Location 19280 Evans Street NW, Lot 2, Block 1, Hillside Crossing South Zoning/Land Use C-3 (Highway Commercial) / HB (Highway Business) Attachments · Report to Planning Commission Background Phoenix Enterprises is requesting a conditional use permit to locate a sports bar in the Hillside Crossing South Mall. On -sale liquor requires a conditional use permit in the C-3 district as does a class I restaurant. MOst of the necessary site improvements were addressed in the conditional use permit for Hillside Crossing South Commercial Center in March 1995. In July 1996 New Horizon Daycare was granted a conditional use permit for a daycare center on the north end of the mall. 13065 Orono Parkway · P.O. The landscaping surrounding the expansion will be installed per the approved landscaping plan. Page 2 Operations The approximately 6000 square foot sports bar will have a seating capacity of 145 to 160 people, a raised dining area will have 60 seats, the central bar area will have 68 seats at tables and 32 at the bar. An outdoor patio, enclosed with a black rod fence, will provide seating area on the south end of the facility with access from the bar area. The site plan shows a gate in the fence that would allow customers to access the patio without requiring them to go through the bar. There will be a dance floor and a DJ booth located in the bar area in the opposite corner from the raised dining area. The proposed hours of operation are as follows: Monday through Friday 11:00 am to 1:00 am Saturday and Sunday 10:00 am to 1:00 am Traffic, Access and Parking Traffic The peak traffic associated with this use will probably occur during the evening and during lunch time. This should not conflict with the peak traffic time of the other tenants of the center. There may be some overlap with the daycare center after work when parents are picking up children and customers begin arriving at the bar. Access Access to the bar will be via the existing entrances on the north and south end of the center. The rear driveway could become the primary access to the bar. it would be an alternative to going through the parking lot and dealing with the other traffic associated with the other businesses in the center. Since most of the traffic utilizing the rear drive will be at night, lighting is important. The existing streetlight at the north end of the center, at the exit from the S.A. station, and one at the south end near the office building dumpster, along with the lighting on the rear of the center, provides s:XplanningXscottXcu975cc-doc Memo to the Mayor and City Council/CU 97-5 Page 3 April 21, 1997 increased security to the rear of the center and adequate visibility along the driveway. Parking The site plan approved in 1995 included 158 parking spaces. The parking requirement for a bar is one space for every 50 square feet of floor area; the parking requirements for the bar, including the outdoor patio, is 115 spaces. The parking requirement for the center, including the daycare center, the sports bar and the remainder of the retail center is 200 spaces. Technically the center does not meet the parking requirements. However, since the peak parking demand for the various businesses currently in the center come at different times of the day, the 158 spaces may be adequate to meet the needs of the current businesses located in the center. If the sports bar is considered a class I restaurant, which is what the applicant is requesting a conditional use permit for, the parking requirements would be 58 spaces and the total number of parking spaces required for the center would be 143 (58 for the restaurant and 85 daycare and the remainder of the center). If the sports bar was considered a class I restaurant, the center would have enough parking spaces to comply with the parking requirements. Si~na~e Signage shall be installed per the Hillside Crossing Retail Center signage requirements. The applicant is proposing to install wall signs on the tower portion of the building and have a sign on the existing freestanding development sign on Highway 169. On Sale Liquor On sale liquor requires a license from the City council as well as a conditional use permit. The City does not have any setback requirements for liquor establishments from facilities such as a daycare center. Planning Commission Meeting At the Planning Commission meeting held on March 25, 1997 no one spoke at the public hearing. Commission discussion centered on the access to the patio seating area, lighting and signage. The applicant is proposing to allow access to the patio without having to have to go through the building; this could present security problems with customers leaving the patio with drinks. s:Xplanning\scottXcu975cc.doc Memo to the Mayor and City Council/CU 97-5 April 21, 1997 However, an outside exit through the fence is required for emergency purposes. This entrance should be ehminated in order to better control access to the patio. There will be a dance floor and a DJ booth located in the bar area in the opposite corner from the raised dining area. The floor plan shows an area that will be reserved for future use for pull tabs. When the owners of the bar decide to start the pull tabs, they will be required to get a gambling application from the State Gaming Commission and submit it to the City Council for theft review and approval. There is currently a street light at the north end of the building at the exit from the S.A. station and one on the south end near the office building dumpster. Two additional lights, of similar design to the 2 poles at the north and south ends of the building, should provide enough light to provide increased security to the rear of the mall and improved visibility along the driveway. The 4 light poles in the parking lot should provide sufficient illumination for the parking area. Sienaee Signage shall be installed per the Hillside Crossing Retail Center signage requirements. The bar will be allowed one wall sign made up of individual letters. The bar can also have a sign on the freestanding development sign along Highway 169. No other freestanding signage was approved as part of the retail centers original approval. On Sale Liquor On sale liquor requires a license from the City Council as well as a conditional use permit. Recommendation It is recommended the Planning commission recommend approval the conditional use permit request by Phoenix Enterprises to construct a class I restaurant with on sale liquor with the following conditions: 1. The proposed gate through the patio fence be eliminated. An additional 2 lights, of similar design to the 2 hghts located near S.A. exit and the office building dumpster, be provided along the driveway which runs on the east side of the mall. o One wall sign and one sign on the development sign, which complies with the Hillside Crossing Retail Center signage requirements, will be allowed. The applicant must receive a sign permit prior to placing any signs on the property.
