ACTION REQUESTED
Adopt ordinance relating to membership of the Heritage Preservation Commission (HI'C).
BACKGROUND/DISCUSSION
The HPCwas established in 1999 with seven members. Currentlythere are five members with two open
seats. One seat has been vacant since November 2009 while the other seat has been vacant since February
2010.Over the years it has been difficult keeping this commission full with seven members despite
utilizing various advertising sources and seeking members through other sources such as the Oliver
Kelley Farm and the I~storical Society.
Staff is proposing to reduce the commission to five members due to the difficulty in keeping the seats
filled. Staff liaison Rebecca Haug discussed this issue with the HPC and theywere amendable to moving
forward with the change.
State Statue X471.193 states that members must reside in the political subdivision regulated by the
ordinance establishing the commission. Therefore, the ordinance has been updated to complywith state
law.

Heritage Preservation Commission
The Heritage Preservation Commission reviews and makes recommendations to the City Council on
issues pertaining to the historical, archaeological, engineering, and cultural heritage of the city. The
Commission also participates in the preservation and acquisition of Elk River's heritage and historical
sites. For more detailed information, see Chapter 2, Article V, "Boards and Commissions" of the Elk River
City Code.
The Heritage Commission consists of seven members appointed by the City Council. Terms are three
years beginning on the first day of March. Members are appointed by the City Council and do not need to
reside in Elk River but it is expected that a preference will be given to Elk River Residents. The HPC
shall include, if available, a member of the Sherburne County Historical Society.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING SECTION 2-
212 OF THE ELK RIVER, MINNESOTA, CITY CODE OF ORDINANCES
RELATING TO THE HERITAGE PRESERVATION COMMISSION
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. Section 2-212 titled, Membership; officers, of the City of Elk River
Code of Ordinances shall be amended to read as follows:
The heritage preservation commission shall consist of seen five members appointed
bythe citycouncil forterms of three years. The last dayforthe term of office of each
member shall be the last day of February; however, all members may continue service until
either reappointed or replaced by the city council. A vacancy shall be filled by the city
council for the remainder of the term. The members of the heritage preservation
commission, bya majorityvote, shall elect one of the appointed commissioners at the first
meeting of the year to serve as chair and one to serve as vice chair. Commission members
must be persons with demonstrated interest or expertise in historic preservation.
. Each commission member must be a resident of the City of Elk River. The
heritage preservation commission shall include, if available, a member of the Sherburne
County Historical Society.
Section 2. That this ordinance shall take effect upon publication as provided by
law.
Passed and adopted by the City Council of the City of Elk River this 20th day of
September, 2010.
