lot area of 3.76 acres at the present time. The proposed
administrative subdivision would divide this acreage into a 2.91 acre site and
a .85 acre site. Given the amount of total acreage, it is obvious that two
parcels which meet the city's one acre minimum could be accomplished.
However, each parcel also has to be able to stand on its own by providing its
required parking on the given parcel. Therefore, due to the distribution of
parking on the auto mall complex, in order to subdivide off the southerly
building and allow each parcel to have enough required parking on each
. parcel, the maximum size of the southerly parcel turns out to be .85 acres.
It is also worth mentioning that because Carson Street is a private road,
none of the businesses along this street meet the minimum lot width
requirements. The ordinance states that the 100 foot lot width requirement
must front onto a public street, which the auto mall does- not meet. However,
the City Council has approved a private roadway agreement for all the
businesses along Carson Street which has allowed the subdivision of these
lots to occur in the past avoiding the need to meet lot frontage requirements.
Variance
Subdivisions of this nature have occurred in other commercial and office
building developments. The common characteristic in all of those
subdivisions is that each of the lots have been a part of either a commercial
PUD or a common development such as the Freeport Financial Center. The
requested variance by the Elk River Auto Mall LLC fits within these
perimeters in that it is a unified auto mall development and the subdivision
is merely necessary to convey separate ownership of a portion of the auto
mall.

• Recommendation

one is held by the Bank of Elk River, and the Elk River EDA has a second
mortgage on the property, too. There is some concern on the lender's behalf
regarding their equity position if one of the parcels is to change ownership.
Therefore, before this administrative subdivision can be recorded at the
County, a condition will be made part of this approval that all of the lender's
concerns be satisfied.

The Planning Commission did not review this application because the
administrative subdivision only requires Council
Recommendation
It is recommended the City Council approve the administrative subdivision
for Elk River AutoMall to divide a 3.76 acre site into a 2.91 and .85 acre site
with the following condition:
. 1. Prior to recording the administrative subdivision, a letter of approval
be received from the Bank of Elk River stating their concerns have
been satisfied.
