The Executive Session of the City Council was called to order by Mayor Duitsman
at 5:35 p.m.
Mayor Duitsman explained that the Executive Session is being held to discuss a
personnel issue relating to a police department employee. The issue was
discussed. The Council was given the opportunity to ask questions regarding the
issue.
It was the consensus of the Council to terminate Officer Matt Habben based on
the recommendations from the City Administrator, the Police Chief and his
Sergeants and based on the information presented to the Council in oral and
written form before and during the executive session. Attorney Dale Nolan
indicated that this conclusion must be stated in a motion by the Council during
the open City Council meeting.
There being no further business, Mayor Duitsman adjourned the executive session.
The meeting of the Executive Session of the City Council adjourned at 6:05 P.M.

1. Call Meetinq To Order
Pursuant to due call and notice thereof, the special meeting of the Elk River City
Council was called to order at 5:30 p.m. by Mayor Duitsman.
2. Consider Aqenda
COUNCILMEMBER FARBER MOVED TO APPROVE THE APRIL 14, 1997, CITY COUNCIL
AGENDA. COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
3. Motion to Call Executive Session
MAYOR DUITSMAN MOVED TO CALL AN EXECUTIVE SESSION OF THE CITY COUNCIL
PURSUANT TO MINNESOTA STATE STATUTE 471.705 SUD. 1D(c) RELATING TO
PRELIMINARY CONSIDERATION OF ALLEGATIONS OR CHARGES AGAINST AN
EMPLOYEE IN THE POLICE DEPARTMENT. COUNCILMEMBER HOLMGREN SECONDED
THE MOTION. THE MOTION CARRIED 5-0.
4. Recess into Executive Session
The City Council recessed into executive session at 5:35 p.m.
5. Reconvene City Council Meetinq
The City Council reconvened at 6:05 p.m.
COUNCILMEMBER DIETZ MOVED TO TERMINATE OFFICER MA'Ir HABBEN BASED ON
THE RECOMMENDATIONS FROM THE CITY ADMINISTRATOR, THE POLICE CHIEF AND
HIS SERGEANTS AND BASED ON THE INFORMATION PRESENTED TO THE COUNCIL IN
ORAL AND WRII'i'EN FORM BEFORE AND DURING THE EXECUTIVE SESSION.
COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 5-0.
