SHERBURNE COUNTY ADMINISTRATION BUILDING EXPANSION
PETITION FOR WATERMAIN AND ROADWAY
Dear Council Members:
At last Tuesday's County Board meeting, City Administrator Pat Klaers and I appeared on
behalf of the City to discuss the need for water improvements for fire fighting purposes and
roadway improvements for a secondary access to the County Administration Building in
conjunction with their planned expansion. At that Board meeting, the County Board voted
unanimously to petition the City for these improvements. At this point in time, we have not
received the signed petition from the County, but believe that it will be forthcoming.
Therefore, attached to this letter is a resolution which declares the adequacy of the County
petition and authorizes the feasibility study for the necessary improvements.
It should be noted that this project will entail crossing the Gagne property with lateral
sanitary sewer, trunk watermain, and street and storm drainage improvements to access
the Sherburne County site. There are currently no easements or road right-of-way
crossing the Gagne property. Therefore, if the City is unsuccessful in negotiating with Mr.
Gagne for these easements and/or road right-of-way, it may be necessary for the City to
use their powers of eminent domain to secure the necessary easements. It should also
be noted that these improvements that were petitioned by the County Board would also
entail lateral sanitary sewer and watermain assessments along with street and storm
drainage assessments against the Gagne property. Staff felt it was imperative that the
County petition for watermain and street improvements prior to a building permit being
issued for the expansion of their facility because of the need for fire protection and a
secondary access to the signalized intersection at TH 10 and Joplin Street. Therefore, it
is important to note that staff feels this project is necessary to move forward even if it
requires condemnation of the necessary easements across the Gagne property.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASIBILITY REPORT IN THE MATTER
OF THE WATER, STORM DRAINAGE, AND STREET IMPROVEMENT OF 1997
TO SERVE THE SHERBURNE COUNTY ADMINISTRATION BUILDING
the City has received a petition (the Petition) requesting that the City improve
certain property by the extension of watermain, street, and storm drainage
facilities; and
the City has reviewed the Petition and identified the owner of the real property
abutting the streets named in the Petition and determined the Petition has been duly
executed by the owners of not less than 35% in frontage of the real property
abutting on the streets named in the Petition as the location of the improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
The Petition is hereby declared to have been signed by the owners of at least 35 % of the
frontage of the real property abutting on the streets named in the petition as the location
of the improvement. This declaration is made in conformity to Minnesota Statutes,
Section 429.035.

This Petition is hereby referred to Howard R. Green Company, who is instructed to
provided to the City Council a report advising, in a preliminary way, whether the
proposed improvement is feasible and whether the improvement should thus be made as
proposed or in connection with some other improvement and the estimated cost of the
improvement as recommended.
Passed and adopted this 21st day of July, 1997.
