Location. The property is located directly west of and adjacent to the Sherburne County Government Center on the south side of Business Center Drive. As offices are a permitted use within the Business Park zoning district, only staff approval will be required. The proposed lot meets the dimensional requirements of the Business Park District for lot area and lot width. The developer has prepared an overall concept plan for development of the remainder of Outlot A, Elk Path Business Center that will be discussed under "Other Business" during the Planning Commission meeting. The City Engineer has reviewed the plat and his comments regarding easements and access control are outlined in his memo. He suggests that only one access onto Business Center Drive be allowed. Park Dedication The Park and Recreation Commission reviewed the request for park dedication purposes and recommended that cash be accepted for this lot. Planning Commission Action The Planning Commission conducted a public hearing at its August 28, 2001 meeting. No one spoke for or against the request. The Planning Commission voted unanimously to recommend approval of the request to the City Council with the conditions recommended by staff. Recommendation Staff and the Planning Commission recommend that the City Council approve the preliminary and final plat of Elk Path Business Center with the following conditions: I. THE LOT BE LIMITED TO ONE ACCESS POINT ON BUSINESS CENTER DRIVE. PARK DEDICATION FEES BE PAID PRIOR TO RECORDING THE PLAT WITH SHERBURNE COUNTY. This final plat creates one lot in Outlot A from the first addition. The lot that is created is south of Business Center Drive and immediately west of the Sherburne County Government Center. The lot is approximately two acres in size and anticipated to hold an office building development. Access off of Business Center Drive should be at the west lot line and should be a shared access with a future lot to the west of this site. The access should also line up with a future access into Outlot C north of Business Center Drive. Since this is the only location access should be allowed off of Business Center Ddve; the remaining frontage along Business Center Drive should be shown as limited access on the final plat. We would also note that the drainage and utility easement typical shown on the final plat is incorrect. The side yard drainage and utility easements are five feet on each lot for a total of 10 feet, not 10 feet on each lot as shown in the typical example. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Development Plan. Co The physical characteristics of the site, including , but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. The proposed subdivision will not cause substantial environmental damage. Fo The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. ° Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. ° The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time. The concept plan shows an overall layout for additional public streets and building/parking lot layouts for proposed uses. The Planning Commission reviewed the concept plan and recommended no changes at this time. The City is asked to review the overall concept and recommend any changes or express any concerns to staff regarding the identified uses, layout or other issues. We would like to use the Concept Plan as a guide to the marketing and development of the Center, with the understanding that as specific users commit to each site, the Concept Plan would be adjusted to take into consideration that users needs. Having the City review and give it's general concurrence to the Concept Plan will assist greatly in our efforts to market the site, and to plan appropriately for site drainage, storm water control, grading, street and utility locations and buffering. The Initial Concept Plan does incorporate the specific site plan being requested by John Oliver & Associates on Parcel J. It also includes a rough calculation of the storm water holding ponds that would accommodate the drainage for the southern two thirds of the site. I am also including a spreadsheet that shows each parcel, the potential use that is illustrated, the size of the parcel, approximate building square footage, required parking and parking that is provided. We would of course appreciate any comments on the plan that you, the Planning Commission or Council may have. If you have any questions on the Concept Plan please feel free to give me a call.
