Steinman, Director of Economic Development August 13, 1997 SAC Charges for Historic Downtown The purpose of this agenda item is to formally adopt an ordinance to allow a reformulation of the method of calculating SAC charges for restaurants within Historic Downtown. As you may recall, this issue was brought before the Council in concept form at a previous Council meeting. It was discussed, reviewed, and approved by the Council at that time. This issue appears before the Council at this time in an identical form to which it was previously discussed. Upon approval and publishing of the attached ordinance amendment, the new method for calculating SAC charges for restaurants within the Historic Downtown area will be established. Box 490 · Elk River, MN 55330 · TDD & Phone: (612) 441-7420 · Fax: (612) 441-7425 ORDINANCE 97 -__ AN ORDINANCE OF THE CITY OF ELK RIVER AN ORDINANCE AMENDING SECTION 1302.10, SERVICE AVAILABILITY CHARGES (SAC), OF THE ELK RIVER CODE OF ORDINANCES The City Council of the City of Elk River does hereby ordain as follows: Section 1. That Section 1302.10 of the City of Elk River Code of Ordinance shall be amended by adding the following underlined paragraph referring to the "historic downtown": 1302.10 - SERVICE AVAILABILITY CHARGES (SAC) The debt service for the wastewater treatment facilities shall be recovered from new connections by a service availability charge (SAC) assessed against new building units. The service availability charge shall be paid at the time at which a building permit or a sewer connection permit is issued for all buildings to be constructed or connected to the sewer system on or after the effective date of this ordinance. No charge shall be due upon the issuance of a connection permit if a charge was paid upon issuance of a building permit. The debt service connection charge for each building or structure shall be equal to the number of SAC units times the service availability charge in effect at the time of the application. The SAC units for a full service restaurant located within that part of historic downtown described as Main Street (both sides) from the Parrish Avenue bridge to Lowell Avenue; Jackson Avenue (both sides) from Highway 10 to Main Street; and Kinq Avenue (both sides) from Highway 10 to Main Street, shall be as follows: 22 seats = 1.0 unit The SAC units for the various Residential Dwellings shall be calculated as follows: Single-family houses, townhouses & duplex units 1.0 unit Condominium and apartment units 0.8 unit Public housing units subsidized under any federal program for iow and moderate income housing 0.8 unit The SAC units for various Commercial, Public and Institutional facilities shall be calculated according to the following table. Section 2. That the definition of "Restaurant (full service)" in Section 1302.10 of the City of Elk River Code of Ordinance be amended to read as follows: SERVICE AVAII2%BILITY CHARGE (SAC) UNITS FACILITY PAI~%~4ETER SAC RESTAUPJ~NT (full service) 8 seats 1 washable silverware, glasses & dishes) *EXCEPTION - HISTORIC DOWNTOWN 22 seats 1 Section 3. provided by law.
