SUBJECT: Conditional Use Permit Request by Shea Architects (TCF Financial Corporation), Public Hearing Case No. CU 95 -25 Issue Shea Architects, representing TCF Financial Corporation, is requesting a conditional use permit for site plan review to construct a financial institution in Elk Park Center Planned Unit Development. • Location Lot 2, Block 1, Elk Park Center 3rd Addition (northeast corner of Jackson Road and Freeport Avenue). Zoning/Land Use PUD (Planned Unit Development) / HB (Highway Business) Attachments • Revised development plans dated 10/18/95 • Report to the Planning Commission dated 10/24/95 Overview Twin City Federal (TCF) Financial Corporation is requesting a conditional use permit to construct a 5,179 square financial institution, along with a multiple lane drive -up area. The anticipated hours would be as follows: Lobby hours - 9 a.m. to 7 p.m., Monday through Friday 8 a.m. to 1 p.m. on Saturday Drive -Up Window - 7 a.m. to 7 p.m., Monday through Friday 8 a.m. to 1 p.m. on Saturday Site Plan Review As part of the Planned Unit Development for Elk Park Center, all new construction is required to obtain a conditional use permit for site plan review. Therefore, TCF has submitted some plans for staff review which have been provided to the Planning Commission and are now presented for the Council's consideration. In the report to the Planning Commission dated October 24th, staff has provided a list of comments based on the original plans submitted by TCF. Since preparing these comments, TCF has provided revised development plans dated October 18, 1995. These plans have been • amended to address a majority of the concerns listed in staff's memo to the Planning Commission. The following are comments from staff's memo to the Planning Commission which deserve some additional attention prior to approving the final plans: • Comment B.S. The westerly entrance to the TCF site will need to line up with the entrance south of Freeport into the Cub Store. The proposed driveway is close to lining up, however, will need to be confirmed prior to site plan approval. Comment C.2. Protection of existing trees will need to occur during the construction process. Comment C.3. It may be appropriate to locate a couple of overstory trees between the two berms along Freeport Avenue to diversify the landscaping along this area of the site. Comment CA. The berm adjacent to the westerly drive could be increased slightly in height to add additional screening and buffering to the drive -up area. s: council: cu95 -25 Shea Architects/TCF Page 3 November 20, 1995 • *Comment D.2. The Planning Commission discussed a location for a sidewalk to serve not only the TCF site, but also the northerly parcel from Freeport Avenue. It was recommended by the Planning Commission that a sidewalk be installed along the west side of the private road from Freeport up to the northerly property line. By including a sidewalk on the west side of the private road, TCF has indicated that they could then extend a short segment of sidewalk from their building to this proposed sidewalk to accommodate pedestrian traffic. An additional easement may be necessary to accommodate the sidewalk. Comment D.3. Final development plans will have to reflect the appropriate pedestrian ramps at locations along Freeport. Comment G.1. A permit from Mn /DOT for grading within the right -of -way will need to be obtained prior to issuance of a building permit. City Engineer Comments 4. An easement to cover the sidewalk along Freeport that encroaches on • TCF's site will need to be executed. Planning Commission Recommendation The Planning Commission recommended approval of the conditional use permit request by Shea Architects and TCF with the conditions outlined in the staff report and including the condition relative to providing a six foot sidewalk along with the appropriate easements along the west side of the private road from Freeport Avenue to the north property line. Recommendation It is recommended the City Council approve the conditional use permit request by Shea Architects and TCF for site plan review to construct a 5,179 square foot financial institution with the following conditions as outlined by the Planning Commission: ALL COMMENTS LISTED IN THE REPORT TO THE PLANNING COMMISSION DATED OCTOBER 24, 1995, BE INCORPORATED INTO THE REVIEW PLANS FOR APPROVAL. 2. The site proposed to be developed by TCF is the southernmost parcel of the recently replatted Elk Park Center Third Addition. 13065 Orono Parkway • P.O. The Concept Review Committee has conducted a complete review of the proposed development plans and offer the following comments: A. Site Plan 1. All building and parking areas have been designed to meet the required setbacks as set forth in the approved development plans for Elk Park Center PUD. • B. Parking and Circulation 1. Based on the size of the financial institution and the city's parking requirements, adequate parking has been provided on site. The required number of stalls is 26 and 27 stalls have been provided. 2. The city's ordinance requires five spaces for stacking distance behind each drive up window, however, given the number of drive through lanes and the number of cars that can be serviced through the drive up lanes, staff does not believe that five stacking spaces is necessary in this case for every drive up window. 3. The parking area has been designed with a "dead end" parking area. This type of design can cause problems if all of the parking stalls are occupied and vehicles are required to turn around or back up within the parking area. A desirable solution would be to redesign the parking area to allow full access to the private road on the east side of the property, allowing full circulation to occur through the parking area. The exit drive from the drive up windows to the private road intersects at an angle less than 900 rather than a preferred 90 degree intersection. Furthermore, this driveway will function as an exit only, therefore it can be reduced in width to roughly 20 feet, further encouraging the one way nature of the driveway. 5. The westerly entrance drive off of Freeport Avenue should line up with the proposed driveway which will extend south of Freeport Avenue to access the Cub Foods site. The proposed driveway is close to the appropriate alignment, however it needs to be slightly adjusted so the center lines of each driveway match up. 6. The private driveway along the east side of the site actually occurs on Lot 1 of Block 1, Elk Park Center Third Addition. This driveway will provide access not only to the TCF site, but also the property to the north. With the redesigning of the parking area and providing another access point onto the private road, the road will have to be built far enough north to accommodate the traffic demands of this development. • C. Landscaping 1. The submitted landscape plan has provided adequate numbers to meet the city's zoning ordinance and requirements set forth in the Elk Park Center Planned Unit Development Agreement. However, additional trees (conifers) may be necessary along Jackson Road to enhance the screening towards the residential area. 2. The existing trees along Jackson Road should be protected during the construction and incorporated into the final landscape plan. 3. Some of the proposed plant material should be relocated to the Freeport Avenue side of the site to provide a balance of the landscape plan. Relocating some overstory trees would satisfy staff concern. 4. A 3 to 5 foot high berm with some shrubs should be incorporated along the south side of the drive up window to help screen and • soften the visual impact of this large vehicle use area. This type TCF CUP 95 -20 October 24, 1995 ------------------ - - - - -- Page 4 of treatment was accomplished on First National Bank's building constructed within the Elk Park Center development. 5. Depending upon the final design of the drive aisles as they intersect with both the private road and Freeport Avenue, site visibility triangles will have to be kept clear of plant material to maintain adequate visibility for exiting and entering traffic. 6. Underground irrigation shall be provided throughout all landscape areas as set forth in the Planned Unit Development Agreement. 7. Sod will be necessary on all disturbed areas. This includes sodding along each side of the private road on the east side of the project. D. Pedestrian Circulation All sidewalks that are perpendicular to the parking areas will need to be six feet in width. . 2. Similar to the other commercial developments in Elk Park Center, consideration should be given to providing a sidewalk extension from Freeport Avenue to the bank facility. This type of improvement is suggested to try to encourage and accommodate pedestrian traffic throughout this entire development. 3. With the construction of the new driveways onto Freeport Avenue, new pedestrian ramps will have to be constructed for the sidewalk along Freeport. E. Refuse Collection 1. The refuse enclosure shall be large enough to accommodate recyclable items. 2. Enclosure shall consist of material similar to building. F. Drainage and Utilities 1. Please refer to the city engineer's memo dated October 17, 1995, • for a description of issues. TCF CUP 95 -20 October 24, 1995 ........................ G. Miscellaneous Page 5 1. A permit from MnDOT will be required to allow grading within their right -of -way. H. Signage 1. TCF is proposing to have two wall signs and one freestanding sign. The freestanding sign is a monument style that complies with the sign standards set forth in the PUD Agreement. The two wall signs will be on the east and west elevations. These signs also meet the requirements found in the PUD Agreement. I. Police Department 1. The Police Department has requested to meet with TCF at some point to review security issues. Staff has met with Shea Architects and TCF to discuss the issues mentioned in this report. At the time of preparing this report, revised plans had not been received, therefore, the comments relate to the original submitted plans. If staff receives the revised plans prior to the reports going out to the Commission members they will be included. Several of staff's comments should be addressed in the revised plans. Recommendation It is recommended the Planning Commission recommend approval of the CUP request by Shea Architects and TCF for site plan review to construct a 5,179 square foot financial institution with the following conditions: 1. All comments listed in the report to the Planning Commission dated October 24, 1995, be incorporated into the review plans for approval. 2. The city engineer comments outlined in the memo dated October 17, 1995, be incorporated into the plans. 3. Box 490 Elk River, MN 55330 RE: TCF BANK Dear Mr. Ach: As requested, we have reviewed this submittal package prepared for the TCF Bank facility located at the northern end of Elk Park Center. The package was prepared by Shea Architects and consisted of a site plan, grading plan, utility plan, planting plan, and exterior elevations. These various plans were dated September 25 and 26, 1995. As you are aware, there was a concept review meeting on October 10, 1995, to discuss this proposal. Also, on October 13, 1995, you and I met with representatives of TCF and Shea Architects to discuss points of concern. Based upon our review and comments received at these various meetings, I would offer the following comments: 1. Our biggest concern with this site plan is the traffic flow into and out of the site from Freeport Avenue. The only means of entrance to the site is the driveway along Freeport Avenue located approximately 150 feet from Jackson Road. Cars utilizing the drive -up facilities would then exit via the private road on the east side of the property. Cars utilizing the parking lot and walking into the facility would be forced to exit the same method by which they entered the site, off of Freeport Avenue. We are concerned about the potential traffic congestion problem at this Freeport Avenue driveway. A drive -up bank facility tends to have a peak traffic generation between 4:00 and 6:00 p.m., with the worst occurrence being on Friday afternoon. This will correspond to other peak traffic along Freeport Avenue. Our first suggestion would be to reconfigure the site so that traffic using the drive - up facility enters off of the private road further away from the intersection of Jackson Road and Freeport Avenue. After having met with representatives of TCF and Shea Architects, we find that it is critically important to the operation of the bank to have it situated in the manner that is shown, that is with the drive -up facilities in front of the bank in clear view of traffic. An Equal Opportunity Employer Mr. Steve Ach • October 17, 1995 Page Two Our second alternative to hopefully alleviate any potential problems here would be to construct an exit from the parking area along the north property line to the east, connecting to the private road, then, if there is a problem, make the entrance off of Freeport Avenue an entrance only, allowing no exit from the site, or possibly just restrict left turns out of this driveway. This would eliminate any potential conflicts with vehicles entering and vehicles trying to exit. This was discussed with Larry Rose of TCF and he agreed. In addition, the driveway access off of Freeport Avenue needs to be relocated slightly to the east to line up directly with the entrance to the Target site. 2. The internal entrance to the parking area should be 24 feet wide. It scales somewhat less than that. 3. The exit from the drive -thru facility should be slightly expanded so that the far outside lane has a better chance to merge with traffic in a busy condition. Also, the intersection with the private road on the east side should be made more perpendicular. Traffic may potentially come out of there and want to turn left, heading north, or have to contend with traffic from the north. • 4. The sidewalk along Freeport Avenue as it approaches Jackson Road veers into the site. Apparently, the sidewalk alignment was chosen to preserve trees in this area. This development should provide the City with a sidewalk easement covering this section of sidewalk. 5. The drainage from the site should be contained and picked up internally. The driveway access off of Freeport Avenue should have a high point design into it somewhere near the back of the existing sidewalk. Drainage along the drive -thru access can be allowed to drain onto the private road and then be picked up prior to Freeport Avenue. 6. The private road on the east side of the property should be constructed at least to the north property line of the site with this project. Also, sanitary sewer and water needs to be extended along this alignment for future service to the north. In addition, the Fire Department would like to see a hydrant placed along the northern end of the private road for fire protection of this lot and the one to the north.
