The property is located at the northwest corner of Meadowvale Road (County Road 32) and County Road 1. The Sachs owned approximately 33 acres at the northwest corner of County Rd. 32 and County Rd. 1. A 5 acre parcel was subdivided from the west side of 13065 Orono Parkway · P.O. A 6.29 acre lot, located at the intersection, was subdivided in 1991. This lot includes a pond, the original farmhouse and barn. In 1989, in order to allow for the construction of a detached garage on the adjacent 5 acre lot, a 30' by 102' lot line adjustment was deeded. This was necessary because the garage was located on the original lot line and did not meet the setback requirements. The remaining 21.65 acres is the subject of the current request for administrative subdivision. Proposed subdivision The proposed 6 acre lot complies with the dimensional requirements of the Rla district. The lot has 267 feet of frontage on County Road 1. There is a small pond located near the center of the lot, and the proposed house location is near the southwest corner. The proposed lot will be serviced by on-site well and septic. The proposed locations of the well, primary and alternate septic systems should be shown on the survey. The remaining 15.6 acres includes the applicant's residence. There is an 280' by 440' isolated piece directly west of the proposed 6 acre lot that is included as part of the 15.6 acres. The applicant indicated that this is included as part of the 15.6 acre parcel in order to maintain Green Acres status. At some point in the future it will either be combined with the proposed 6 acre parcel to the east or the existing 5 acre parcel to the south. Access Access to the proposed 6 acre lot will be from County Road 1. A driveway permit will be required from Sherburne County. The remaining 15.6 acres is accessed by an existing driveway from County Road 32. Right-of-way The property involved in this subdivision has frontage on both County Road 32 and County Road 1. The proposed 6 acre lot has frontage on County Road 1 and the remaining 15.6 acre parcel has frontage on both County road I and County Road 32. Additional right-of-way will need to be dedicated in order to have the necessary 50 foot half right-of-way on county roads. See the city Engineer's memo for comments regarding possible 30 foot right-of-way along north boundary line. Drainage and utility easements will also have to be granted over the pond located on the proposed 6 acre lot. Park and Recreation Commission At their meeting of May 14,1997, the Commission recommended cash dedication in lieu of land to satisfy the park dedication requirements for the one new lot being created. Recommendation It is recommended the City Council approve Nellie Sach's request for administrative subdivision with the following conditions: Drainage and utility easements be granted to the City over 10 feet around the perimeter of the site. A drainage easement is also needed over the pond located on the 6 acre parcel. o A grant of easement be prepared and executed granting 50 feet of right-of-way along County Road 1, including both parcels; additional right-of way will also be required along County Road 32 per Sherburne County and the City. o Proposed locations for the well, primary and alternate septic systems shall be shown on the proposed 6 acre parcel. ° Park dedication fee in the amount of $600 shall be paid to the City prior to recording this subdivision with Sherburne County. o Surface water management fee in the amount of $66.83 shall be paid to the City prior to recording this subdivision with Sherburne County. The applicant shall receive all necessary County permits in order to allow access from County Road I to the proposed 6 acre lot. o A legal description of the 15.6 acre parcel be provided prior to recording this subdivision with Sherburne County. 10. Based on our review and comments received at the staff review meeting, we would offer the following comments: The applicant is attempting to split off one lot approximately six acres in size from a larger piece of property. The drawings that were submitted were prepared by Taylor Land Surveying. The first one showed the overall property and the second one showed the specifics of the lot proposed to be broken off. The parcel that is to be subdivided is a peculiar shape and leaves a remnant to the west that is virtually disconnected from the remainder of the property. This raises the question as to what are the property owner's future plans for this land. We question whether, at some point in the future, a road servicing property further to the west or north would be needed off of CSAH 1. If there is any potential for this to be needed at any time in the future, this subdivision should be required to provide a half of right-of-way or a 30-foot right-of-way along the north boundary line. Drainage and utility easements should be provided around the perimeter of the site. OFFICES IN: ,qNEAPOLIS PRIOR LAKE ST. PAUL WASECA County Road 32 to the south of the site is the proposed corridor for an east-west collector route in the City's Draft Transportation Plan. We have not seen the County's Draft Transportation Plan, but have been led to believe that it will recommend a similar type of corridor. Therefore, we would recommend that a 100-foot right-of-way for County Road 32 be acquired. An Equal Opportunity Employer Mr. Steve Ach May 14, 1997 Page Two 5. No topography or spot elevations have been provided; therefore, it is impossible to determine if any additional easements should be provided for items such as wetland or drainage from one parcel to another. It is also impossible to determine how, if at all, this subdivision of land will affect the surrounding parcels. If you have any questions regarding these comments, please call.
