The preliminary plat and final plat request for Sunny Acres is the second step in the
development process that the applicant, Mr. Brueske, is proceeding through. Mr. Brueske is
planning on moving his business, Aqua Pure, to this site. In order to do this, three planning
permits are required, an interim use permit, platting the property and site plan review. An
interim use permit was required in order to allow the development of the property prior to
.the availability of sewer and water. The City Council approved Mr. Brueske's request for the
~ntenm use permit on June 18, 2001. He is now before the City Council for preliminary and
final plat approval. Once the plat is approved the final step in the process is site plan review
of the actual development plans. His business is a permitted use that requires only
administrative site plan review.
Existing Conditions
The applicant is proposing to plat a 5.47 acre parcel into a 1 acre lot and a 4.47 acre outlot.
The property is located at the northeast corner of Highway 169/10 and 165th Avenue. There
is an existing one story metal building on the property; it houses a recycling business and
office space for a church. There is also some outdoor storage located next to a detached
garage at the rear of the property. There is a paved parking area around the front of the
building and a gravel surface around the rear. Adjacent land uses include the RDF plant to
the east and agricultural fields to the north, south and west.
Lot Size
Lot 1 is proposed to be 1 acre and is currently vacant. The applicant is proposing to develop
Lot 1 and locate his business on it. Lot 1 meets the dimensional requirements of the I1
zoning district. Outlot A is proposed to be 4.47 acres and will contain the existing buildings
and the parking/loading areas. Before any future building permits can be issued for Outlot A
is will have to be platted.
Access
The property has 3 existing access driveways, one on Highway 169 and two on 165th Avenue.
All three of the access drives are proposed to remain open. The eastern most drive on 165th
Avenue will be moved further east to provide access to the new lot.
Grading, Drainage and Utilities
Grading, drainage and utility issues are noted in the City Engineer's memo.
Park Dedication Requirements
The park dedication requirement for industrial land is $2,000 per acre. Lot 1 of the plat of
Sunny Acres is 1 acre. The Park and Recreation Commission recommended cash dedication
of $2,000 for this plat. Park dedication fees for Oultot A will be due when the outlot is final
platted.

Planning Commission Meeting
At the Planning Commission meeting held on August 28~h Dick Hetlund, owner of the
property proposed to be platted, explained that he would like his lot, the lot containing the
existing building, platted as an Outlot because he could not afford the $8,900 park
dedication fee.
Recommendation
The Planning Commission and staff recommend that the City Council approve the
preliminary plat request and approve Resolution No. 01- approving the final plat for
Sunny Acres with the following conditions:
1. All comments of the City Engineer shall be addressed.
2. Surface water management fees for Lot 1 shall be paid prior to releasing the plat for
recording.
3. Park dedication fees for Lot 1 shall be paid prior to releasing the plat for recording.
4. The property owner will agree to pay all trunk and lateral costs assessed for
extending water and sanitary sewer to the site and will waive all rights to appeal the
amount assessed for water and sanitary sewer.
5. The property owners will hook-up to city sewer and water within the specified time
frame in the City's current ordinance applicable at the time these services become
available.

RE: SUNNY ACRES ADDITION
Dear Ms. McPherson:
As requested, we have reviewed the submittal package for the Sunny Acres Addition.
This plat is located at the intersection of 165th Avenue and Trunk Highway 10 (TH 10).
The submittal package was prepared by Hakanson Anderson and Associates and
consisted of a preliminary plat; site plan and utility plan; grading, drainage, and erosion
control plan; and a landscaping plan. Also submitted were drainage calculations and
earthwork calculations. Based on our review, we would offer the following comments:
The purpose of this plat is to create a second lot, which is proposed to be
developed by Aqua Pure Solutions. The lot shown is only 0.89 acres. In this
zoning area, the lot needs to be a minimum of 1.0 acres.
There is an existing building located on Lot 1. Since the plat does consist of both
lots, it would be reasonable to have Lot 1 come into conformance relative to
driveway widths. Lot 1 currently has a driveway of approximately 75 feet onto
165th Avenue. The ddveway is relatively close to the intersection of TH 10. This
driveway should be narrowed to meet the City ordinance.
A small piece of additional right-of-way should be requested from Lot 1 at the
intersection of TH 10 and 165th Avenue. As shown on the preliminary plat, the
radius at that intersection cuts the corner of the lot. A triangular piece of right-of-
way should be added to the plat in this location.
On the site layout for the Aqua Pure Solutions parking lot, a turnaround should
be added to the north end of the parking lot so that the last head-in parking stall
can be utilized for backing purposes.
The site layout should indicate that all of the northerly triangular piece of Lot 2 is
actually a drainage and utility easement. This is shown on the preliminary plat
and is needed for ponding purposes.
The grading plan for the Aqua Pure Solutions site indicates a handicap stall in
the corner of the parking lot. The parking area shows a 1 percent cross slope in
this area but has a 4 percent grade along the curb line. We believe that this
grade is too steep to meet the ADA standards for handicap stalls. The grade
should be adjusted in this location.

The storm drainage calculations account for a hundred-year runoff volume from
the entire site--both Lots 1 and 2. The pond is sized accordingly. However,
greater detail should be provided as to how the hundred-year runoff volume will
get to the pond without causing erosion. On Lot 2, a curb cut is indicated with a
swale leading into the pond. There is no detail relative to erosion protection in
this area. The pond also shows an overflow in the northeast corner. This area
should also have detail showing some type of erosion protection should the
overflow be needed.
The grading, drainage, and erosion control plan should have the high water pond
elevations shown on the drawing.

This is in response to the Howard R. Green Co. letter submitted to you. Here are our comments
to the items listed:
1. We have now changed the lot dimensions and Aqua Pure Solutions now has 1.0 acres, The
needed area w'as taken fxom our lot.
We feel that.this is an inappropr/ate time.to.address the issue of driveway width. This issue
should have been taken up when we purchased the property and applied for a Conditional Use
Permit. The development at this time is not on the lot which we occupy. There are no
building cl~nges or additions that we will be doing. We sold this lot in order to g,t out of
debt. The slow economy has affected our business greatly. In the sate of this lot we are
incurring expenses for moving a fence and digging a holding pond. We feel that a more
appropriate time to address this issue would be when we ask to add a building to our property
or enlarge our c~xistmg building.
The right-of-way triangular piece in question is for sale if the city or state wants to purchase
it. It can be purchar~d at fair market value with all expenses to be incurred by purchaser.
The piece m question is .37 acre in edze.

WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council September 17, 2001; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and

Conditions:
1. All comments of the City Engineer shall be addressed.
2. Surface water management fees for Lot 1 shall be paid prior to releasing the plat for
recording.
3. Park dedication fees for Lot 1 shall be paid prior to releasing the plat for recording.
4. The property owner will agree to pay all trunk and lateral costs assessed for
extending water and sanitary sewer to the site and will waive all rights to appeal the
amount assessed for water and sanitary sewer.
5. The property owners will hook-up to city sewer and water within the specified time
frame in the City's current ordinance applicable at the time these services become
available.
