Safety Mana ement Pro ram
BACKGROUND:
Elk River Municipal Utilities (ERMU) contracts with Minnesota Municipal Utilities Association
(MMUA) to provide safety training through their Safety Management Program and Job Training and
Safety (JTS) Program. The Safety Management Program provides required trainings on topics such as
blood borne pathogens and right to know. The program also provides customer and customer specific
trainings like Pole Top Rescue training and OSHA compliance inspections for water and electric
facilities. Elk River Municipal Utilities is one of ten municipal in the Central Group of the Safety
Management Program. The JTS program provides training more specific for the electric and technical
service departments. Elk River Municipal Utilities is one of one of five in our JTS group.
DISCUSSION:
In the 2009-2010 contract period for the MMUA Safety Management Program, ERMU's cost was
$16,400. For the 2010-2011 contract period, ERMU's cost would increase by $275 for a total of $16,67>.
The 2009-2010 contract period for the MMUA JTS Program, ERMU's cost was $6000. For the 2010-
2011 contract period, ERMU's cost would remain the same. See the attached service agreement
amendment.
ACTION REQUESTED:
Staff recommends approving the renewal of the MMUA Safety Management Program and JTS Program
for the 2010-201 I contract period for a total cost of $22,675.

It is time to renew your safety management program contrail. Since our group
meeting, all requested changes have been made. There has been very little change
from the budgets delivered at the earlier meeting. The contrail amendments will
cover October 1, 2010 through September 30, 2011, to coincide with MMUA's
fiscal year.
Two copies of your contract amendment are enclosed. Please sign both contrails
keeping one for your records and mailing the other to the address shown below.
Please do not send payment at this time. You will be billed October 1. Mail your

AMENDMENT TO SERVICES AGREEMENT
Safety Management Program
Contract Date: August 13. 2010 Contract Number: 5-2011
The services agreement entered into between Minnesota Municipal Utilities Association
(MMUA) and Elk River Municipal Utilities (Elk River), dated August 14, 2009, contract
number 5-2010, is amended as follows:
PART II. Section 1.
1. DURATION: This Agreement shall remain in force from October 1, 2010 until
September 30, 2011 (the "expiration date").
PART III. Section i.
1. COMPENSATION: For the services covered by this Agreement, Elk River
shall pay MMUA an annual fee of sixteen thousand six hundred seventy-five
dollars and 00 cents ($ 16,675.00) for the 2010-i1 annual period. Such
compensation shall be due and payable according to the selected payment
terms below.
Payment terms for the fee agreed to above shall be based on one of the
following options (select one):
^ Annual Payment ($16,675.00)
^ Quarterly Payments ($ 4,168.75 each)
For any term of less than twelve full calendar months, the fee shall be a portion
of the annual fee, pro-rated based on the number of calendar months or partial
calendar months in which the services were provided as a percentage of twelve
(12).
The parties hereby accept the terms of the Agreement as modified.
