Overview
The City Council approved the preliminary plat for Lafayette Woods on June
19, 1995. The preliminary plat included 213 single family lots, in addition to
an area of approximately 30 acres that was donated to the city as a
charitable contribution. The first phase of Lafayette Woods included 75
single family lots and the construction of the necessary streets to provide
services. The second phase will include a total of 51 lots which will also

involve additional street construction including a connection along the west
portion of the development to County Road No. 1. This connection will
provide two access points into the development; one off of County Road No. 1
and the other off Proctor Avenue.
The development was approved with sidewalks being constructed along the
primary route through the development. This route includes the entrance off
of Proctor Avenue and along the road that winds through the development
ultimately ending up at County Road No. 1. The sidewalk in the first phase
is expected to be built in the next couple of weeks and there will also need to
be a short segment of sidewalk built in the southwest portion of the second
addition along Upland to County Road No. 1.
The proposed second addition of Lafayette Woods has some slight deviations
from the preliminary plat that was originally approved. The variation is
primarily related to the number of lots included on the final plat. The final
plat has been adjusted by eliminating two lots. Other than the number of
lots, the final plat is consistent with the preliminary plat that was .originally
approved by the City Council.
The developer has submitted a grading and development plan for the entire
development that is being reviewed by Terry Maurer. It is anticipated that
the entire site will be rough-graded in accordance with an approved grading
plan by Terry Maurer to accommodate the balancing of dirt on this large site.
During the grading of the site, measures will be taken to preserve as many
trees as possible.
Fence Adiacent to Ridgewood
During the preliminary plat review of Lafayette Woods there was some
concern from the Ridgewood subdivision immediately to the north that there
may need to be some type of fence or barricade constructed along the north
borders of this plat, due to the private ski hill in the Ridgewood subdivision.
As a condition of the final plat approval in the first phase, the Council
included a condition which read:
"A review of the possible need for a security fence between the
proposed development and Ridgewood subdivision be made by the City
Council prior to the final plat approval of that phase closest to
Ridgewood subdivision."
The second phase of Lafayette Woods does not go all the way to the north
border adjacent to Ridgewood, however, there may be residents in attendance
from Ridgewood subdivision ready to discuss the fence issue. One additional

note; as part of the first phase of Lafayette Woods, the developer donated 30
acres to the city. This 30 acres includes a strip of land approximately 100
feet wide between Ridgewood and Lafayette Woods. The fence that has been
discussed would occur on city property throughout this deeded outlot to the
city. The developer has expressed a concern in constructing a fence since it
will involve clearing and grubbing a swathe through the woods in order to
construct such a fence. The developer has indicated that he will be. present at
the meeting Monday night to answer any questions the Council may have.
Recommendation
It is recommended the City Council approve Resolution No. 97- , granting
final plat approval for Lafayette Woods 2nd Addition with the following
conditions:
A developer's agreement be prepared and executed outlining terms and
conditions for plat approval.
o
All of the concerns and comments outlined by the City Engineer be
addressed and incorporated into the final plans for the development.
A water availability charge of $300 per lot be paid to Elk River
Municipal Utilities prior to releasing the final plat for recording.
°
Surface water management fee in the amount required by the city at
the time of final plat be paid prior to recording the plat with 'the
county.
A sealcoating fee in the amount determined by the City Engineer be
paid prior to releasing the plat for recording.
°
Park dedication fee be paid on a per lot basis. This fee will need to be
paid prior to releasing the final plat for recording.
°
Prior to issuance of a building permit, a grading and development plan
be submitted and approved by the City Engineer.
o
Developer pay any outstanding legal and engineering fees associated
with the review of this plat prior to recording the plat with the County.
o
A letter of credit in the amount required by the city to cover the costs
of improvements shall be submitted prior to releasing the plat for
recording.

10. Sidewalks shall be installed along Upland Avenue from County Road
No. I to the terminus of Upland Avenue.
11.
A review of the possible need for a security fence between the proposed
development and Ridgewood subdivision be made by the City Council
prior to the final plat approval of that phase closest to Ridgewood
subdivision.
12.
Appropriate wetland permits be obtained prior to construction
occurring within or adjacent to wetland areas.

FINAL PLAT APPROVAL
Dear Mr. Ach:
As you requested, we have reviewed the final plat for Lafayette Woods Second Addition.
It appears from our review that the final plat is very similar to the preliminary plat that
was approved some time ago. It appears that one or two lots may have been removed
and the lots on the final plat are slightly larger than had been envisioned when the
preliminary plat had been approved.
We have recently received the proposed grading plan for the development. At this point
in time, the review of that grading plan is not complete. We have also not seen any
utility plans for the Second Addition as of yet. Coordination of the review of the final
plat with the grading and utility plans is important because of the potential need for
easements on the final plat. Therefore, we would recommend approval of the final plat
contingent on review, and approval of the grading plan and utility plan.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
LAFAYETTE WOODS 2ND ADDITION
Case No. P 97-9
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on June 19, 1995; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
It is hereby determined by the City Council for the City of Elk River as
follows:
The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and
siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
The proposed subdivision will not cause substantial environmental
damage.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.
The owner of the Property is authorized to record the final plat 'as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
This final plat approval shall expire one year from the date of this
resolution if the final plat is not recorded within that time.
