A letter of credit in the amount of 100% of the cost of the improvements, including landscaping shall be provided prior to the releasing of the building permit. BACKGROUND/DISCUSSION A Pizza Ranch is proposed for the former Movie Scene building within the Elk Park Center Shopping Center. Substantial alterations of the exterior elevations require a formal site plan review by the Planning Commission and City Council, per the Planned Unit Development Agreement. In addition to the site plan review, staff is processing a boundary line adjustment. Pizza Ranch is acquiring a portion of the First National Bank property to expand the parking lot, shifting their shared property line to the north. Pizza Ranch is a permitted use on the property, provided that there is no live entertainment. The site plan process is the verify compatibility with the main shopping center and city ordinances. There are no written design standards for this building. Planning Commission discussion Planning Commissioners questioned the proposed signage, including the large mural on the north side of the building. The mural is not considered signage unless it contains commercial speech or logos. There were no concerns with the proposed use, or the proposed building facade improvements. Since the Planning Commission meeting, the applicant has decided to remove the mural. The freestanding and wall signage has been submitted for review. Address 19141 Freeport Road 60 Day Rule The City must take action by June 25, 2011 OVERVIEW The applicant seeks formal site plan approval for a proposed Pizza Ranch at 19141 Freeport Road. The subject property is zoned PUD and is governed by the Elk Park Center Planned Unit Development Agreement, which requires Planning Commission and City Council review (after public hearings) of any proposed "exterior remodeling of a structure." Changes to the structure include facade changes to all sides of the building, and an expansion of the parking lot to the north. The project includes the exterior and interior modification of the existing 6056 square foot commercial building, formerly housing the Movie Scene business. Live entertainment is not defined, but is understood to mean that no bands or other shows are permitted without a conditional use. The City reserves the right to refuse approval if, in the City Councils judgment, this condition is not met." ANALYSIS The review of the site plan is to confirm that the building is consistent with the original "Conditional Use Permit for the project, this PUD agreement, applicable City Ordinance requirements, and all other legal requirements". In staff's view, the facade improvements will include materials chosen for durability and strength, and axe not inconsistent with the balance of the shopping center. Materials proposed include fiber cement siding, asphalt shingles, and metal trim. The applicant proposes a large (20' x 10') mural on the north side of the building. Murals are not considered signage unless they include commercial speech or logos. The site improvements are reviewed based on applicable city zoning requirements, including parking, landscaping, storm water, and lighting. Parkin-g Site improvements include expansion of the parking lot, creating 88 parking spaces, including 4 handicapped parking spaces. The ordinance requirement is 10 spaces per 1000 square feet, or 61 spaces. Generally, it is desirable to avoid improving parking spaces well in excess of the requirement, although there is not regulation against such a practice. This subject parcel, including the portion of property acquired from bank to the north, is 894 feet, requiring 22 trees. The attached staff comment letter goes into more detail regarding the landscaping requirements, the credits applied, and the remaining needs. Utilities Storm water -Storm water on site will be collected in a number of catch basins in the parking lot and treated in an onsite underground piping retention system prior to being discharged to the existing storm sewer system on Freeport Street. Upon review of the drainage calculations provided by the applicant, the City Engineer does not have a concern with the proposed impervious surface. The City Engineer is currently working with the applicant's engineer to correct some minor issues identified in his review. These issues do not impact the visible plan. Ll~htmg The applicant has provided a lighting plan that is consistent with the recently adopted lighting requirements, maintaining a minimum of 3 fc on the commercial property. Sl ai?e The PUD agreement specifically spells out signage for the freestanding building sites: Signs must be a monument style with a magnum height of 10 feet and maximum area of 100 square feet. Wall signs are permitted, one per frontage on a public street, up to 10 percent of the wall area on which the sign is located. The sign package as provided is not consistent with the agreement and is not approvable. Staff is highlighting this in the conditions; all signage must be consistent with the agreement and the Planned Unit Development. Following this review, the following comments were generated. These comments axe not expected to effect changes to the site plan documents prior to the Planning Commission meeting on May 10. However, it is beneficial that changes be made prior to May 12, 2011 for inclusion in the City Council packet. If the plans cannot be altered, and you agree with the comments, a letter is sufficient. If you have comments or questions, it is beneficial to bring those to my attention as soon as possible. This letter is attached as a recommended condition of approval. 1. I can support the exchange of one evergreen and one ornamental trees for the 7 shrubs to be retained on site. This is attached. 2. Dempster Enclosure. The dumpster enclosure will need to be improved to match the proposed building facade. The gate should be constructed of a metal framed, wood gate. 3. Signa~e. The signage proposed on sheets C5.11 and A2.11 is inconsistent with the agreement. I have forwarded a copy of the sign regulations as they apply. In summary: Freestanding sign must be a monument style, no higher than 10 feet, and not larger than 100 square feet. Two wall signs are permitted, and can be no larger than 10% of the ~~all area on which they are displayed. The lettering must be individual letters. Panel type signs are not permitted. It is unclear how the signs will be constructed. All sign age requires separate permits. Approval of the site plan documents does not imply approval ox waiver of the sign or its regulations. McDonald whom will hire a general contractor that has built other Pizza Ranches. This family style restaurant will bring traffic to the area. It will seat 200 guests and include a community room to be used for group functions, In addition, the Elk River Pizza Ranch will be an integral part of the community and part of the marketing plan is to hold fundraisers for various groups in Elk River. About Pizza Ranch The Pizza Ranch, an Iowa-based company, was founded in 1981 in the town of Hull., Iowa, (population 1804). At the beginning of 2011, Pizza Ranch had 156 restaurants in 9 states. Many of the stores are located in small towns with same store sales consistently exceeding national statistics. More recently, Pizza Ranch has expanded into larger markets and has consistently done very well in these communities. These stores have experienced significantly higher profitability. The Pizza Ranch has received many awards for its contribution to the pizza industry. The first award came in 1990. The Pizza Ranch was the Pizza Maker of the Month featuring Kelly Pendelton, the training officer, on the cover. The Pizza Ranch also received an award for the introduction of the 3D pizza that includes an appetizer, main course, and desert all in one. The most important awards are the most recent. In January of 2000, the Pizza Ranch was ranked among the top 15 food-related chains in America and it was listed in the August 2001 Pizza Today magazine for being #1 among the top 100 pizza chains in "Same Store Sales" with an increase of 61.8% for the five-year period of 1995 to 2000. Since 2000, growth has continued, as Pizza Ranch has been in significant expansion mode. It has grown from 82 franchised locations to 155 at the start of 2011. This projects location will be taking an existing commercial building located in Elk Park Center and converting it to a restaurant. It will fit in extremely well with the surrounding. properties Hours of Operation The restaurant will be open for lunch and dinner 7 days a week. Service will begin at I lam and end at lOpm. The lunch buffet will begin at 11 am and end at 2:OOpm. The dinner buffet will begin at 4:30pm and end at 8:OOpm. The restaurant will be closed on Christmas and Thanksgiving. Number of Employees Two weeks prior to opening, all employees will be hired and start training.
