Consider a request by Jim Maplethorpe for an administrative subdivision to
subdivide a 5 acre lot into two 2.5 acre lots.

.Overview
The applicant is proposing to subdivide a 5 acre lot into two 2.5 acre parcels.
The property is located on 196th Avenue west of Ogden Street. The parcel is
wooded with a ridge running west to east across the rear of the property. The
lot has an existing house; this house will be included as part of parcel B.
Access to the existing house is from the cul de sac on 196th Avenue; access to
the new lot will also be from the cul de sac.

Dimensional Requirements
The lots comply with the dimensional regulations and the lot size
requirements of the Rla zoning district. However, the location of the existing
house and septic system will have to be shown on the survey in order to
determine if the lots comply with the setback requirements. The proposed
locations for the house, well, primary and alternate septic systems should be
shown for parcel A.
Typically lot lines run perpendicular or, in the case of a cul de sac, are radial
to the right-of-way. The lot line that separates the two parcels is unusual in
that it starts out for the first 100 feet perpendicular to the right-of-way then
jogs to the northwest. This unusual configuration is needed to avoid the
existing septic system that services the house on parcel B.
Property Ownership
There is also an area on the west side of lot A that is noted on the survey as
an area that others may claim ownership. The applicant should provide proof
that they actually own this portion of the property.
Easements
The applicant should provide drainage and utility easements along the
property lines. There is also an easement for 196th Avenue that extends
approximately 75 feet from the end of the existing cul de sac to the west
property line of parcel A. Typically the applicant is required to construct the
road to the edge of the property being subdivided. In this case the applicant is
not proposing to extend 196th Avenue at this time. The extension of the
street is not needed in order to provide access to parcel A, the lot can be
accessed from the cul de sac. If the Council would like to have the applicant
pay the cost of extending the road 75 feet to the western boundary of their
property, it could be made a condition of approval. If it is not done at this
time, it could be extended when the property to the west is developed.
Junk Vehicles and Debris
There are junk vehicles and debris located on the property. The site should
be cleared of junk vehicles and debris prior to recording the subdivision.
Park and Recreation Commission Recommendation
The Park and Recreation Commission has recommended a cash dedication in
lieu of land to satisfy the park dedication requirements for the new lot.

Recommendation
It is recommended that the City Council approve Jim Maplethorpe's request
for an administrative subdivision with the following conditions.
THE LOCATION OF THE EXISTING STRUCTURES, WELL AND SEPTIC SHALL BE SHOWN
ON THE SURVEY.
THE PROPOSED LOCATION FOR THE HOUSE, WELL, PRIMARY AND ALTERNATE SEPTIC
SYSTEMS SHALL BE SHOWN FOR PARCEL A.
FIVE FOOT DRAINAGE AND UTILITY EASEMENTS SHALL BE PROVIDED ALONG ALL
PROPERTY LINES AND TEN FEET ALONG THE STREET RIGHT-OF-WAY.
DOCUMENTATION SHOWING PROOF OF OWNERSHIP OF THE AREA OF PARCEL A,
WEST OF THE FENCE, NOTED ON THE SURVEY AS "OTHERS MAY LAY CLAIM TO LAND
LYING WEST OF THE FENCE".
THE JUNK VEHICLES AND DEBRIS SHALL BE REMOVED PRIOR TO RECORDING THIS
SUBDIVISION WITH SHERBURNE COUNTY.

PAYMENT OF A PARK DEDICATION FEE IN THE AMOUNT OF $600 FOR THE NEW LOT
BEING CREATED TO BE PAID PRIOR TO RECORDING THE ADMINISTRATIVE
SUBDIVISION.
PAYMENT OF A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF $61.80 FOR
THE NEW LOT BEING CREATED TO BE PAID PRIOR TO RECORDING THE
ADMINISTRATIVE SUBDIVISION.
IN ORDER TO PREVENT THE SPREADING OF OAK WILT, THE APPLICANT SHALL TAKE ALL
NECESSARY PRECAUTIONS AND FOLLOW PROPER CUTTING PROCEDURES WHEN
REMOVING TREES.
