Ach City Planner DATE: November 20, 1995 SUBJECT: Conditional Use Permit Request by Novco, Inc., Public Hearing Case No. CU 95 -23 Novco, Inc. is requesting a conditional use permit to construct a second principal structure and operate a truck terminal in a light industrial zoning district_ Location • Lot 4, Block 1, Rail 10 subdivision (17230 Ulysses Street) L Zoning/Land Use I -1 (light industrial) /L -I (light industrial) Attachments • Reports to the Planning Commission dated September 26 and October 24, 1995. • Plans submitted by Novotny's (Exhibit A) • Site plan approved by the Planning Commission (Exhibit B) Overview Novco, Inc. originally constructed a 2,560 square foot building in 1993 for the purpose of storing trucks. Since that time the business has evolved into more of a truck terminal, which is a conditional use in the light industrial zoning districts. Therefore, this conditional use permit not only applies to the second principal structure but also grants a conditional use permit for Novco to operate a truck terminal on the subject property. 13065 Orono Parkway • P.O. Box 490 • Elk River, MN 55330 • (612) 441 -7420 • Fax: (612) 441 -7425 Page 2 • Proposed Office Building The proposed office building will be approximately 520 square feet in size and will resemble a small residential garage. This structure will be used as part of the Novotny trucking business as an office and dispatch center. The architectural material proposed for this new structure will meet all the requirements listed in the city zoning ordinance. • One of the concerns staff has with the proposed location of the second building is its proximity to the existing septic field. Staff would recommend that proper separation between the building and septic system be maintained to protect the drain field from being damaged during construction. Compliance With Approved Site Plan One of the issues the Planning Commission was concerned with is Novco's lack of improvements from their approved site plan in 1993. The Planning Commission requested that Novco provide the Planning Commission a site plan illustrating existing and proposed landscaping, location of bituminous surface as well as required curbing. This plan is attached as exhibit A in the Council's packet. The one improvement that is not clearly reflected on Novco site plan is the installation of curb and gutter for parking areas within the front yard as required in the city's ordinance. The attached site plan labeled exhibit B is the plan which was approved by the Planning Commission, which for the most part corresponds with Novco's plans except for the installation of curb and gutter in the front of the buildings. Planning Commission Recommendation The Planning Commission recommended approval of the conditional use permit by Novco, Inc. to operate a truck terminal and construct a second principal building with the following conditions. 1. All site improvements shown on the site plan labeled Exhibit B, be installed and completed by June 1, 1996. 2. The improvements to the parking lot include bituminous surface and curb and gutter from the property line to the front building face as required in the performance standard section of the zoning ordinance. Bituminous millings may be utilized on that portion of the parking area where trucks will be parking and maneuvering. s:council/CU95 -23 Page 3 3. Additional information be provided to the building department • verifying the location of the existing septic system, assuring staff that there will be no conflicts of the proposed building in the existing system. • is 4. The building official and fire chief perform an inspection of the existing building to determine if all codes are met relative to the existing use of the building and outdoor storage tanks. 5. Four sets of revised site plans reflecting conditions of approval be submitted for staff review and approval prior to issuance of a building permit. Ach, City Planner_,, DATE: October 24, 1995 SUBJECT: Conditional Use Permit Request by Novco, Inc., Public Hearing Case No. CU 95 -23 Novco, Inc. is requesting a conditional use permit to construct a second principal structure and operate a truck terminal on an industrial lot in Rail 10 Industrial Park. Back - 'round This item was presented to the Planning Commission on September 26th. The Planning Commission tabled this item until the October 24th meeting to allow the applicant an opportunity to prepare a site plan illustrating the existing and proposed improvements to the property. Since the Planning Commission meeting, the applicant has submitted a plan to staff outlining the existing conditions, as well as the improvements they would like to install. Please refer to the attached Planning Commission report dated September 26, 1995, for additional information on this particular request. Revised Site Plan Attached are two exhibits for the Planning Commission's consideration. The first is a plan submitted by the applicant (Novotnys) illustrating the existing conditions and the improvements that they would like to install. The second exhibit is the same site plan with some modifications made by staff that will be recommended to the Planning Commission. The two primary differences between the plans submitted by Novotnys and staff's recommended plan is the following: (1) As outlined at the last Planning Commission meeting, Novotny's current parking area consists of both a bituminous surface as well 13065 Orono Parkway - P.O. Box 490 - Elk River, MN 55330 - (612) 441 -7420 - Fax: (612) 441 -7425 Novotny Conditional Use Permit October 24, 1995 Page 2 as an area improved with bituminous millings. Staff is recommending the • area utilized by vehicles be improved with a bituminous surface. (2) The plans submitted by the applicant does not include any curb and gutter. This standard was included as part of the City's performance standards subsequent to the building being constructed in 1993; however, as part of the parking lot improvements that need to be completed staff is recommending that the curb and gutter be installed in accordance with the zoning ordinance. This improvement will be consistent with some of the surrounding property owners. • Recommendation It is recommended the Planning Commission approve the conditional use permit request by Novco, Inc. to operate a truck terminal and construct a second principal building with the following conditions: 1) All site improvements shown on the approved plans dated 11/10/93 be installed and completed by June 1, 1996. 2) The improvements to the parking lot include bituminous surface and curb and gutter from the property line to the front building face, as required in the performance standards setforth in the zoning ordinance. 3) Additional information be provided to the building department, verifying the location of the existing septic system, assuring staff that there will be no conflicts with the proposed building and existing system. 4) The building official and fire chief perform an inspection of the existing building to determine if all codes are met relative to the existing use of the building and outdoor storage tanks. s:p1annin g:p c:cu95 -23x PLAN SUBMITTED BY NOVOTNY'S 'io :° ' • 25.00' •:• i!,40AO•:, tip Q '•,•'. 1• \• • .. t ,,,25.00_ 0•. wt .• ' ► 20'1 '$ tA 1 R VI 4 _ 18.58 OMAN 47. `r• ' 7 • ` N-0 -- • . Ach, City Planner–lve&417— September 26, 1995 SUBJECT: Conditional Use Permit Request by Novco, Inc., Public Hearing Case No. CU 95 -23 Request ITEM 5.10. Novco, Inc. is requesting a conditional use permit to construct a second principal structure and operate a truck terminal on an industrial lot in Rail 10 Industrial Park. Location Lot 4 Block 1, Rail 10 Subdivision (17230 Ulysses Street). Zoning/Land Use I -1 (Light Industrial) / L -I (Light Industrial) Attachments • Location Map • Zoning Map • Exhibit A (approved site plan) • Exhibit B (proposed site plan) • Excerpt from Performance Standards Backaroand Novco, Inc. originally constructed a 2,560 square foot building in 1993 for the sole purpose of storing a couple of trucks. In order to construct this building, Novco was required to go through a site plan review process prior to receiving a building permit. Attached is Exhibit A illustrating the plan that was approved on November 10, 1993. The proposed site plan illustrating the second accessory building is attached and labeled Exhibit B. 13065 Orono Parkway • P.O. Box 490 • Elk River, MN 55330 • (61 2) 441 -7420 • Fax: (61 2) 441 -7425 Proposed Use • When Novotn Y s originally constructed the building, it was presented as a building that would be used for storage and warehousing which is a permitted use in the I -1 (Light Industrial) zoning district. Under that interpretation, staff proceeded to review their proposed site plan and issue a building permit based on that particular use. However, with the addition of the second principal building which will serve as an office area and the current operation of the facility, staff believes a better interpretation of the use is a truck terminal. A truck terminal is a conditional use permit in the light industrial district; therefore, this conditional use permit request has been expanded to include a truck terminal, as well as the second principal use. Proposed Office Building The proposed office building will be 520 square feet in size and will resemble a small residential garage. The structure will have a hip roof with asphalt shingles and pre - finished vinyl siding on all sides. These architectural materials meet the city's architectural requirements listed in the zoning ordinance (see attached excerpt from performance standards). The proposed second building meets all of the industrial setback requirements; however, staff is concerned with its location if it interferes with the existing septic system. The approved site plan from November of 1993 indicated the septic system on the west side of the property; however, staff believes it was relocated to a location close to the proposed building. Therefore, additional information will need to be provided to make sure the building does not interfere with the existing septic system. Compliance with Approved Site Plan The approved site plan from November 1993, illustrated a bituminous parking surface along with landscaping that was to be installed as part of the improvements. Staff is concerned that these improvements have not been installed in accordance with the approved plan and would recommend that a condition of the conditional use permit state that the improvements be installed prior to June 1st of 1996. Since the original site plan was approved in November of 1993, the Planning Commission and City Council have approved anordinance requiring curb and gutter within front yard areas of industrial development. Furniture and Things located across the street and Custom Cutter and Grinding (under • construction) have both installed curb and gutter in accordance with city s:p lanningpc:cu95 -23 ordinance. Therefore, staff recommends Novco, Inc. also install curb and gutter along with the paving of their parking and drive areas. Recommendation Staff recommends approval of the conditional use permit request by Novco, Inc. to operate a truck terminal and construct a second principal building with the following conditions: 1) All site improvements shown on the approved plans dated 11/10/93 be installed and completed by June 1, 1996. 2) The improvements to the parking lot include curb and gutter from the property line to the front building face, as required in the performance standards setforth in the zoning ordinance. 3) Additional information be provided to the building department, verifying the location of the existing septic system, assuring staff that will be no conflicts with the proposed building and existing system. 4) The building official and fire chief perform an inspection of the existing building to determine if all codes are met relative to the existing use of the building and outdoor storage tanks. s:p lanning:p c:cu95.23 EXHIBIT .::.
