SR 09-08-1997,~sty of Item # 7.7. iver TO: MEMORANDUM Mayor & City Council FROM: DATE: Pat Klaers, City Admini~s~or September 8, 1997 SUBJECT: Consider Police Union Contract for 1997-1999 At the July 28, 1997, Executive Session of the City Council, staff was given further direction regarding the City Council's preferences for settlement of the Police Union contract. On August 26, 1997, staff met with representatives of the Elk River Police Union and reached a tentative agreement on a 3 year contract for the years 1997 through 1999. A meeting of the Police Union and its business agent was held in the afternoon of August 26, 1997, and the tentative agreement was unanimously accepted by those present. The terms and conditions of the tentative agreement is attached. This attachment reflects what will be the changes in the Police Union contract. One change from items previously discussed with the City Council is that the agreement is for a 3 year period. The only other significant items to note regarding this proposal are the wages for 1999 and the sick leave change for 1998. Regarding wages, instead of the typical 3% given throughout the calendar year, the city has offered 2.75% on January 1, 1999, and an additional 1/2% on July 1, 1999. Regarding the sick leave severance pay provision, the city has a maximum payment amount of 12 days and this is proposed to be changed to 18 days. This is the maximum allowed and only available if there is sufficient sick time in reserve. It should be noted to the City Council that if this contract is approved, the severance pay benefit will be recommended to be provided to all city employees. Additionally, it is likely that the wage recommendation for all city employees in 1999 will follow what is offered to the Police Union employees. Recommendation ! believe the changes in the Police Union contract are consistent with direction received from the City Council at its 7/28/97 meeting and I am therefore recommending City Council approval of the 1997-1999 City and Police Union proposal as outlined in the attached material. 13065 Orono Parkway · P.O. Employer Proposal City of Elk River and LELS August 26, 1997 o ARTICLE VI - GRIEVANCE PROCEDURE For clarification add the word "prior" preceding "approval" in the last sentence of Section 6.3. An aggrieved employer and a Union representative shall be allowed a reasonable amount of paid time off for grievance processing which requires the "prior" approval of the designated superior. ARTICLE VI. - GRIEVANCE PROCEDURE Add a step; Step 1 is the oral presentation to the employee's supervisor (Sergeant). Step 2 is the Police Chief and Step 3 is the City Administrator. ARTICLE VI - GRIEVANCE PROCEDURE Step 3 would become Step 4. Provide for the option of mediation prior to arbitration. ARTICLE IX- DISCIPLINE Section 9.6 - Grievances relating to this Article shall begin at Step 3, (the City Administrator). WAGES For 1997: January 1, 1997 3 % For 1998: January 1, 1998 3% For 1999: January 1, 1999 2.75% July 1, 1999 .50% INSURANCE - Employer Contribution in Article XIV For 1997 $325 per month effective January 1, 1997 For 1998 $340 per month effective January 1, 1998 For 1999: $355 per month effective January 1, 1999 ARTICLE XVI- UNIFORMS The annual uniform allowance will be increased by $10 in 1997 to $500; by $10 in 1998 to $510; and by $10 in 1999 to $520. ARTICLE XXI - HOLIDAYS Add one (1) premium pay holiday, Veterans Day in 1998. ARTICLE XVIII - SICK LEAVE, SECTION 18.3 In contract year 1998: Increase the severance pay percentages as follows: ao Provided the following conditions are satisfied, an employee shall be entitled to a cash payment for unused sick time in the amount equal to fifteen percent (15%) of his/her accumulated sick time up to a maximum of one hundred forty-four (144) hours: i) ii) iii) The employee must resign in good standing;; The employee must provide written notice of his/her resignation to the City at least two (2) weeks in advance of the employee's last day of work; and, The employee must have worked for the City for at least two (2) consecutive years. The cash payment shall be in an amount equal to fifteen percent (15%) of the employee's accumulated sick time (at the employee's current rate of pay), up to a maximum of one hundred forty-four (144) hours. bo The accumulation of sick time in excess of one hundred twenty (120) days shall not be subject to the fifteen percent (15%) payment under this policy. However, employees may continue to accumulate sick time in excess of one hundred twenty (120) days as a form of income protection in the event of unexpected long-term illnesses during their employment. c: Steve Miller, Steward
