Attached, is a memo from Cliff Skogstad, Building Official, dated October 16,
1995, that explains the specifics with the adoption of the new State Building
Code. In order to adopt the new building code, Chapter 10, Subsection
1000.00, of the City Code of Ordinances titled "Adoption of State Building
Code ", must be amended. Action Requested: Adopt Attached Ordinance

Building Permit Fees
The Building and Zoning Department is proposing to modify several of the
miscellaneous permit fees, the heating, ventilation, and air conditioning fees,
and building permit fees. Mr. Skogstad elaborates on these in his attached
October 16, 1995, memo. Action Requested: Pass Fee Resolution

Mineral Excavation License
In 1995, the city charged $15.00 per acre for land that was going to be mined
in the forthcoming year or was approved to be mined. In 1996, staff is
proposing this fee be increased to $20.00 per acre to cover the cost of
administering the gravel mining licenses.

• In 1995, the city charged $5.00 per acre for land that was mined and not
reclaimed. Staff is proposing to increase this fee to $10.00 per acre to act as

SUBJECT: Adoption of the New Building Code
and Fee Schedules
Provided for you in this memo, are many different areas that we wish to have
addressed at this time. Staff s intention is to update the following areas to be
'in compliance with State regulations and city codes. The following is
included with this memo:
1. Section 1000 of the City Code regarding the adoption of the 1994 State
Building Codes.
2. Adopting a new City of Elk River fuel gas piping permit fee.
10 3. Adopting a new City of Elk River Heating, Ventilation, and Air
Conditioning permit fee.
4. Adoption of the City of Elk River's miscellaneous permit fee schedule.
The first item is the adoption of the 1994 Uniform Building Code.
Approximately every three years, the Uniform Building Code is updated by
the International Conference of Building Officials and then published. Once
published, the code is presented to the State Building Code Division. The
State Building Code Division writes the new State Building Code with
amendment to the Uniform Building Code. Once this code has been adopted
by the State, all municipalities can adopt the State Building Code with
amendments to the Uniform Building Code. The 1994 State Building Code
was adopted on March 20, 1995.
With the adoption of this new code, there are certain areas that need to be
brought to your attention. The State Building Code Division never adopted
the 1991 code. The reason for this action was to start working on the 1994
code and have it adopted in 1995. The State Building Code was always
running about six years behind in regard to the adoption of the Uniform
Building Code. The Building Code Division felt it was a good time to bring
• all the codes up to date. Secondly, in regard to the adoption of the codes, two
building code chapters were added to this section of the ordinance, letters "S"

and "T". The Uniform Building Code Appendix, Chapter 15, regarding re-
roofing, assists building inspectors in the inspecting process on all re- roofing
. projects and gives them a guideline for work being completed. This chapter
was in the 1988 Building Code, but was under Chapter 25 and not an
appendix chapter. Since it is now an appendix chapter, it must be adopted
with the city codes.
The Uniform Building Code Appendix, Chapter 33, for excavation and
grading, assists the building inspector for recognizing hazardous excavating
regarding cutting of soils for foundations and recommendations for protection
of these excavated sites. It also assists in the recommendations for soil
engineering reports and engineered grading requirements, erosion control,
and all necessary inspections for this type of activity. Once again, this
chapter was in the 1988 Uniform Building Code but was not an appendix
chapter.
One of the major changes with the adoption of the 1994 Uniform Building
Code is Table 1A, for building permit fees. With the elimination of the 1991
Uniform Building Code, we have not seen a change in building fees for
approximately five years. With the adoption of this new code there has been
a dramatic change in the permit fees. Provided for you is a scenario of the
changes. Assuming a residential structure at $100,000 valuation, the 1988
Uniform Building Code permit price out of table 3A (which is our current
• permit pricing schedule) would be a total price of $1,105.50. This does not
include a septic permit fee of $65.00 or a SAC charge of $1300. The same
house with a valuation of $100,000 using table lA from the 1994 Uniform
Building Code would be $1,527. This would be an increase of $421.50.
Again, this price includes permit fee, plan check fee, and state surcharge and
does not include a $1300 SAC charge or a $65.00 septic charge.
Staff feels that this may be a fee that would be a very heavy burden on
homeowners and contractors. A gradual increase may be better at this time.
Staff is proposing to leave the permit fee the same as what we have in Table
3A until the end of 1995 and start January 1, 1996 with commercial and
industrial permit fees based out of Table lA of the 1994 Uniform Building
Code. All residential projects would also have their permit prices based out
of Table 1A of the 1994 Uniform Building Code, but instead of a 65% plan
check fee for residential, it would be a 35% plan check fee. The permit price
using the same scenario of $100,000 would be $1,258. This would be a
$152.50 increase from the 1988 Uniform Building Code permit fee schedule.
We would then go to a 65% plan check fee January 1, 1997. This will allow
us to give all residential contractors a notice of price changing on permit fees
and will give them the opportunity to put these price changes into their bid
prices. In addition, notice will be given to all commercial and industrial
. contractors of the January 1, 1996, price change.

The second and third items are Exhibit A regarding fuel gas piping fees and
Exhibit B regarding heating, ventilation, and air conditioning. These two
• items were combined in the current City Code and we wish at this time to
separate the two, as they are two completely different types of work. Exhibit
A for fuel gas piping requires a license with the city and also a bond. We
have found that many different contractors were running gas lines without a
license or a bond. With this change, it will assist the inspectors to more
define this type of work and put licensed pipe fitters on all gas piping.
Exhibit B is a fee that we wish to charge for all heating, ventilation, and air
conditioning projects. This fee is 1% of the total valuation of the work being
performed. In the past, we never had a price for this type of work but were
doing plan reviews and inspections. This allows us to charge for all the
inspections that are being performed.
The last item is Exhibit C regarding miscellaneous permit fees. Staff is
trying to base all valuations off of square footage with these fees. We have
learned from other municipalities that using a base price has put them into a
legal court system. Contractors felt that they were being charged too much
for the smaller projects and allowing the larger projects to be a lot less than
expected. Using square footage for valuation allows the smaller projects to
become a fair permit price along with the larger projects, thus allowing
unfair situations.
• At this time staff is requesting the adoption of the 1994 State Building Code
with Appendix Chapter 15 and Appendix Chapter 33, and the residential
permit price change stated above. Also, the adoptions of Exhibit A, B, and C.
If you have any further questions, I will be at Monday night's meeting.

The City Council of the City of Elk River does hereby ordain as follows:

2. Enforcement. Enforcement of the Building Code shall
be as established by the Uniform Building Code, 1994 Edition. The
Building Code shall be enforced within the incorporated limits of
the city. The City Council shall designate the Building Official
for the City of Elk River.
3. Permits, Inspections, Fees and Surcharge
A. Permits, Inspections and Fees. Permits, inspections,
and collection of fees shall be as provided by the Uniform
Building Code, 1994 Edition. The Council shall establish
the fees and charges from time to time by resolution.
B. Surcharge. In addition to the required permit fee, the
applicant shall pay a surcharge to be remitted to the
Minnesota Department of Administration as prescribed by
Minnesota Statutes 1984, Section 16B.70.
4. Violations and Penalties. The violations of this section
shall be a misdemeanor. Each day that a condition in violation
of this section shall continue shall constitute a separate
offense.

Section 2. This ordinance shall be effective upon adoption and
publication, according to law.

WHEREAS, the cost incurred to process the various licenses, services,
zoning and planning requests, etc., has been studies; and
WHEREAS, the study of these fees has resulted in an increase in certain
fees; and
WHEREAS, this resolution reflects the fees charged by the City for 1996.

Fuel -Gas Piping Permit Fees
The Chief Building Inspector, before issuing any permit for the installation of
any fuel -gas piping, shall require the payment by the applicant for such
permit of fees in the amount herein provided.
Minimum Fee
In no case shall the fee charged for any permit issued by the Chief Building
Inspector be less than Eighteen Dollars ($18.00).
Basic Fees
(A)
The fees for all fuel -gas piping permits shall be computed on the basis of the
number of fuel -gas appliances. The fee for each appliance so provided for
shall, except as herinafter otherwise specifically provided, be Six Dollars
i($6.00) for each fuel -gas appliance.
(B)
Where any such permit is issued for roughing in of fuel -gas lines for future
appliances, a fee of Six Dollars ($6.00) shall be charged for each line or lines.
(C)
In addition to the Six Dollar ($6.00) charge for each fuel -gas appliance and
future fuel -gas lines run for appliance, a Six Dollar ($6.00) charge for the
main fuel gas supply in the building shall be charged.
(D)
For the purpose of this article, a gas appliance shall be taken to mean a
furnace, range, water heater, dryer, fireplace, barbecue, etc.

residential and commercial development.

Overview
In 1992, the City Council adopted a resolution which adjusted the park
dedication fees on an annual basis by $50.00 for a three -year period. The
last adjustment as set forth in the resolution was made on 1/1/95 which
brought the fee up to $500 per dwelling unit for residential development.
Attached for the Council's review is a survey of other communities' park
dedication fees.
Park and Recreation Commission
The Park and Recreation Commission, at their September 13, 1995 meeting,
discussed an increase in park dedication fees. The Park and Rec Commission
recommended increasing the fee for single family and multi - family
development by $100 per lot annually for the next two years. The
Commission also recommended increasing the commercial park dedication
• fee from the current rate of $1,500 per acre to $2,000 per acre in 1996 and
$2,500 per acre in 1997.

. Commercial Park Dedication
Currently, the City of Elk River has a rural and urban park dedication fee.
The proposed resolution would eliminate the rural rate and equalize the
commercial dedication. There is not a lot of rural commercial development
and when it does occur, they are held to the same standards as urban
commercial. Therefore, staff believes the rate for urban and rural should be
identical.

Recommendation
The attached resolution establishes a park dedication fee increase as
recommended by the Park and Recreation Commission for residential and
the first year increase for commercial. Staff would like to review the
commercial park dedication rate later this year to determine if an increase to
$2,500 per acre is appropriate or if that fee should actually be higher.
It is recommended the City Council adopt Resolution 95- , amending the
park dedication fees as set forth in the attached resolution.

WHEREAS, the City Council of the City of Elk River in Ordinance 87 -1
established that the City Council can require a fixed fee to be
paid for Park Dedication purposes and that this fee shall be set
by resolution of the City Council; and,
WHEREAS, the Elk River City Council has received and reviewed a
recommendation from the Elk River Park and Recreation
Commission that recommends that this Park Dedication Fee be
increased per residential and multi - family dwelling unit based
on the need for additional funds to provide recreation
opportunities and based on the increased land value in the City
of Elk River; and,
WHEREAS, the Elk River Park and Recreation Commission recommends
the Park Dedication Fee requirements for commercial property
be increased based on the increased land value in the City of
Elk River; and,
WHEREAS, the adoption of this resolution adjusts the Park Dedication Fee
for all residential dwelling units that was adopted in
Resolution 92 -122.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
