Staff recommends that the Parks and Recreation Commission recommend approval of the Ordinance
Amendment.
OVERVIEW
After receiving feedback from the Parks and Recreation Commission at their January 12, 2011 meeting,
staff has drafted an ordinance regarding the disturbance of natural features and wildlife in City parks.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER
ADDING SECTIONS 54-34 & 54-35 OF THE CITY CODE OF ORDINANCES
RELATING TO DISTURBANCE OF NATURAL FEATURES AND WILDLIFE
IN PARKS
The Ciry Council of the City of Elk River does hereby ordain as follows:
Section 1. That Section 54-34 titled Disturbance of Natural Features of Elk River City
Code shall be amended to read as follows:
Sec. 54-34. Disturbance of Narural Features.
(a) It shall be unlawful for any person and/or pet to:
1) Deface, remove, alter, cut, injure and/or destroy any tree, plant, flower, grass, rock, soil, or
mineral.
2) Introduce any plant or other agent within a City park.
3) Dig trenches, holes, or other excavations in a City park.
4) Remove any device, apparatus, or material installed for the protection, support, or
preservation of any tree, shrub, or plant.
5) The harvesting of fruits and nuts for personal consumption and the controlling of exotic
vegetation shall be allowed with written authorization from the City Administrator, or their
designee.
Section 2. That Section 54-35 titled Disturbance of Wildlife of Elk River City Code
shall be amended to read as follows:
Sec. 54-35. Disturbance of Wildlife.
(a) It shall be unlawful for any person and/or pet to:
1) Kill, trap, hunt, remove, hazass, annoy, pursue, or in any manner disturb or cause to be
disrurbed, or have in possession any species of wildlife found within the confines of any City
park, except that hunting and fishing maybe permitted in designated areas established by the
City and shall be subject to the laws and regulations as established by the State of Minnesota.
2) Release or abandon any animal within a City pazk.
3) Feed any wildlife in a Ciry park.
4) Remove any animal or animal remains, such as but not limited to, whitetail deer antler sheds,
from a City park and any animal and/or remains so removed or taken contrary to the
provision of this Ordinance or laws of the State of Minnesota, shall be considered
contraband and subject to seizure and confiscation.
Section 3. That this ordinance shall take effect upon publication as provided by law.
