Location The property is located on Lander Street south of Lake Orono in the Fox Haven subdivision Zonin.cl/Land Use Rlc (Single Family Residential) / MR (Medium Density Residential) Attachments Location map Registered land Survey Memo from City Engineer Overview The applicant is requesting that he be allowed to split Lot 10, Block 2, Fox Haven into two parcels. Each parcel would then be combined with the adjacent parcels. The west half of Lot 10 would be combined with Lot 9 and the east half would be combined with Lot 11. If this registered land survey is approved, the existing drainage and utility easements on the lot lines between Lot 10 and Lot 9 and Lot 10 and Lot 11 should be vacated and new easements should be granted along the new lot line. No new lots are being created. Planning Commission Meetinq At the Planning Commission meeting held on June 24~h, no one spoke at the public hearing. The Commission recommended approval of the proposed Registered Land Survey. Recommendation The Planning Commission and staff recommend that the City Council approve the proposed Registered Land Survey with the following conditions: 1. THE APPLICANT FILE FOR AN EASEMENT VACATION TO VACATE THE EXISTING DRAINAGE AND UTILITY EASEMENTS ON THE LOT LINES BETWEEN LOT 10 AND LOT 9 AND LOT 10 AND LOT 11. 2. NEW DRAINAGE AND UTILITY EASEMENTS SHALL BE GRANTED ALONG THE NEW LOTS LINE 3. THE EAST HALF OF LOT 10 BE COMBINED WITH LOT 11 AND THE WEST HALF OF LOT 10 BE COMBINED WITH LOT 9. No. 445145 NI3°20'38"E , 23.39 / VACATED .... ~)/ Howard R, Green Qompany June 3, 2003 File: 821310J-0240 Mr. Scott Harlicker Senior Planner City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: FOXHAVEN ADDITION REGISTERED LAND SURVEY Dear Mr. Harlicker: As requested, we have reviewed the Registered Land Survey of Lot 10, Block 2, Foxhaven Addition. It is our understanding the intent is to split Lot 10 north and south so that a portion can be attached to Lot 11 to the east and Lot 9 to the west. The reason a Registered Land Survey is needed to accomplish this split is because the land is torrens. Based on our review, we would offer the following comments: It should be a condition of the approval of the Registered Land Survey that a portion of Lot 10 be attached to Lot 11 and a portion attached to Lot 9. We do not want to create two substandard lots. The five-foot wide drainage and utility easements along tl~e common boundaries with Lot 11 and Lot 9 need to be vacated. These should be vacated from, but not including, the ten-foot drainage and utility easement along the Lander Street frontage to the large drainage and utility easement at the rear of Lot 10. This vacation needs to be accomplished by a separate document and cannot be included on the Registered Land Survey. A new ten-foot wide drainage and utility easement, five feet on either side of the newly created lot line down the center of Lot 10, needs to be given.
