Dear Council Members:
As directed by the City Council, we have prepared the East Elk River Planning
Document, a copy of which is attached to this letter. This document summarizes the
work that has been done over the last two to three years regarding extension of trunk
utilities and major transportation corridors in the eastern area of Elk River. As work was
being completed on this document and the major transportation corridor alignment
concept, staff had an opportunity to discuss these issues with the potential developers of
the Wadde Schultz property and the potential developers of the Earl Hohlen property.
The developers of the Wadde Schultz property have submitted a petition along with an
escrow amount for the preparation of a Phase I Eastern Area Feasibility Study to analyze
providing trunk sewer and water to their development. We are also anticipating a
petition and escrow amount from the developers of the Earl Hohlen property for the same
study.
As work was being completed on the road alignment for the realignment of CSAH 13
and the further extension south of County Road 12 to 171st Avenue, Steve Ach and I had
an opportunity to review this with Bob Vandenberg. Also, Steve Ach, Steve Rohlf, Pat
Klaers, the Mayor, and I had an opportunity to meet and discuss this road alignment with
Roger Eull and Dirk Barrett, Paul Ebner, and Carol and George Deschenes, Ruth and
LeRoy Brown, and Joe and Yvonne Kirkeide. I believe that, in general terms, the
meetings all went very well. Staff and/or the Mayor would be able to comment further
on these meetings Monday evening.
At Monday evening's meeting, I will be prepared to discuss the Planning Document or
answer any questions, and I anticipate going through the road alignment in detail. After
a discussion of the issues, there are two actions staff would recommend City Council
taking at Monday evening's meeting. The first action would be to approve the concept
of the road alignment and authorize preparation of an official map document. By
officially mapping the road alignment, we would be going the next step and detailing out
the alignment by preparing essentially a plat that describes the alignment. The second
action we would recommend would be to accept the petition from the developers, and

authorize the preparation of an Eastern Area Phase I Feasibility Study. We would
recommend that feasibility study be authorized with two alternatives. The first, a small
scale project which would include only Wadde Schultz's and Earl Hohlen's property.
The second alternative would be a larger scale project which would include all the area
needed to get street and utilities down to 171st Avenue at TH 10. Attached are two draft
resolutions for the Council's consideration, which would authorize these two actions.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION APPROVING THE CONCEPT OF THE
CSAH 13 REALIGNMENT AND NEW ROAD EXTENSION
FROM COUNTY ROAD 12 TO 171ST AVENUE, AND
ORDERING THE PREPARATION OF AN OFFICIAL MAP
OF THIS ROAD REALIGNMENT CONCEPT
WHEREAS,
the City has prepared a Draft Transportation Study which recommends the
realignment of a portion of CSAH 13 and a new major transportation corridor from
County Road 12 to TH 10 at 171st Avenue in the Eastern Area of Elk River; and
WHEREAS, the City has reviewed the concept of the CSAH 13 realignment and new road
alignment from County Road 12 to 171st Avenue; and
WHEREAS,
171st Avenue between TH 10 and the Burlington Northern/Santa Fe Railroad was
reconstructed in 1996 to Municipal State Aid standards, anticipating this road
alignment;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The concept for the realignment of CSAH 13 north of County Road 12, and the road
alignment from County Road 12 to 171st Avenue is hereby approved.
MSA, Consulting Engineers is instructed to prepare an official map of the realignment of
CSAH 13 and new road alignment from County Road 12 to 171st Avenue.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASIBILITY REPORT IN THE MATTER
OF THE EAST ELK RIVER PHASE I IMPROVEMENT OF 1997
WHEREAS
the City has received a petition (the Petition) requesting that the City improve
certain property by extending trunk sanitary sewer and water and major street
construction (the improvements); and
the City has reviewed the Petition and identified the owner of the real property
abutting the streets named in the Petition and determined the Petition has been duly
executed by the owners of not less than 35 % in frontage of the real property
abutting on the streets named in the Petition as the location of the improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The Petition is hereby declared to have been signed by the owners of at least 35 % of the
frontage of the real property abutting on the streets named in the petition as the location
of the improvement. This declaration is made in conformity to Minnesota Statutes,
Section 429.035.
This Petition is hereby referred to MSA, Consulting Engineers who is instructed to
provided to the City Council a report advising, in a preliminary way, whether the
proposed improvement is feasible and whether the improvement should thus be made as
proposed or in connection with some other improvement and the estimated cost of the
improvement as recommended.
