A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION REMOVING PARCEL 75-409-0740 FROM THE SPECIAL ASSESSMENT
ROLL FOR THE 2010 MAIN STREET REHABILITATION PROJECT
WHEREAS, the final Assessment Roll for the 2010 Main Street Rehabilitation Project was
approved on June 28, 2010, and parce175-409-0740 was included in this final Roll; and
WHEREAS, property owner, John MacGibbon made written objection to the assessment, prior to
the Assessment Hearing, stating the subject parcel is unbuildable; and
WHEREAS, the City Council directed Mr. MacGibbon to combine the unbuildable parcel with an
adjacent parcel he owns; and
WHEREAS, after adoption of the final Assessment Roll it was determined by Sherburne County
that the parcels could not be combined due to a street located between the two properties.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk River, Minnesota
hereby removes Parce175-409-0740 from the Special Assessment Roll for the 2010
• Main Street Rehabilitation Project b_ ecause it is unbLlildable and can't be combined
with the property owner's adjacent parcel.
