Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River Board of Appeal and Equalization was called to order at 6:30 p.m. byMayor Klinzing. 2. Board of Appeal and Equalization . Gerald Kritzeck, Sherburne County Assessor, indicated that the purpose of the Board of Appeal and Equalization is to consider and review 2010 estimated market values and property classifications. Information was presented on the assessment procedures and statistics for the City of Elk River 2010 assessments. The Board of Appeal and Equalization heard appeals as outlined below: 1. Thomas and Janet Weishalla, Parcel Identification Number 75-121-4405 Mr. and Mrs. Weishalla indicated that they believe their estimated market value is high and requested it be reduced. Mr. Weishalla added that the neighbor's property is in poor condition which brings his value down. Mr. Olson reviewed comparables. MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY MAYOR KLINZING TO ADJUST THE VALUE OF PARCEL 75-121-4405 BY 5% ($13,100) WITH A REDUCTION OF $10,000 IN THE LAND VALUE AND A REDUCTION OF $3,100 FROM THE HOUSE VALUE. MOTION CARRIED 5-0. 2. Charles Hulse, Parcel Identification Number 75-690-0130 Mr. Hulse presented an appraisal and requested that his value be reduced to $345,000. MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILMEMBER ZERWAS TO ADJUST THE TOTAL VALUE OF LAND AND BUILDING TO $345,000 SPLITTING THE REDUCTION EQUALLY BETWEEN THE LAND AND BUILDING VALUES. MOTION CARRIED 5-0. 3. William Mahan, Parcel Identification Number 75-690-0142 Mr. Mahan presented an appraisal and requested his value be reduced to $345,000. He added that he has almost the identical house to Mr. Hulse as discussed above. Mr. Olson reviewed the appraisal and comparables. He added that Mr. Mahan's home has more square footage and is higher qualitythan his neighbor's. MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILMEMBER ZERWAS TO REDUCE THE TOTAL VALUE OF LAND AND BUILDING BY $17,100 SPLITTING THE REDUCTION EQUALLY BETWEEN THE LAND AND BUILDING VALUES. MOTION CARRIED 5-0. 4. Chris McClory, Parcel Identification Number 75-132-2220 Mr. McClory stated he believes his property value is too high based on sales in the area. He requested his value be reduced to $238,800. Mr. Olson indicated that Mr. McClor~s request would be a large reduction for Elk River. MOVED BY COUNCILMEMBER ZERWAS AND SECONDED BY COUNCILMEMBER GUMPHREY TO REDUCE THE VALUE OF PARCEL 75- 132-2220 BY 5% SPLIT EQUALLY BETWEEN THE LAND AND BUILDING VALUES. MOTION CARRIED 4-1. Councilmember Motin opposed. Councilmember Motin stated he believes the value on this parcel has been reduced enough and thought lowering it by another 5% was excessive. 5. Grace Ostien, Parcel Identification Number 75-117-4007 Ms. Ostien indicated she would like a change in classification to remain in the Green Acres program. Ms. Henderson stated she would like to reviewthe properryto ensure that the property qualifies for the change in classification. Elk River Christian and Mission Alliance Church, Parcel Identification Number 75-134-2200 Joel Nelson, on behalf of the church, requested that the above referenced parcel be exempt from taxes as the church is anon-profit organization. Mr. Cullen explained that the tax exempt status is not based on the non profit status of the organization but rather on the use. Elk River Aerie #3264, Parcel Identification Numbers 75-405-0940, 75-405- 0910, and 75-405-0920 Discussion took place on the Eagles Club classification of a club versus commercial. It was noted the Eagles hold a club liquor license. Discussion also took place on combining parcels 75-405-0920 and 75-405-0940. Elk River Aerie # 3264 can initiate this with the County Assessor. Robert Hoffman, Parcel Identification Number 75-101-2200 Mr. Hoffman requested his entire parce175-101-2200 be reduced by $220,000. Ms. Quinn reviewed the building value and the value of the land the house site is on. Ms. Henderson explained that the green acre value went up because she removed a system ovemde that was in place keeping the tillable value at $3,000 per acre. She indicated the increase is consistent with other sod farms and lower than neighboring counties. Matthew Justinak, Parcel Identification Number 75-406-2040 Mr. Justinak stated his value is too high and requested it be reduced as much as possible. Mr. Olson indicated that Mr. Justinak did not respond to his request to reassess his unit; however, he was able to obtain access to other units and valued Mr. Justinak's property accordingly. He requested that the value on this parcel be reduced to $2.83 per square foot to be consistent . with parce175-597-0105. Mr. Cullen indicated that both parcels were lowered in 2006 and have held value considerable to other vacant commercial lots within the city. He discussed the minimum assessment agreement that is in place for the Bluffs. William Tyrrell, Parcel Identification Number 75-585-0460 Mr. Tyrrell presented comparables. He requested his value be reduced to $260,000. Mr. Olson reviewed the comparables with Mr. Tyrrell. Chester Borger, Parcel Identification 75-672-0505 Mr. Borger requested his value be reduced to $365,000 based on the sales of neighboring homes. i Mr. Olson indicated that one of the neighborhood sales was a short sale and cannot be included in their sales data. He added that Mr. Borger's home is more square footage at 1932. Mr. Borger indicated his home is only 1700 square feet. Paul Heinen and April Westgaard, Parcel Identification Number 75-111-2100 Councilmember Westgaard excused himself from discussion on this item as he is related to appellant. Mr. Heinen and Ms. Westgaard requested their value be reduced. Ms. Henderson explained that there doesn't appear to be 10 contiguous acres in agricultural production on this property; therefore, it would no longer qualify for the agricuhural classification and the Green Acres program. Mr. Heinen indicated he has a verbal agreement with a neighbor to cut hay on the property. Kaap Enterprises, Paul Heinen and April Westgaard, Parcel Identification Number 75-445-0130 Mr. Heinen and Ms. Westgaard indicated they recently purchased this property. They requested that the value be reduced to $300,000, which is the purchase price of the property. Mr. Riley submitted a handout recommending a reduction from $510,500 to $420,300. It was noted that a road access has been removed from the value.
