BACKGROUND/DISCUSSION The City recently developed a new I-3 General Industrial Zoning District. The City's goal in creating this new district is to preserve its limited industrially-zoned property for uses requiring infrastructure that is either in place, readily available, or anticipated. Less intensive uses would be relegated to specific areas of the community without infrastructure. In the development of the ordinance, the prime area considered for the I-3 zone was the industrial developments along Jarvis, in the SE corner of the city. These areas, industrial in character, are outside of the urban services district, and are not anticipated to receive city water and sewer in the latest Comprehensive Plan. The new ordinance allows all the uses (with the exception of water and sewer treatment) that were allowed in the I-1 and I-2 zoning district. Property owners impacted by the proposed rezoning should see no change at all. Comprehensive Plan The rezoning remains consistent with the 2004 Comprehensive Plan. Public Comment During the public hearing, a property owner questioned the impact to his property. His property being currently zoned C-3, there will be no change. Planning Commission Comments Having recently reviewed the Ordinance, Commissioners had no concerns with the proposed rezoning. BACKGROUND/DISCUSSION The City Council reviewed a new zoning district at their meeting on June 15`x. The new zoning district, called General Industrial, combines the uses permitted or conditional in the existing I-1 and I-2 zoning districts. The intent is to remove less intense uses from the urban services district and encourage them in the I-3 zone, a zone intended to be outside the urban services district. As of this writing, the Council has not approved the C-rdinance, directing staff to make some non- substantive changes prior to formal adoption. Formal adoption is expected August 2, 2010. The parcels are currently zoned either I-1 or I-2. The rezoning, if approved, would be consistent with the Comprehensive Plan. All permitted uses in the I-1 and I-2 zones are pernitted in the I-3 zone, with the exception of water and sewage facilities. All conditional uses in the current I-2 zone are permitted in the I-3 district. The zone change is not intended or expected to alter the use of any existing businesses lawfully operating as of today. ZC 10-07 The City Council of the City of Elk River does hereby ordain as follows: Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to rezone to I-3 (General Industrial) the properties described as: See Attached Exhibit A Section 2. The rezoning is being approved based on the following findings: 1. THE PROPOSED REZONING IS COMPATIBLE WITH THE SURROUNDING LAND USES. 2. THE PROPOSED REZONING IS NECESSARY IN ORDER TO PRESERVE THE CITY'S LIMITED INDUSTRIALLY-ZONED PROPERTY FOR USES REQUIRING INFRASTRUCTURE THAT IS EITHER IN PLACE, READILY AVAILABLE, OR ANTICIPATED. LESS INTENSIVE USES WOULD BE RELEGATED TO SPECIFIC AREAS OF THE COMMUNITY WITHOUT INFRASTRUCTURE. 3. THE REZONING IS IN ACCORDANCE WITH THE COMPREHENSIVE PLAN FOR THE CITY. Section 3.
