AN ORDINANCE OF THE CITY OF ELK RIVER
AN ORDINANCE AMENDING CHAPTER 10 OF THE CITY CODE OR
ORDINANCES PERTAINING TO ADOPTION OF STATE BUILDING
CODE
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 1000.00 entitled "Adoption of State Building
Code" of the City of Elk River Code of Ordinances shall be amended as
follows:
1000.00 - ADOPTION OF THE STATE BUILDING CODE
1. Those portions of the Minnesota State Building Code, as
amended, 1997 Edition, with Appendixes as set forth below are
hereby adopted as the Building Code of the City of Elk River as
follows:

The Minnesota State Building Code includes the
following chapter of Minnesota Rules:
i. 1300 Minnesota Building Code
ii. 1301 Building Official Certification
iii. 1302 State Building Construction Approvals
iv. 1305 Adoption of the 1997 Uniform Building Code
including
Appendix Chapters:
a. 3, Division I, Detention and Correctional
Facilities
b. 12, Division II, Sound Transmission Control
c. 15, Reroofing
d. 16, Division I, Snowload Design
e. 29, Minimum Plumbing Fixtures
f. 31, Division II, Membrane Structures
v. 1307 Elevators and Related Devices
vi. 1315 Adoption of the 1996 National Electrical
Code

2. Enforcement. Enforcement of the Building Code shall be
as established by the Uniform Building Code, 1997 Edition. The
Building Code shall be enforced within the incorporated limits of
the city. The City Council shall designate the Building Official
for the City of Elk River.
3. Permits, Inspections, Fees, and Surcharge
A. Permits, Inspections, and Fees. Permits, inspections,
and collection of fees shall be as provided by the Uniform
Building Code, 1997 Edition. The Council shall establish
the fees and charges from time to time by resolution.
B. Surcharge. In addition to the required permit fee,
the applicant shall pay a surcharge to be remitted to the
Minnesota Department of Administration as prescribed by
Minnesota Statutes 1984, Section 16B.70.
4. Violations and Penalties. The violations of this section
shall be a misdemeanor. Each day that a condition in violation
of this section shall continue shall constitute a separate
offense.
Section 2. That this ordinance shall take effect and be in full force
from and after the date of its publication.
Passed and adopted this 25th day of January, 1999 by the City council of the
City of Elk River.
