Analysis
Overview
Located on the property is the vacant Ron's Foods facility that is 24,000 square feet in area.
The parking lot is paved and provides 114 spaces. No changes are being proposed to the
exterior of the building; all improvements will be on the interior.
Conditional Use Permit
The applicant proposes to convert the existing interior of the building into a motorized Go-
Kart facility. Proposed is a Go-Kart track, pit area, bathrooms, meeting room, and
ticket/concession area. Packaged foods such as pop and chips will be sold at the concession
area. Video games are also proposed along one wall of the facility. The applicant anticipates
the following hours of operation:

11:00 a.m. to 11:00 p.m.
11:00 a.m. to 12 midnight
9:00 a.m. to 12 midnight
9:00 a.m. to 11:00 p.m.
The applicant should be required to enforce the City's curfew requirements as the age of the
clientele will be those 16 years and older. The parking lot should also be patrolled on a
regular basis to prevent loitering and improper use of the parking lot.
The zoning code does not identify the specific number of spaces required for this proposed
use. General recreation parking standards require one space four each four patrons when
full.
During the staff review, there were no adverse comments other than a concern in regards to
adequate ventilation in order to remove the exhaust of the Go-Kart motors. The decibel
level of the go-karts was also questioned; will the building provide enough soundproofing to
buffer the adjacent residential neighborhood. The applicant will be required to comply with
all building and fire code requirements in this regard.
Plannin& Commission Recommendation
Staff recommended that the Planning Commission recommend approval of the conditional
use permit request with the following conditions:
1. THE GO-KART OPERATION SHALL COMPLY WITH ALL OF THE
BUILDING CODE REQUIREMENTS.
2. THE APPLICANT SHALL PROVIDE PROPER FLAMMABLE
MATERIAL STORAGE.

Plannin& Commission Action
The Planning Commission conducted a public hearing regarding the request at its April 22,
2003 meeting. Jeff Bruan, 626 Fulcom Avenue, Minneapolis, representing the applicant was
in attendance to answer any questions that the Commission had. There were number of
questions from the Commission regarding the operation of the facility and the condition of
the building/site.
Robert and Carol Hall and Greg Bossany spoke against the proposed facility. Dennis
Dahlen, attorney representing the Halls had a number of questions regarding the
moratorium and the pending litigation.
Recommendation
Staff and the Planning Commission recommend that the City Council approve the request
for a conditional use permit to operate a go-kart facility at 321 Baldwin with the following
conditions:
1. THE GO-KART OPERATION SHALL COMPLY WITH ALL OF THE
BUILDING CODE REQUIREMENTS.
2. THE APPLICANT SHALL PROVIDE PROPER FLAMMABLE
MATERIAL STORAGE.
3. THE SPRINKLER SYSTEM SHALL BE MODIFIED TO ADDRESS THE
CHANGE IN OCCUPANCY.
4. THE APPLICANT SHALL POST AND ENFORCE THE CITY OF ELK
RIVER'S CURFEW REQUIREMENTS.
5. THE APPLICANT SHALL POLICE THE PARKING LOT AND
PREVENT LOITERING BY PATRONS.
6. ENTRANCE DOORS SHALL REMAIN CLOSED DURING HOURS OF

The indoor karting facility will feature a Formula One type racing experience along with a small
concession stand and video arcade. The racetrack will accommodate appro~mately 12 karts at a
time. It will be approximately 1200 ft long and 20ft wide allowing for lots of ro"om for passing
along with varied comers and straight-aways. It will also feature a pit Jane for entering and
exiting the racetrack.
This type of facility is meant for fun, family entertainment for all ages. The driving experience
itself, for the most part, will attract ages 16 and up for just a fun racing experience. Or for the
serious driver, leagues will be formed to accommodate their competitive needs. We will also
feature a set of kiddie karts to accommodate the younger kids and will schedule special times just
for their races. The concession stand and video arcade are also available for those of all ages who
come with the drivers to watch. We will also have a meeting room for corporate meetings and/or
birthday parties etc.

ARTICLE III. OFFENSES INVOLVING
PUBLIC ORDER
Sec. 50-61. Curfew for minors.
(a) Definitions. For purposes of this section,
the following definitions shall apply:
Minor means any individual who is under the
age of 18 and has not been declared by a court of
competent jurisdiction as being emancipated.
Parent means any individual who is over the
age of 18 and is the birth or adoptive parent of the
minor, or who has the legal custody of a minor as
established by order of a court of competent
jurisdiction. This definition excludes individuals
who are providing foster care as defined in Minn.
Stats. ~ 260.015, subd. 7.
(b) Curfew regulations.
(1) Curfew established; hours. It shall be un-
lawful for any minor who is unaccompa-
nied by a parent, or an adult who have the
permission of the parent to be with the
minor, to be present upon any public street,
avenue, alley, park, playground or place
open to the public, place of amusement
and entertainment, vacant lot, or other
unsupervised place in the city during the
following hours:
a. If the minor is under the age of 16,
between the hours of 10:00 p.m. of
any day and 5:00 a.m. of the follow-
ing day;
b. If the minor is under the age of 18,
but over the age of 15, between the
hours of 12:00 a.m. of any day and
5:00 a.m. of the following day.
(2) Exceptions. It shall be an affirmative de-
fense to a prosecution under this section

if, at the time of the curfew violation, the
minor is involved with an organized school
or church activity or is in the employ of a
business.
(3) Responsibility of parents. It shall be un-
lawful for any parent of a minor to allow
or permit such minor to violate the provi-
sions of this section.
(4) Duties of business proprietors. It shall be
unlawful for any person operating or in
charge of any place of amusement, enter-
tainment or refreshment, or other place of
business to permit any minor to loiter or
idle in such place contrary to the provi-
sions of this section. Any such proprietor
shall immediately order such minor per-
son to leave such place, and, if such per-
son refuses to leave, the proprietor shall
immediately notify the police department
of the violation.
(c) Violations.
(1) Any parent whose minor violates this
section shall be notified of all such of-
fenses. Service by first class mail to the
last known address or the address given
by the minor shall be deemed notice to
such parent. The parent shall be notified
that, if the minor incurs three or more
curfew violations, the parent shall be sub-
ject to the penalties set forth in this
section.
(2) A parent of a minor may be charged with
a misdemeanor under this section.

Dear members of the Elk River City Council:
The overwhelming majority of the residents who live in their own private homes, who rent apartments,
and who own property in the area are in strong disagreement, as demonstrated by the numerous people
(There are approximately 80 signatures on this part of the petition. However, the final total has not been
determined as of yet, because the petition is still being circulated. We expect more than a hundred people
to sign the petition.) who have signed this petition. The people are in disagreement with the City Planning
Commission's recommendation to rezone the building formerly known as Ron's Foods from R4 (Multiple
Family Residential) to C3 (Highway Commercial), Case No. ZC02-06, and the Conditional Use Permit for
a commercial recreational facility (Indoor Go-Kart track wlvideo games), Case No. CU 02-16.
The people who live in the individual family homes and apartment residences near the proposed facility
are being put in jeopardy by a business that is not neighborhood friendly for the following reasons:
1. Increased congestion from added people in the area during the aftemoon,
evening and late at night.
2. Increased traffic congestion from cars during the afternoon, evening and late at night.
3. Increased noise from cars driving around the facility and in the neighborhood, because of roaring
engines and squealing tires. The neighborhood is already congested from existing traffic.
4 Increased noises from unsupervised teenagers on the grounds of the facility during the aftemoon,
evening and late at night.
5. Increased debris such as paper, cigarettes, food wrappers, and pop cans in the neighborhood from
unsupervised teenagers milling around the parking area and neighborhood while the facility is in
operation.
6. Increased safety concems pertaining to potential physical harm to area residents caused from
unsupervised teenagers milling around the parking area and neighborhood while the facility is in
operation.
7. Increased potential of damage to property caused from unsupervised teenagers milling around in

building from being subject to. inappropriate canditianal use permits, such as. an indaor Go-Kart track with

Proposed Indoor Speedway
It is my understmding that the City has received a request to authorize an indoor speedway
in the vacant Ron's Foods building located in Elk River.
I have contacted the Brooklyn Center Police Department where an existing indoor speedway
has been conducting business since the last part of December (Thunder Alley). This race
track was built in a vacant K-Mart building. The BCPD informed me that there have not
been any complaints made regarding this business.
I also spoke with an employee of Thunder Alley who advised me that there are two (2) race
tracks at their facility; one for licensed drivers and one for juveniles over 48" tall. The karts
have a ma.."{imum speed of forty (40) miles per hour and twelve (12) miles per hour
respectively. They also advised me that the majority of patrons are in this younger group.
111ey are open seven (J) days a week and their hours are Monday through Thursday (9:30
a_m. - 11:00 p.m.), Friday through Saturday (9:30 a.m. - midnight), and Sunday (9:30 a.m. -
10:00 p.m.).
There has been some resistance from the neighborhood in the area of the vacant Ron's
Foods building where there is a concern that this may become a "hangout" for our youth. I
am stressing that the City put restrictions on this new business regarding the activity in the
parking lot. I feel this area should be monitored by the owners to thwart any future problem
with juveniles loitering.
