The Lowell Avenue Reconstruction project was recently bid with Orono Lake 3rd
improvements and the Joplin Street reconstruction. The total construction bid for Lowell
Avenue was $50,625.55. With overhead, the total project is approximately 15 % under
the estimate in the feasibility study dated October 1996. As the City Council will
remember, the public hearing was postponed until the construction bids could be received
to determine what the assessment rate should be for street reconstruction in a commercial
area. Bearing in mind the assessment policy which has as a goal assessing 50% of these
types of projects and the City paying 50 %, the assessment rate for Lowell Avenue should
be established at $42/front foot. According to the City's Assessment Manual, street
reconstruction assessment rates are set by City Council resolution. Therefore, we have
attached a resolution which establishes the street reconstruction assessment rate at
$36/front foot for residential property and $42/front foot for all other property.
Also attached for the City Council's consideration are two resolutions. The first
resolution rescinds Resolution 96-104 and re-establishes that action in this resolution
which accepts the feasibility study and orders the public hearing for March 3, 1997. The
second resolution establishes the amount to be assessed at the $42 rate and orders the
preparation of the assessment roll and the assessment hearing also for March 3, 1997.
If you have any questions about the issues discussed in this letter, I will be in attendance
at your January 27, 1997, City Council meeting.

RESOLUTION 97 -
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ESTABLISHING THE ASSESSMENT RATE
FOR STREET RECONSTRUCTION IMPROVEMENT PROJECTS
WHEREAS,
the City has adopted a revised assessment manual on March 6, 1989, which
requires assessment rates for street reconstruction improvements be established by
resolution; and
WHEREAS, the City last increased the assessment rates over two years ago; and
WHEREAS, the assessment rates have been determined to need to be increased to offset rises
in construction costs;
NOW, THEREFORE, BE IT RESOLVED by the Elk River City Council of the City of Elk
River, Minnesota:
The street assessment rate for residentially zoned property shall be $36 per
assessable front foot and commercial, industrial, and all other zonings shall
be $42 per assessable front foot.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MATTER OF THE LOWELL AVENUE
IMPROVEMENT OF 1997 TOGETHER WITH THE
RESCINDING OF RESOLUTION 96-104
WHEREAS
WHEREAS
the Feasibility Report ordered by the Council in Resolution 96-58 has been
prepared with reference to the Lowell Avenue improvement and was received by
the City on November 18, 1996; and
the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:

Resolution 96-104 is hereby rescinded.
The City Council will consider the Lowell Avenue improvement as described in the
Feasibility Report and the assessment of the property abutting this proposed improvement
for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section
429 at an estimated total cost for the improvement of $76,800.
A public hearing shall be held before the City Council on the proposed improvement on
the 3rd day of March, 1997, at 6:00 o'clock p.m. at Elk River City Hall Council
Chambers.

The City Administrator shall provide ten days mailed notice and two weeks published
notice on the hearing as required by law.

RESOLUTION 97 -
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION DETERMINING ASSESSED COST OF
IMPROVEMENT AND ORDERING PREPARATION OF
PROPOSED ASSESSMENT ROLL IN THE MATTER OF
LOWELL AVENUE IMPROVEMENT OF 1997
WHEREAS
costs have been determined for the Lowell Avenue improvement consisting of a
contract price of $50,625.55 and expenses incurred or to be incurred by the City
in the making of the improvement in the amount of $14,175.15 for a total cost of
the improvement of $64,800.70.
NOW, THEREFORE, BE IT RESOLVED by the City Council for the City of Elk River,
Minnesota:
Based upon the City Assessment Policies, it is determined that the portion of this
improvement to be paid by the City and not assessed to benefitted properties is
$32,200.00.
The portion of the cost to be assessed against benefitted properties pursuant to the Elk
River City Assessment Policies shall be $32,600.00.
The assessments shall be payable in equal annual installments including and coinciding
with real estate tax payments and shall extend over a period of 5, 10, or 15 years. The
first of the installments will be included on your 1998 tax statement unless prepaid with
interest at the rate of 8% per annum starting December 1, 1997.
The City Administrator with the assistance of the Project Engineer shall forthwith calculate
the proper amount to be specially assessed for such improvement against every assessable
lot, piece, or parcel of land, without regard to cash valuation, as provided by law, and
shall have available to the City Administrator's office a copy of the proposed assessment
roll for public inspection.
Upon completion of the proposed assessment roll, the City Administrator shall notify the
Council and schedule a public hearing upon the proposed assessment, causing notice of the
hearing by publication and mail to be made at least two weeks prior to the hearing.
Passed and adopted this 27th day of January, 1997.
