Attachments Resolution No. 97- Location map Exhibits illustrating easement to be vacated Overview. Kraus-Anderson is proposing to make an expansion to the north end of Cub Foods which will be a slight modification of the development plans that were originally approved for Elk Park Center. In order to facilitate this building expansion, a 25' by 30' drainage and utility easement will need to be vacated. This easement was originally platted with the Elk Park Center Planned Unit Development. With the slight modifications that have taken place in developing this center, the drainage and utility easement requested to be vacated has no utilities nor a need for future utilities; therefore, can be vacated. Recommendation It is recommended the City Council approve Resolution No. 97- , vacating certain drainage and utility easements within Elk Park Center as illustrated on Exhibit A in the attached resolution. s:\council\ev97-2.doc 13065 Orono Parkway · P.O. Box 490 · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 RESOLUTION NO. 97- RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION FOR VACATING DRAINAGE AND UTILITY EASEMENTS Case No. EV 97-2 WHEREAS, the property owner abutting the drainage and utility easement has requested the City Council in a petition dated March 18, 1997, to vacate such easement according to law; and, WHEREAS, a public hearing was held on April 21, 1997, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given on April 2 and April 9, 1997,as well as personal notice to affected property owners and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears that it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the drainage and utility easement described as follows is hereby vacated: See attached Exhibit A Adopted by the Elk River City Council this 21st day of April, 1997.
