The City Council is asked to adopt the attached resolution removing the special assessment on parce175-
409-0740.
BACKGROUND/DISCUSSION
At the June 28, 2010, City Council meeting, John MacGibbon made a written objection to the assessment
on parce175-409-0740 for the 2010 Main Street Rehabilitation project. Mr. MacGibbon stated that the
parcel was not assessed for previous projects because the lot is unbuildable.
It was suggested that Mr. MacGibbon contact Sherburne County to see if this parcel could be combined
with the adjacent parcel which Mr. MacGibbon also owns. It has been determined that because there is a
road between the two parcels they cannot be combined even though the one lot is unbuildable.

RESOLUTION 10-
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION REMOVING PARCEL 75-409-0740 FROM THE SPECIAL ASSESSMENT
ROLL FOR THE 2010 MAIN STREET REHABILITATION PROJECT
WHEREAS, the final Assessment Roll for the 2010 Main Street Rehabilitation Project was
approved on June 28, 2010, and parce175-409-0740 was included in this final Roll; and
WHEREAS, property owner, John MacGibbon made written objection to the assessment, prior to
the Assessment Hearing, stating the subject parcel is unbuildable; and
WHEREAS, the City Council directed Mr. MacGibbon to combine the unbuildable parcel with an
adjacent parcel he owns; and
WHEREAS, after adoption of the final Assessment Roll it was determined by Sherburne County
that the parcels could not be combined due to a street located between the two properties.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the Ciry of Elk River, Minnesota
hereby removes Parcel 75-409-0740 from the Special Assessment Roll for the 2010
Main Street Rehabilitation Project because it is unb~aildable and can't be combined
with the property owner's adjacent parcel.
Passed and adopted this 16`'' day of August 2010.
