Box 490 Elk River, MN 55330-0490 RE: JOINT POWERS AGREEMENT FOR ENGINEERING FEES TRUNK HIGHWAY 10 AND UPLAND, TRUNK HIGHWAY 10 AND SIMONET DRIVE, UPLAND AVENUE AND SIMONET DRIVE Dear Mr. Klaers: Enclosed are five (5) copies of the Joint Powers Agreement and five (5) copies of a Resolution for each of the MnDOT projects located on Trunk Highway 10. First of these is the left turn lane being added at Simonet Drive and the second is the signalization of the intersection of Upland Avenue. These agreements are for reimbursing the City for consultant fees for the design and inspection of these projects. MnDOT has chosen to use this method for reimbursing these fees. They have asked that each of these agreements and resolutions be approved by the City and signed by the Mayor and City Administrator. The project includes work on Simonet Drive also. Please present this agreement to the city council for its approval and execution which includes original signatures of the council's authorized officers and the affixing of the city seal on all copies of the agreement. Please return, as soon as possible to this office, the agreement along with five certified copies of a new resolution (suggested form enclosed) passed by the city council authorizing its officers to sign the agreement on its behalf. The fifth copy of the agreement is for use by the City until a fully executed copy is returned to the City. NOW, THEREFORE, BE IT RESOLVED that the City of Elk River, Minnesota, enter into Agreement No. 76115 with the State of Minnesota, Department of Transportation, to provide for the City to manage the design and construction inspection of the proposed Trunk Highway No. 10 improvements, and for Mn/DOT to reimburse the City for the costs of the design and construction inspection, and the City resolves to amend this agreement to the actual costs of the city's consultant for the design and construction administration in the event those costs are less than those agreed to in the price of this agreement. Upon completion of the project design, and prior to the contract letting for the construction of the Trunk Highway No. 10 improvements, Mn/DOT will prepare an agreement to provide for Mn/DOT to pay its share of the construction costs of the Trunk Highway No. 10 improvements in accordance with the current "Procedures for Cooperative Construction Projects with Municipalities" (a copy of which has been received by the City). CERTIFICATION I hereby certify that the foregoing Resolution is a true and correct copy of the resolution presented to and adopted by the Council of the City of Elk River at a duly authorized meeting thereof held on the __ day of , 1997, as shown by the minutes of said meeting in my possession.
