Staff and the Planning Commission recommend the City Council approve the Conditional Use Permit
(CUP) request with the following conditions:
1. All comments of the Fire Marshall memo dated August 3, 2010 shall be addressed.
2. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
required permits.
3. The project shall meet all fire codes.
BACKGROUND/DISCUSSION
No one spoke at the public hearing and the Planning Commission unanimously recommended approval
of the request.

BACKGROUND/DISCUSSION
In September 2005, Tractor Supply received a CUP to construct a commercial retail building. They now
v7ould like to provide retail sales of bulk propane via a 1,000 gallon propane tank and dispensing cabinet
installed in the existing fenced in storage area.
The PUD agreement for Elk River Crossing states that a CUP is required for the "retail sale of gasoline".
Staff interpreted this as the retail sale of highly flammable products.
The request was reviewed by the Site Plan Committee and there were no concerns raised. The Fire
Marshall indicated that the use of the NFPA 58 guidelines was acceptable but that he needed more
detailed plans showing distances and a tank layout with protection, signage and extinguishers.

The site plan review committee met and I would like to make the following comments:
The narrative supplied by Tractor Supply refers to using NFPA 58 for the guidelines for the
installion of a new 1000 gallon refilling propane tank. This is acceptable but we still need a
more detailed plan, showing distances and a tank layout with protection, signage and extinguishers.

During this process you may also need to temporally move the gates from
against the building so the electrical conduit can be run.
Once the work is complete the gates can be put back where they were.
After the crash post and electrical work is complete no additional work will be
done for approximately 2-3 weeks when the dispensing unit is delivered. At that
point a crew will set the tank and dispensing unit and connect the electrical work.
