Introduction
5.5. **
Elk River/Rogers VFW Post #5518 has made application for a premises
permit to operate pull tabs at the Eagles Club.
Background
State law requires the local government unit to pass a resolution either
approving or denying the application for a premises permit prior to the
Gambling Control Board's review of the application.
Elk River/Rogers VFW Post currently operates pull tabs at the Sunshine
Depot. They have now made application to also sell pull tabs at the Eagles
Club located at 824 Railroad Drive. State law does not restrict the number of
locations in which an organization may sell pull tabs.
The Elk River/Rogers VFW Post is aware of the city's requirement of
spending 75 percent of its lawful expenditures within the city's trade area. I
have attached the expenditure of funds report for 1994 and 1995 showing
that the VFW has complied with the city's ordinance while selling pull tabs
at Sunshine Depot.
I do not believe that the Eagles will be renewing their premises permit to sell
pull tabs at their location of 824 Railroad Drive.
Action Requested
Council motion to adopt the attached resolution approving a premises permit
for the Elk River/Rogers VFW Post to sell pull tabs at the Eagles Club.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING PREMISES PERMIT FOR ELK
RIVER /ROGERS VFW POST #5518
WHEREAS, the Elk River/Roger VFW Post #5518 has made application
to the State Gambling Control Board for a premises permit;
and,
WHEREAS, the premises permit will allow Class B charitable gambling
on the premises; and,
WHEREAS, the premises upon which the gambling will be conducted is
the Eagles Club - Elk River Aerie #3264 located at 824
Railroad Drive in the City of Elk River; and,
WHEREAS, the Elk River/Rogers VFW Post is aware of the city's
requirement to spend at least 75 percent of its lawful
expenditures within the city's trade area.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of Elk River grant its approval of a premises permit for the Elk River/Rogers
VFW Post #5518 to operate charitable gambling at Elk River Eagles Club,
824 Railroad Drive.
Passed and adopted by the Elk River City Council this 18th day of December,
1995.
