Overview
The City of Elk River is proposing to construct a 12,818 sq. ft. liquor store
facility within the Hillside Crossing Planned Unit Development. The
building will consist of a first floor area of 7,858 sq. ft. and a basement of
4,960 sq. ft. The basement area will be used for storage of product while the
first floor will be dedicated to retail sales.
Planned Unit Development
All new construction within the Hillside Crossing Planned Unit Development
is required to obtain a conditional use permit for site plan review. This
application is typical of all planned unit developments recently approved in
the city. The planned unit development agreement and concept plans
previously approved for Hillside Crossing contained certain criteria and
performance standards. The proposed plans for the liquor store comply with
the specified standards.
Parking/Access
The proposed project will have two access points off Evans Street. The
southernmost access will be aligned with the access point into Sax Grocery
Store. The second access further to the north on Evans is located in the
approximate location as identified on the concept plans as they were
approved for the Hillside Crossing Planned Unit Development.
The proposed plans include a total of 69 available parking stalls on site.
There has been some discussion regarding trailer/RV parking on this site.
The liquor store manager has indicated that he would prefer to see the
parking lot striped for passenger vehicles and allow recreational vehicles to
park wherever it may be convenient for them. This is basically how the
parking of recreational vehicles occurs at the current liquor store and there
has not been an obvious concern.
Signa~e
The signage proposed for the liquor store includes one wall sign on the south
elevation facing 193rd and one wall sign facing the west directed towards
Highway 169. In addition to these two wall signs, there is an electronic
reader board over the entrance to the liquor store which will be oriented
towards the intersection of Highway 169 and 193rd.

There is no free-standing signage proposed at this time, however, the liquor
store will utilize one of the available spaces on the Sax Foods free-standing
sign along Highway 169.
The planned unit development agreement for Hillside Crossing was approved
with a sign package which allowed one wall sign for each of the free-standing
developments. This condition is different than the sign requirements in the
Elk Park Center Planned Unit Development which allows one wall sign for
every free-standing building and two wall signs for those lots which have
frontage on two public streets. In discussing this with the developer of
Hillside Crossing, it was agreed that the planned unit development for
Hillside Crossing be amended to be consistent with the Elk Park Center sign
requirements. Therefore, the Council is also being asked to consider an
amendment to the Hillside Crossing I and II Planned Unit Development
Agreement to allow a similar sign package as that approved for the Elk Park
Center Planned Unit Development Agreement. (Attached to the Planning
Commission report are excerpts from each agreement).
Changes Made to the Development Plan
Through the staff review process there have been suggestions made to modify
the proposed plans. These changes include the following:
· Eliminate the landscaped/traffic control island at the southeast corner of
the building
Extend the existing hydrant along the west side of Evans Street onto the
liquor store property to provide full fire protection
· Extend the sidewalk from 193rd north along the west side of Evans Street
to connect with the sidewalk from the liquor store
· Eliminate the landscaping in front of the entrance of the liquor store
· Eliminate designating trailer/RV parking stalls and stripe the entire lot
for passenger vehicles
· Flatten the radius of the parking lot curbing directly in front of the store's
entrance.
These changes have been discussed with the architect and will be
incorporated as part of the final plans for approval. The final plans are
attached for the Council to review. Please refer to the attached report to the
Planning Commission for additional information.
Planning Commission Recommendation
The Planning Commission recommended approval of the conditional use
permit request with the conditions outlined in staffs report. The

Commission also suggested installing "no parking" signs along Evans Avenue
and extending the sidewalk from 193rd Avenue to connect with the liquor
store. There were no comments from the public on this application.
Recommendation
It is recommended the City Council approve the following:
A. Conditional use permit request for site plan review to construct a
12,818 sq. ft. liquor store facility with the following conditions:
1. APPROVAL FROM MN/DOT BE RECEIVED FOR THE PROPOSED GRADING IN
THE HIGHWAY 169 RIGHT OF WAY.
2. THE EXISTING FIRE HYDRANT SOUTH OF THE FIRST ENTRANCE INTO THE SITE BE
RELOCATED AT A LOCATION ACCEPTABLE TO THE FIRE CHIEF.
3. THE TRAFFIC CONTROL/LANDSCAPED ISLAND AT THE SOUTHEAST CORNER
OF THE BUILDING BE REMOVED TO EASE IN SNOWPLOWING THE PARKING
LOT.
4. THE LANDSCAPING SHOWN NEAR THE ENTRANCE TO THE LIQUOR STORE
FACILITY BE REMOVED AND REPLACED WITH CONCRETE.
5. ALL SIDEWALKS ADJACENT TO PARKING AREAS WILL NEED TO BE A
MINIMUM OF 6 FT. IN WIDTH.
6. THE POLICE DEPARTMENT HAS ASKED THAT AN ADDITIONAL WINDOW ON
BOTH SIDES OF THE ENTRANCE BE PROVIDED TO IMPROVE THE EMPLOYEES'
SURVEILLANCE OF THE PARKING LOT.
7. COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED 1/17/97 BE
INCORPORATED INTO THE PLANS FOR APPROVAL.
8. INSTALL "NO PARKING" SIGNS ALONG EVANS IF ON-STREET PARKING
BECOMES AN ISSUE.
9. EXTEND SIDEWALK FROM 193RD AVENUE ALONG THE WEST SIDE OF EVANS

All of the proposed buildings within the Hillside Crossing Planned Unit
Development are required to receive a conditional use permit for site plan
review. This is a typical requirement in all of the planned unit developments
that are being approved along the Highway 169 corridor. This review process
is the opportunity for the Planning Commission and Council to review the
proposed development plans to determine their conformance with the "master
plan" approved for the Hillside Crossing project.
Parkinf/Access
The project is proposed to have two access point off of Evans Street. The first
access closest to the intersection of Evans and 193rd Avenue will be aligned
with the first access into the Sax grocery store. The second access further
north on Evans Street is located in an approximate location as identified on
the concept plans for the Hillside Crossing Planned Unit Development.
These two access points will provide easy circulation in and out of the facility
for passenger vehicles, recreational vehicles and delivery trucks servicing the
facility.
The total number of possible passenger vehicle parking stalls on site is 69
spaces. The submitted site plan has been prepared illustrating 8 car-trailer
parking spaces in place of 24 passenger vehicle spaces. The Planning
Commission may want to discuss if they have a preference on how the
parking lot should be striped to accommodate car-trailer parking. The two
options that may be considered is to actually designate car-trailer parking by
striping, or, stripe the parking lot for passenger vehicles and allow the car-
trailer parking to occur wherever it may be convenient at any given time.
Landscap in~
The landscaping plan consists of a variety of materials consistent with the
city's ordinances. The proposed landscaping along Highway 169 will need to
be reviewed to determine if the mature height of the proposed trees will
conflict with any overhead electric lines. If this is the case, the trees will
need to be relocated.
During staffs review of the plans it was felt that the proposed landscaping
near the entrance of the facility should probably be removed because of the
amount of pedestrian traffic in this area. Staff was concerned that the
shrubbery proposed for this area would receive a lot a abuse from customers
possibly cutting through the planting areas. All landscaped areas will be

sodded and have underground irrigation installed as set forth in the PUD
agreement for Hillside Crossing.
Si~nage
The Hillside Crossing Planned Unit Development Agreement was approved
with signage requirements that could be carried out through the entire
development. When the Sax Foods facihty was developed there was specific
signage approved as part of that project. In addition, other criteria were
established for the remaining lots in the Hillside Crossing project. With the
liquor store being the first free-standing site in Hillside Crossing, one of the
sign requirements in the PUD agreement has raised some concern. The
allowable wall signage is currently limited to one wall sign. This condition is
different than the sign requirements in the Elk Park Center Planned Unit
Development agreement which allows one wall sign for every free-standing
building, and two wall signs for those lots which have frontage on two streets.
In discussing this with the developer of Hillside Crossing, it was agreed that
the Planned Unit Development for Hillside Crossing be amended to be
consistent with the Elk Park Center sign requirements.

Building Materials
The building materials will consist primarily of brick with a soft earthtone
color. Through the center of the building, a raised pre-finished metal roof
will be installed with a green color matching the green on the Sax Foods
building. The building's orientation will be towards the Highway 169/193rd
Avenue intersection with the service area along the north side of the
building.
Recommendation
It is recommended the Planning Commission recommend approval of the
conditional use permit request for site plan review to construct a 12,818 sq.
ft. hquor store facihty and amending the Hillside Crossing PUD Agreement

RE: NORTHBOUND LIQUOR STORE SITE PLAN REVIEW
Dear Mr. Ach:
As you are aware, the proposed Northbound Liquor Store development located at the
corner of 193rd Avenue and Evans Street NW in the Hillside Crossing development is a
City project. As such, we have prepared the Preliminary Grading Plan and Preliminary
Utility Plan for the site. There are just a few items I believe are worth noting. They are
as follows:
The site will receive sanitary sewer and water service from the existing stubs
located at the southern portion of the site off of Evans Street.
The existing hydrant located along Evans Street at the southeast corner of the lot
will need to be relocated at a location determined by the Fire Chief for providing
better fire protection to the building.
There is an existing catch basin on Evans Street which will fall into a driveway
opening for the site. This catch basin will need to have the casting changed to one
that is appropriate for a driveway location.
The proposed storm sewer for the site wilt pick up the drainage internal to the site
and will also provide an extension into the TH 169 right-of-way to intercept
highway ditch flow before it can enter the Liquor Store site overland. This
proposed catch basin and grading in the TH 169 right-of-way will require a
MnDOT permit.
The Preliminary Grading Plan shows how up to eight vehicles with trailers could
be parked on the site. That determination will need to be made at a later date as

to whether or not the parking stalls should be striped in, signed, or just allow
vehicles with trailers to park in these locations.
The northerly driveway location was designed so a full size semi-tractor/trailer
can be at the loading dock and not block the driveway.

Tenant Identification (Along Jackson)
1. A monument style sign may be located at the intersection of
Jackson Road and southernmost entrance to the project.
2. This sign shall have a maximum height of six (6) feet and a
width of four (4) feet.
3. The purpose for this sign is to identify the anchor tenant
(Target) located at the southerly end of the project.
4. Said sign shall be constructed in accordance with the
illustration on Attachment B.
Monument Sign For Freestanding Sites
1. Each of the freestanding buildings within EPC will be
allowed to have a freestanding sign. The freestanding sign must
be of a monument style with a maximum height of ten (1 O) feet and
a maximum area of one hundred (100) square feet.
2. Attachment C illustrates a typical monument sign for
freestanding buildings.
