Background
Riverside Development originally requested preliminary plat for
approximately 40 acres to be divided into 88 single family lots. This
preliminary plat was approved by the City Council on August 1, 1994, along
with a conditional use permit for a residential planned unit development.
• Earlier this year on May 15, 1995, the Council approved a final plat
consisting of 14 lots of the 88 lots presented in the preliminary plat for

• Hillside Estates 4th Addition. The developer is now requesting to plat an
additional 28 lots as Hillside Estates 5th Addition. The final plat for Hillside
Estates 5th Addition will include the construction of streets, completing the
connection between 197th Avenue and 193rd. This connection will eliminate
the long dead ends that previously occurred in developing the earlier phases
of Hillside Estates. The final plat for Hillside Estates 5th Addition has been
prepared in accordance with the preliminary plat approval given by the City
Council last August and staff comments.
NSP Power Easement
The vacant land between Hillside 4th and 5th is currently owned by the
developer and is encumbered with a 240 foot NSP power line easement. One
of the conditions of the preliminary plat approval was to have this land
included with a future final plat and that land consisting of the NSP power
easement be deeded to the City. There has been some discussion in the past
that this NSP power easement could be used as a recreational corridor since
it cannot be developed due to the overhead power lines. The developer has
indicated that the NSP easement will be included with a future plat lying
southeast of the water tower.
Parkland/Trail
• When Hillside Estates PUD was originally presented to the City Council in
1992, the trail corridor concept included establishing a north -south and east -
west trail somewhere within the PUD. As Hillside Estates has developed
over the years, a north -south trail has been discussed in previous plats and
most recently adjusted to the east edge of the development along the
Northern Natural Gas easement extending from 197th to 193rd.
The Park and Rec Commission had recommended that a 33 foot trail corridor
lying east of the 50 foot Northern Natural Gas easement be utilized as the
trail corridor. This is not reflected on the final plat because the developer
has expressed some interest in retaining the easterly 18 feet ( Outlot B and
Outlot A) of the final plat for possible future development considerations.
However, Park A and Park B as identified on the final plat represents a 50
foot corridor of which approximately 15 feet lies outside of the Northern
Natural Gas easement. In talking with Northern Natural Gas, it sounds as
though there will not be a problem with constructing a trail; however, the
City will have to present plans to Northern Natural Gas for their review and
consideration.
Attached is a map of the surrounding area illustrating existing and proposed
• pedestrian routes along with destination points. The trail corridor along the
east side of the proposed final plat will connect 197th Avenue to the proposed

park shown on the final plat, as well as the NSP power easement and
eventually, 193rd Avenue to the south. The 50 foot corridor will provide a lot
of opportunity to construct the trail and provide adequate separation
between the trail and the residential lots.
One of the concerns staff has is to make sure the trails are constructed as
part of the overall improvements. This will allow the trail to be in place so
that homeowners are fully aware of the conditions of which they are buying
J and not surprised by construction of a trail afterwards. Presently, the
city is responsible for constructing these trails and financing them out of
park dedication funds. Staff is also concerned that the funding to continue
this practice may surpass the city's revenue sources (i.e. park dedication) in
the future. Therefore, the discussion on trail construction and who should be
financially responsible will most likely be a topic of discussion with the City
Council in the future.
Recommendation
It is recommended the City Council approve Resolution No. 95- , granting
final plat approval for Hillside Estates 5th Addition to create 28 single family
lots on approximately 17 acres of land based on the conditions outlined in
Exhibit B.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR
HILLSIDE ESTATES 5TH ADDITION
CASE NO. P 94 -6
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property "; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on August 1, 1994; and
• WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including , but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
D. The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial environmental
damage.
F. The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.

1. A Developer's Agreement and PUD Agreement be prepared and executed
prior to releasing the Plat for recording.
2. Park dedication be provided in accordance with City Council approval.
3. Street lights be provided throughout the Plat as required by Elk River
Utilities and installed as part of the public improvements.
4. Payment of a surface water management fee in the amount of $3,460.80
prior to releasing Final Plat for recording.
5. Payment in the amount to be determined by the City Engineer be made to
the City to cover the cost of sealcoating the streets.
6. A complete grading and development plan be submitted for City review
and approval prior to issuance of any building permits.
7. The necessary drainage and utility easements be provided throughout the

City Planner Steve Ach indicated that Riverside Development is requesting a
preliminary plat to subdivide approximately 40 acres into 88 single family lots. He
stated that Riverside Development is also requesting a conditional use permit to
develop a residential Planned Unit Development. The PUD is an extension of the
iF Hillside Estates residential development along 193rd Avenue. Steve Ach
indicated that the property has some physical constraints including utility
easements and wetlands. He further stated that an EAW (Environmental
Assessment Worksheet) is being prepared for the plat.
Discussion was held regarding park dedication for the plat. It was indicated by
Dana Anderson, Park and Recreation Commission representative, that the
Commission has recommended a trail system in the plat. Discussion was held by
the Council regarding the issue of the trails located along the back of the lots as
recommended by the Park and Recreation Commission.
Councilmember Scheel and Vice Mayor Farber indicated their desire to see a trail
along the roadway as opposed to back yard trails. Councilmember Scheel
indicated that back yard trails were an invasion of privacy and could lead to
burglary. Vice Mayor Farber stated he felt that trails along major roadways would
be used more than trails along back yards. Discussion was held as to whether or
not a trail along the roadway would require additional right -of -way or if it would
be considered as park dedication.
Dan Tveite, Planning Commission Representative, stated that the Planning
Commission recommended approval of the conditional use permit and
preliminary plat.
There being no further comments from the public, Vice Mayor Farber closed the
public hearing.

7.3. Consider conditional use to develop a residential planned unit development (CU
94 -26) and a preliminary plat to subdivide approximately 40 acres into 88 single
family lots (P 94 -06) by Riverside Development, PUBLIC HEARING
City Planner Steve Ach stated that the City Council reviewed the conditional use
permit and preliminary plat at the July 18, 1994, City Council meeting. At that
meeting the Council discussed the appropriate park, trail and sidewalk needs for
Hillside Estates 4th Addition. Following Council discussion at that meeting, the
issue was tabled to allow the Park and Recreation Commission to further review
the park and trail issues. He further stated that the Park and Recreation
Commission met to discuss this issue on July 26, 1994, and have made the
following recommendations:

The Planning Commission and City Council require future plats in the sewer
and water district to contain sidewalks and bicycle lanes for safe non -
motorized transportation on streets that carry other than neighborhood
traffic.
The City assume ownership of the Northern Natural Gas line easement and
the NSP power line easement in Hillside Estates Development.
Auburn Street from the south plat boundary to 196th Avenue, 196th
Avenue from Auburn Street to Zane Street, and Zane Street from 196th
Avenue to 197th Avenue have a 70 foot right of way with a 6 foot wide
diamond lane for bicycle traffic added to the street width between the
curbs on the east side of Auburn Street, the south side of 196th Avenue,
and the east side of Zane Street, in lieu of the rear yard trail previously
proposed paralleling Auburn Street.
The dedicated park area described in the 6/27/94 Park and Recreation
minutes remain as previously requested should the 33 foot wide trail on the
east side of the Northern Natural Gas line easement.
Mayor Duitsman opened the public hearing.
Mayor Duitsman indicated that he does not support a 70 foot right -of -way.
Jeff Gongoll, indicated that he agrees with Staff's recommendations listed in the
Staff report.
Councilmember Holmgren questioned whether the park dedication requirement
would be satisfied. Steve Ach indicated that the requirements for park
dedication are satisfied through the 3.9 acre of park land and the corridor along
the eastern portion of the plat.
Dana Anderson, Park and Recreation Commission Representative, explained the
reasoning for recommending a trail along Auburn which connects to the 3.9
acres of park land. He indicated that this trail would move the people within the
plat to the park.
Marty Glines of Riverside Development, indicated that the proposed trails in the
plat are consistent with the City's 1988 Growth Management Plan. He further
indicated that the plan eliminates the need to cross any driveways in the plat.
There being no further comments from the public, Mayor Duitsman closed the
public hearing.
The City Council discussed the park, trail, and sidewalk options. It was concluded
that Riverside Development satisfy their park dedication requirements by
dedicating 3.9 acres for park land and a trail corridor along the east limits of the
plat.
COUNCILMEMBER FARBER MOVED TO APPROVE THE PRELIMINARY PLAT OF HILLSIDE
ESTATES 4TH ADDITION WITH THE FOLLOWING CONDITIONS:
1. A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED PRIOR TO
RELEASING THE PLAT FOR RECORDING.

2. COMMENTS FROM TERRY MAURER'S JUNE 15, 1994, MEMO BE ADDRESSED
AND INCORPORATED INTO THE PLAT.
3. A COMPLETE WETLAND DELINEATION BE CONDUCTED AND INCORPORATED
INTO THE PLAT. ALL IDENTIFIED WETLANDS SHOULD BE PROTECTED WITH A
DRAINAGE AND UTILITY EASEMENT.
4. PARK DEDICATION REQUIREMENTS BE SATISFIED PER CITY COUNCIL
APPROVAL.
5. STREET LIGHTS BE PROVIDED THROUGHOUT THE PLAT AS REQUESTED BY THE
CITY.
6. A DEVELOPMENT PLAN BE SUBMITTED FOR CITY REVIEW AND APPROVAL.
PLANS SHOULD IDENTIFY FINISHED FLOOR ELEVATIONS, LOT CORNER
ELEVATIONS, AND TYPE OF HOME. THIS PLAN NEEDS TO BE APPROVED BY THE
CITY ENGINEER PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS.
7. PRELIMINARY PLAT APPROVAL IS CONTINGENT UPON THE ZONE CHANGE TO
PLANNED UNIT DEVELOPMENT BEING APPROVED BY THE CITY COUNCIL.
8. PAYMENT OF STORM DRAINAGE IMPACT FEE OF $100 PER LOT BE MADE
PRIOR TO RELEASE OF FINAL PLAT FOR RECORDING.
9. PAYMENT IN THE AMOUNT DETERMINED BY THE CITY ENGINEER BE MADE TO
COVER THE COST OF SEAL COATING THE STREETS BE PAID PRIOR TO
RELEASING THE FINAL PLAT FOR RECORDING.
10. ALL OUTLOTS INTENDED TO BE USED FOR TRAIL CORRIDORS BE DEEDED TO THE
CITY.
11. THE EAW BE ACTED ON BY THE CITY COUNCIL PRIOR TO CONSIDERING THE

STANDARDS FOR HILLSIDE ESTATES FOURTH ADDITION.
2. A LANDSCAPE PLAN BE SUBMITTED OUTLINING THE PROPOSED
LANDSCAPING IMPROVEMENTS FOR THE PLANNED UNIT DEVELOPMENT AS
WELL AS THE LANDSCAPING TO MEET THE CITY'S ORDINANCE REQUIREMENTS.
3. DEVELOPER PROVIDE A DETAIL OF THE TYPICAL MAILBOX DESIGN THAT WILL
BE USED THROUGHOUT THE ENTIRE DEVELOPMENT
4. SETBACKS MEET THE FOLLOWING: HOUSE FRONT YARD 30 FEET

4. Consider a conditional use permit for a zero lot line development ICU 94 -23), a
variance to the minimum lot size IV 94 -09) and a preliminary plat to divide a 2.73
acre parcel into 7 duplex structures (P94 -09) by Gramstad Homes /public hearing
Steve Ach reviewed the request for a preliminary plat, conditional use permit and
variance. He indicated that the location of the proposed plat is immediately
east of the two four unit apartment buildings located on the north side of
Meadowvale Road.
Preliminary Plat
Steve Ach stated that Gramstad Homes is requesting a preliminary plat of a
townhome /residential subdivision consisting of seven (7) duplexes (fourteen units)
Conditional Use Permit
Steve Ach indicated that Gramstad homes is requesting a conditional use permit
for a zero lot line separating the duplexes.
Variance
Steve Ach indicated that Gramstad Homes is requesting a variance to the
minimum lot size for the R/3 zoning district.
• The City Planner informed the Council that the Planning Commission reviewed the
requests and recommends approval.

5. Hillside Estates 4th Addition: Consider Park Dedication
Developers Marly Glines and Rick Foster presented a plan showing the proposed
development for residential homes. The developers pointed out two power line
easements and one natural gas pipeline easement that presently exist on the
property as well as the proposed streets and lot configurations. They also
indicated that the land is rolling with an elevation difference of fifty feet.
The plan as displayed showed no land to be dedicated as park land.
Commissioner Dana Anderson expressed a concern that due of the topography,
the proposed park did not contain a flat area large enough for a softball or
soccer field and perhaps the park should be larger or moved to another area of
the plat.
COMMISSIONER LIPETZKY MOVED TO ACCEPT A 3.75 ACRE PARCEL THAT LIES JUST
SOUTH OF THE HILLSIDE 4TH ADDITION FOR PARK LAND, AND THAT THIS PARCEL BE
ATTACHED TO THE HILLSIDE 4TH ADDITION PLAT. THE PARCEL BEING 3.75 ACRES THAT
LIES WEST OF THE NORTHERN NATURAL GAS LINE EASEMENT, NORTH OF THE NSP
POWER LINE EASEMENT, AND EAST OF THE CITY WATER TOWER. AFTER CREDIT FOR
THIS PROPERTY AND TRAIL LAND THAT IS DEDICATED TO THE CITY, THE REMAINDER OF
THE PARK DEDICATION FEE BE TAKEN AS CASH. COMMISSIONER O'BRIEN
SECONDED THE MOTION. THE MOTION CARRIED 6 -1. Commissioner opposed.
It was the consensus of the Commission that City ownership of the NSP easement
would give adjacent green space to the park and other areas in the plat, but the
easement is not acceptable for general park purposes.

A discussion was held regarding trail options.

FROM 193RD AVENUE NORTHEASTWARD PARALLELING AUBURN STREET ON THE EAST
SIDE, ON THE BACKYARD SIDE OF THE EXISTING LOTS, TO THE CITY WATER TOWER
PARCEL AND A 30 FOOT WIDE TRAIL EASEMENT ON THE NSP POWER LINE EASEMENT
FROM THE EAST PLAT BOUNDARY TO THE WEST PLAT BOUNDARY IF THE NSP POWER
LINE EASEMENT DOES NOT BECOME CITY PROPERTY BE DEDICATED TO THE CITY.
COMMISSIONER O'BRIEN SECONDED THE MOTION. THE MOTION CARRIED 6 -0.
