ADOPTION OF ASSESSMENT RESOLUTION
Dear Council Members:
As you are aware, the Assessment Hearing for the 2003 Street Rehabilitation program was held at the
City Council meeting on Monday, May 12, 2003. Due to concerns about potential action by the
Minnesota State Legislature, the headng was closed, but the assessment resolution was not
considered for adoption that evening. Those potential concerns have now passed, the contract for the
2003 Street Rehabilitation program has been awarded, and the contractor has begun work. We are
now recommending that the City Council consider action on the resolution adopting the Final
Assessment Roll.
Attached for your information is a revised Assessment Roll. Based on City Council direction at the
Assessment Headng, we have removed three corner properties from the roll that were previously
assessed for the Main Street project. They include the following:

We have also reduced the Holy Trinity Episcopal Church property at the comer of Fourth Street and

City Council, we will, under separate correspondence, bdng forward resolutions to bring in the
additional owner on Quinn Street who owns the north half of the lot that was originally attributed to the
ownership of Holy Tdnity Episcopal Church.
Attached is a resolution for the City Council's consideration that will adopt the Final Assessment Roll
with the modifications noted above.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ADOPTING FINAL ASSESSMENT ROLL
IN THE MATTER OF THE PAVEMENT REHABILITATION IMPROVEMENT OF 2003
WHEREAS
upon due notice properly made as required by law, the Elk River City Council has
met and heard and passed upon all objections to the proposed assessment for
the 2003 Pavement Rehabilitation improvement and has determined the amount
to be assessed against each individual property as the Council deems just;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
The final assessment roll, a copy of which is attached hereto and incorporated herein by
this reference, is hereby accepted and adopted and shall constitute the special
assessment against the lands therein named. Each such tract of land in the assessment
roll is hereby found to be benefited by the improvement in an amount not less than the
amount of the assessment levied against it.
Such assessment shall be payable in equal annual installments, including both principal
and interest, amortized in such amount annually as is required to pay the principal with
interest at 5.5% over a period of seven or ten years.
The owner of any property so assessed may at any time prior to certification to the
County Auditor of the assessment or the first installment thereof, pay to the City
Treasurer the whole of the assessment on such property, with interest accrued to the
date of payment; except that no interest shall be charged if the entire assessment is paid
within 30 days after the adoption of this Resolution. Prepayment may also be made
after the certification of the assessment or first installment thereof by paying to the City
Treasurer/County Auditor the entire amount of the assessment remaining unpaid with
interest. In the case of a payment made before November 15, interest will be calculated
through December 31 of the year in which payment is made. If payment is made after
November 15, interest will be calculated through December 31 of the next succeeding
year.
The City Administrator shall transmit to the County Auditor a certified duplicate of the
attached assessment roll to be extended on the property tax lists of the County. Such
assessment shall be collected and paid over in the same manner as other municipal
taxes.

Request for Appeal for Assessment - 2003 Street Assessment
Parcels 75-408-0355, 75-408-0360, 75-408--0365 and 75-408-0370
Dear Ms. Peine:
As you know, I attended the City Council Meeting on May 12, 2003 related to the above assessments and
our appeal for an assessment reduction was rejected by the council. Union Church still feels that the
assessment amount is unjustified and is inconsistent. We request that the City Council again review the
assessment amount for our property prior to approving the assessment roll for the following reasons:
1) The size of the six (6) units on our four (4) parcels is not consistent with the rest of the units
assessed in the project (see attached drawing). Lot Numbers 10, 11, 12, 13 and 14 are
consistent as they are 60 feet in width and border 4th Street. However, Lot No. 9 does not even
border 4th street and should not be considered as an assessable lot due to its size and also based
upon your policy of assessing only one side of the property. At a minimum you should reduce the
assessment quantity to five (5) units from the current six (6).
2) Across the street from our property are Parcels 75-408-0560, 75-408-0550, 75-408-0540 and 75-
408-0520. These parcels are assessed a total of one (1) unit for each parcel for a total four (4)
units for the same lineal footage along 4th street. In this case our property should be assessed
four (4) units.
I understand that the methodology of arriving at the amount of the units to assess for any project is
arbitrary; however, at the least it should be consistent.
We are asking the City Council to again review our request and consider reducing the number of
assessed units on our propertY.
