SUBJECT: City Attorney's Comments Regarding Transfer of Development
Rights Program
Staff requested that the City Attorney, Peter Beck, review the Transfer of Development
Rights Program drafted by Commissioner Niziolek. Mr. Beck's comments are as follows:
1. How will the increase of density from one zone to the other be sold politically to the
Council? In some cases, the density could potentially double from what is currently
allowed under the Zoning Ordinance.
2. There is a potential administrative burden that needs to be considered and calculated
into this program. Administrative responsibilities would include crafting the ordinance
language, maintaining the marketing site, and tracking the sale of development coupons.
In Mr. Beck's opinion, this is an unusual program for a city to undertake. Typically, these
types of programs are implemented at the county or regional level.
