98-026 ORD ORDINANCE NO. 98-26 AN ORDINANCE OF THE CITY OF ELK RIVER AN ORDINANCE AMENDING SECTION 218.06 OF THE CITY CODE OF ORDINANCES PERTAINING TO EMPLOYEE BENEFITS The City Council of the City of Elk River does hereby ordain as follows: Section 1. That Section 218.06 (5)(C)(vi.) pertaining to "Sick Time Administration" of the City of Elk River Code of Ordinances shall be amended as follows: vi. Provided the following conditions are satisfied, an employee shall be entitled to a cash payment for unused sick time in an amount equal to fifteen percent (15%) of his/her accumulated sick time up to a maximum payment of one hundred forty-four (144) hours. a. The employee must resign in good standing; b. The employee must provide written notice of his/her resignation to the City at least two (2) weeks in advance of the employee's last day of work; and c. The emploYee must have worked for the City for at least two consecutive years. The cash payment shall be in an amount equal to fifteen percent (15%) of the employee's accumulated sick time (at the employee's current rate of pay), up to a maximum payment of one hundred forty-four (144) hours. For example, if an employee is paid $10.00 an hour, satisfies the above-mentioned conditions, and resigns with an accumulation of 120 sick days, the employee will receive $1,440.00 for unused sick time. Section 2. That Section 218.06 (5)(C)(vii.) pertaining to "Sick Time Administration" of the City of Elk River Code of Ordinances shall be amended as follows: vii. The accumulation of sick time in excess of 960 hours shall not be subject to the fifteen percent ( 15%) payment under this policy. However, employees may continue to accumulate sick time in excess of 960 hours as a form of income protection in the event of unexpected long-term illnesses during their employment. Section 3. That this ordinance shall take effect and be in full force from and after the date of its publication. Passed and adopted this 23rd day of November, 1998 by the City Council of the City of Elk River.
