(MMUA) Legislative Conference in St. Paul will be March 3Ud' -April 1S`. We are budgeted for one Commissioner and one Staff member to attend. On February 22nd, Utilities Commission Chair John Dietz and I testified before the State House Health and Human Services Committee in opposition of HF135. The HF135 (and sister SF64 in the State Senate) propose to amend State Statute to remove a cities authority to regulate private wells within a city's corporate boundary. House File 135 passed on a party line vote 12-6 to be passed on to the next committee for review. Enclosed for your reading is the current MMUA Capitol Tattler. ~i • Vol. 14, No. 3 Feb. 18, 2011 Funny, after all the storm and drama the issue has raised over the years, but the Minnesota House of Representatives Thursday calmly passed a bill (HF 9, Rep. Peppin, R- Rogers) repealing the restriction against approval of state certificates of need for new nuclear generation. The vote was 81-50. Earlier, the Senate approved its version of the bill 50-14. The bills will now be reconciled in a conference committee. Gov. Mark Dayton's signature remains uncertain. The Senate Energy, Utilities and Telecommunications Committee yesterday (Thursday, Feb. 17) heard testimony in regards to the state's Conservation Improvement Program (CIP). Testimony was taken from the Office of Energy Security (OES) and MMUA. Bill Grant and Jeff Haas of OES gave a 45-minute overview of the law. They made a couple points that MMUA agreed with, including stating savings that accrue over the lifetime of a project should be considered when determining annual energy savings and that supply-side savings should also be considered when tallying energy savings. Bob Jagusch, MMUA Director of Energy Services, and Larry Johnston of the Southern Minnesota Municipal Power Agency, testified on behalf of municipal utilities. Jagusch focused on how CIP affects utilities, especially those who are not affiliated with a power agency. He mentioned that municipal utilities, given their diversity, are a good testing ground for many different energy efficiency programs. Among the issues the Legislature may want to take a look at, Jagusch said, were how to quantify savings from 'behavioral' programs and how to better count savings from improvements made to the utility system. Johnston reinforced Jagusch's points and stressed the need for a serious discussion on how to make CIP work in the future. He advised the committee to consider'incentivizing' efficiency measures that provide energy savings over a longer term and those that save energy on the utility side of the meter. Testimony is expected next Tuesday from the investor-owned and cooperative electric utilities. No specific piece of legislation is being heard at this time. Afree-flowing discussion between interested parties is being considered following next week's hearing. On Tuesday, Feb. 15, the Senate Energy Committee heard testimony on the Renewable Development Fund. Some sentiment had been expressed leading up to the hearing on requiring • municipal utility contributions to this fund. It appears that idea has been scrapped. Utilities with nuclear plants (Xcel) contribute to this fund at this point. MMUA lobbyists don't traditionally spend a lot of time in the House Health and Human Services Reform Committee, but the committee is expected to hear HF 134 (Hackbarth, R- Cedar), which would rescind the authority of city councils to regulate private wells within city limits. Introduction of this bill followed hard on the heels of an announcement from the Minnesota Department of Health that it would no longer challenge city authority to .regulate wells by ordinance or through city zoning code. Cities sought clarification of their authority after property owners within city boundaries drilled their own irrigation wells within municipal water utility service areas to avoid paying city utility rates. Private well drillers have used state mandated conservation rates as a selling point for their services. This has led to a serious strain on the financial viability of public water systems where it has occurred, reports the League of Minnesota Cities, and has also resulted in large increases in water use through new private wells, affecting future water availability and security of the public water supply. A related bill of interest is HF 517, which limits water conservation rate structure application to public water suppliers serving more than 1,000 people in the metro area, repeals street lighting mandates and the mandate for transmission-owning municipal utilities to file transmission reports with the state. Governor Mark Dayton introduced his budget on Wednesday. It was not well-received by the Republican-controlled Legislature. April 29 -first policy deadline. A bill must have passed out of one body's committees to continue to be considered, May 6 -second policy deadline. A bill must have passed out of both bodies' committees and be reported to the floor to stay alive. Other important dates include: April 19-25, spring break. This is a new record high in transaction. volume, up 68 transactions from last month's previous highest volume. February's fee should be $1,557. I'll continue to update the commission on the transaction volume and costs with the absorbed fee in place. The auditors were here for fieldwork March 2na -March 4th and it went well. A verbal update can be provided at the meeting. Final audited financial statements are planned to be presented at the April commission meeting. The first few months of activity with the sweep account in place at our bank have been successful. Instead of earning a .15% return, we realized a 1.11% at a maximum utilization of our funds. Were we to try and manage the return on investments through transfers to our savings account, we would have recognized a 1.00% return and wouldn't have reached the same maximum utilization. Work continues to be done to ensure the CRC move is successful. They have asked for a lot of information and some has been completed and some we continue to work on. We have a change to incorporate in our database in how we store the phone numbers in order for them to be able to recognize our customers in the least amount of time. We have stored two numbers in the same field and CRC can only accept one. This will take some effort to make this change but we are working on it. The leak started because of a faulty heater that corroded and did not trip out, which increased the temperature above normal and caused a tank to emit chlorine. The Elk River Fire • Department came to set up perimeters and secured the area from traffic/local residents until the hazmat team came to the well to contain the tank and assess the area. With this we go through checking Padmount transformers and Padmount switch gear making sure nothing is leaking, the proper tags are in place, the map book matches the tags, and all the warning stickers are on the outside. • Continue working on tree trimming. • Finished installing adapters on the old A-base meter sockets so we can use the new electronic meters. • Finished testing the overhead and underground protective grounds. We are also testing the fiberglass hot sticks. Both of these are done annually. • Had two new electric services. • The City shop does D.O.T.'s for our trucks and trailers. In February, the locating department had a total of forty-four locate tickets. Four of those were "emergency" locates. r Staff has been using the thermal imaging camera to detect "hot-spots" in our primary electrical equipment on the power distribution system. - February 8t~' thru February 1 1, 2011 Jeff Murray attended the Meter School in Marshall along with two of the linemen. His education report is attached. - The Metering department continues with weekly and monthly substation checks, and doing the monthly power bill. The meter change-out program is still continuing as time permits. - Home Energy Audits are still underway and are keeping our staff busy. - The Security Systems department had a total of forty-eight phone contacts, eleven personal visits, eleven systems quoted, seven sales made, seven installs completed and nine service calls for the month of February. - Power plant staff did the monthly run on the engines. Everything went well. - On Thursday, Feb. 24"' at 11:32 am, GRE was testing relays and accidentally tripped out the bus feeding into our substation transformer 14-3. This resulted in a four minute power outage for some businesses, apartments and about 3,000 customers. Our office staff did a great job of handling the flood of phone calls.
