1. DNR Grant Awards for Top of The World Addition
The City of Elk River has been awarded 1.2 million dollazs towards the
acquisition of 80 acres of land adjacent to Top of the World Park.
2. Conservation Partners Grant for Highlands East
The City of Elk River has been awarded a matching grant of $6,000 for prairie
and woodland restoration work at Highlands East Pazk
3. Rain Garden and Filter Strip at Orono Park
Grading and planting were finished in late June and plants aze well established.
Curb cuts and paving will take place in August.
4. Outsourcing Grounds Maintenance
In 2006 staff has budgeted for grounds maintenance of City Hall, the library,
Northbound and Westbound Liquor and the area around Lions Park Center to be
handled by a private contractor. This will provide an opportunity for Pazks and
Recreation Maintenance staff to focus on park maintenance and projects. Staff is
exploring the establishment of low maintenance native plantings along Twin
Lakes Boulevard to further reduce time spent mowing.
Culvert Upgrade Under CR 77
Tiller Corporation is planning to install a culvert for their conveyors under CR 77.
Tiller will abandon this structure in approximately 15 years. There is an option for
the city to pay for a size upgrade to 12' by 14' that would allow it to converted to
a pedestrian underpass. The cost of this upgrade is approximately $80,000. Staff is
investigating funding options.
6. Trail Easements and Park Dedication
When making recommendations on park dedication questions, there appeazs to be
some confusion as to what constitutes the Park Commissions mission. The
commission is requested by staff to focus on the question of cash or land, based
on the goals of the master plan. Planning staff will use the trail master plan as a
template to obtain easements. Planning Director, Michelle McPherson has
provided a memo clarifying the various methods of obtaining land for trails.

SUBJECT: Primer on Trails
This memo is written to provide information to the Commission regarding the use of easements
versus land in fee title for public trails.
Trail Easement
A trail easement grants permission over a parcel of property for public access. This trail
easement could be a specific corridor described along an alignment through a parcel of property,
or it could be a large "blanket" easement, whereby a large portion of the parcel is encumbered
by the trail easement and the City has wide latitude for constructing the trail. In an easement
condition, the City does not own the underlying land; therefore, park dedication credit in the
form of land is not required to be given.
Fee Title
In this condition, the City would be given land which it would own in fee title for construction
of a trail. In this instance, park dedication credit would be given for land. An example of such a
trail connection is Outlot A in Trott Brook Farms 8~' Addition. This is a City-owned 50' wide
trail connection located between two homes which will connect Olson Street to Outlot K, Trott
Brook Farms.
Other Considerations
It should be noted that when reviewing plats with wetlands, trail easements or trail corridors will
need to be carefully sited to avoid wetland impacts. The Technical Evaluation Panel will require
mitigation for any fill over and above the dem,,,~mus allowed by Statute. The mm;mum allowed
is not a significant amount of area; therefore, wetland fill in favor of trail construction will need
to be carefully evaluated on a case-by-case basis.
Hopefully, this information will the assist the Commission in making its recommendations for
trails and park dedication.
