Overview The proposal is to operate a wholesale lumber distribution facility. There will be outdoor storage of large quantities of lumber in the open area, on the east portion of the property adjacent to Cleveland Street. The lumber will be stacked approximately 16-feet in height. There will also be cold storage within an existing pole building along the west property line. Activities that will occur within the building are no different than any other lumber yard. There will be some equipment for sizing of lumber as well as some office space. Based on other facilities owned and operated by the applicant, he does not anticipate any general public business. Analysis The hours of operation will be 7 a.m.-6 p.m. Monday through Friday. There will be a total of nine employees with four of them being part-time. S:\PLANNING\Case Files\2003\CU 03-15 Talbot\CU03-15 CC.DOC Mayor and City Council / CU 03-15 July 21, 2003 Page 3 Delivery of lumber usually occurs early in the week via a flat-bed semi truck which is then unloaded in the outdoor storage yard. The proposed business will have two 24-foot flat bed trucks, one single axle and the other a tandem axle. These trucks will then deliver lumber to its customers. These two tracks will be stored in the existing building. The outdoor storage area is a mix of class-5, concrete and asphalt that is approximately 8- feet lower than Cleveland Street. The building will have to meet all applicable building and fire codes. Landscaping The total number of trees required by the ordinance is 32 and the proposed ske plan shows 33 trees. There is a small berm between Cleveland Street and the lowered outdoor storage area and this provides some screening of the yard. The ske plan shows a proposed 6-foot high chain link fence around the north, east and south perimeters of the outdoor storage yard. Staff recommends that the fence have the opaque slats placed in it to help further screen the property. Trees should be placed on the outside of the fencing. Parking and Circulation Based on the square footage of the building and the City's requirement of one parking stall for every 2000 sq. ft. of floor area, a total of 9 parking stalls would be required. The site plan did not indicate as spedfic number of parking stalls, however, based on the area indicated for parking, there is adequate space to accommodate the required number of stalls. Staff recommends that it be paved and provide striped parking stalls. There will be two access points into the yard, one at the north end of the property, off of the existing parking area, and the second will be directly off of Cleveland Street in the southeast corner. The applicant will need to maintain proper circulation, as determined by the Fire Chief, around the stacks of lumber. Planning Commission Action Screening was the major topic and the Commission wanted to make sure that the yard was adequately screened on the south side as the adjoining property is zoned residential. There was some discussion regarding the adjacent zoning and whether or not retail sales should be allowed. The Commission agreed that no retail sales should be allowed. The ordinance states that in the I-1 zoning district retail sales are allowed such as, the re'ca//sa/es aag/ty does not ocmpy more than 15 percent of the gross floor area of the omqiet quarters. Permitted Accessory Uses that are allowed in the ordinance cannot be disapproved by action of the Council. PROPOSED LANDSCAPING SHALL BE ON THE ON THE OPPOSITE SIDE OF FENCE AS IS THE STORAGE YARD. THE PARKING AREA SHALL BE RESURFACED WITH ASPHALT OR CONCRETE AND PROVIDE STRIPED PARKING STALLS ALL CONCERNS OF THE LEAD BUILDING INSPECTOR AND FIRE CHIEF IN THEIR LETTER DATED JUNE 23, 2003 SHALL BE ADDRESSED. In lieu of no fire department access to the north, south, and west sides of the building the fire department will be requiring the following: 1. The exterior walls need to be 1-hour rated. 2. The roof and the walls on the e:dsdng loading dock must be removed and remain open. 3. The loading dock must be extended to the southwest end of the building. 4. A 1-hour fire barrier wall will be required to compartmendze a minimum of 30% of the 5-1 portion of the building. The following building code issues will also be required: 1. Three-hour fire barrier walls will be required between the different occupancy's. 2. Proper e,,ddng will be required from each occupancy. 3. Please provide a list of all building and fire codes that the property is in violation with in specifics to the code, chapter and paragraph and how that they apply. 2. Please provide the specific codes, chapters and paragraphs in regards to the opaque slat solid screening for the chain link fencing and how it applies. 3. Please provide the codes, chapters and paragraphs pertaining to the resurfacing of the asphak parking area and how they apply. Since I do not have a copy of the codes I would appreciate hard copies of the above mentioned codes used in your decision for recormnendations. In response to item # 1 regarding building and fire codes, I gave you a letter after the Planning Commission meeting, dated June 23, 2003 from Terry Zajac, the Senior Building Inspector, outlining the building and fire code issues. If you would like more information regarding these issues, please contact Terry Zajac at 763-635-1000 or Bruce West, Fire Chief, at 763-441-4919. Conditional Use Permits are issued to uses with specific conditions that are deemed appropriate to the given request. You requested spedfic codes, chapters and paragraphs that pertain to these issues. I have enclosed Section 30-651 thru Section 30-655 of the Zoning Ordinance that pertains to Conditional Use Permits. The nature of these permits is that certain uses will be allowed with such s/2edfic cond/tzms with regard to the development or operation of the proposed use as it (the City Council) considers necessary to satisfy the standards set forth in Section 30-654 and the requirements contained within and to promote compatibility with and mLnimize any potentially adverse effects upon adjacent properties, the neighborhood or the City. Section 30-655 also refers to specific issues pertaining to fencing, screening, landscaping, required yards and other open spaces. The conditions that were recommended in the staff report dated June 24, 2003 reflected the above sections of the ordinance. If you have any question, please feel free to contact me.
