Staff and the Parks and Recreation Conunission recommend the City Council approve the ordinance
amendment regarding park hours.
BACKGROUND/DISCUSSION
Concern has been raised in regards to activities that occur in Elk River City Parks after hours. Cturent
Cityordinance states that parks are open to the public from 6:00 a.m. to 10:00 p.m. daily. There are,
however, cases where activities are operating outside that timeframe.
PARKS & RECREATION COMMISSION
The Parks and Recreation Commission unanimously recommended approval of the request.

Staff is recommending that the Parks and Recreation Commssion recommend approval of the ordinance
amendment regarding park horns.
BACKGROUND/DISCUSSION
Concern has been raised in regards to activities that occur in Elk River City Parks after hours. Current
City ordinance states that parks are open to the public from 6:00 a.m. to 10:00 p.m daily. There are,
however, cases where activities are operating outside that timeframe. Examples of activities that are
occurring after park hours include:
• Mountain bike riding at I~llside Park
• Hikers/Skiers at Woodland Trails Park
Disk golf at Lions Park
• Parks and Recreation events such as Fright Night
The Parks and Recreation Commission discussed, at their September 8, 2010 meeting, that adjustment to
the ordinance will allow appropriate activities to occur in parks outside of established hours under the
direction of the Parks and Recreation Department.
To summarize the proposed changes, the current ordinance only allows parks to be used from 6:00 a.m
through 10:00 p.m The proposed ordinance change would allow two parks, Hillside City Park and
Woodland Trails Park, to be used until 12:00 am with approval of the City and with issuance of a pemut.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER
AMENDING SECTION 54-31 OF THE CITY CODE OF ORDINANCES
RELATING TO PARK CLOSING HOURS
The City Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 54-31 titled Closing Hours of Elk River City Code shall be
amended to read as follows:
Sec. 54-31. Closing hours.
~ No person shall enter or remain upon the grounds of any public park within the city after
10:00 p.m. or before 6:00 a.m. Anyperson involved in a Ciry sponsored/sanctioned
protram or activity ma_y be allowed to enter or remain upon the grounds of any public
nark within the city at any time.
Individuals shall be allowed to enter or remain upon the grounds of Hillside Ciry Park
and Woodland Trails Park within the Ciry unti112:00 a.m. under the following
circumstances•
a) A oermit to enter or remain in these two parks is appcoved by the Ciry of Elk River
and the users intended pumose complies with all special use requirements
b) All persons in the park after 10.00 p m must display their permit as required
through the permitting process.
Section 2. That this ordinance shall take effect upon publication as provided by law.
