TRUNK HIGHWAY 169 FENCING AND LIGHTING
Dear Council Members:
We have received from MnDOT the cooperative construction agreements for both the Simonet
Drive left turn lane construction and the Trunk Highway (TH) 169 fencing and lighting project.
We have reviewed both of these agreements and find them to be very similar to many of the
previous agreements that the City has entered into for joint projects with MnDOT. Both
agreements spell out that the projects are 100% funded by MnDOT. With the Simonet Drive
project we have a separate agreement that spells out reimbursement for engineering services.
The TH 169 fencing and lighting agreement indicates the state will pay 8% of construction cost
for engineering and construction services.
The one item in the TH 169 fencing and lighting agreement that is slightly different is the
maintenance of the improvements. As we discussed previously, MnDOT's 100% funding of the
improvement costs was conditioned upon the City accepting maintenance responsibility. With
regard to the fence that would include repair of any damage to the fence, grass mowing where
the fence is moved into the MnDOT right-of-way weed control and debris removal. With regard
to the lighting along TH 169, the City through this agreement is responsible for the reinstallation
of knocked down poles, repair of wiring, and the replacement of luminairs. The City is also
responsible for providing the necessary electrical energy to operate the lighting system.
Based on our review of these documents, we would recommend that the City Council adopt the
attached resolution. By adopting these resolutions, the City enters into this agreement and
instructs the Mayor and City Administrator to execute the agreements.
If you have any questions regarding these agreements, I will be in attendance at Monday
evening's City Council meeting.

RESOLUTION
BE IT RESOLVED that the City of Elk River enter into Mn/DOT Agreement No. 76653 with the
State of Minnesota, Department of Transportation for the following purposes, to-wit:
To provide for payment by the State to the City of the costs of the left mm lane construction and
other associated construction to be performed upon, along and adjacent to Trunk Highway
No. 10 at Simonet Drive within the corporate City limits under State Project No. 7102-88
(T.H. 10=003).
BE IT FURTHER RESOLVED that the proper City officers are hereby authorized and directed
to execute such Agreement.

one half mile south of Main Street to 640 feet north of 193rd Street Northwest within the

to execute such Agreement.
