SUBJECT: Other ALC Area Land Use Issues
On June 30, 1997, when the City Council accepted the concept of the ALC
building going on school property in and around the Oak Knoll Complex, a
number of other land use issues were discussed. These land use issues
include the City purchasing the balance of the youth recreation fields,
replacement of the lost soccer field, and a joint powers agreement on the
varsity field.
Dr. Flannery will be in attendance at this meeting to provide an update on
these three land use issues. Please note that Dr. Flannery has another
meeting to attend at 7:00 p.m. on Monday evening.
Dr. Flannery and I have talked about these three issues a number of times
since the 6/30/97 Council meeting. Additionally, at one of our meetings, we
had a representative of the Youth Soccer Association (Dave Halgren), Phil
Hals, Jeff Asfahl, and the Park and Recreation Chair, Dana Anderson
attend.
Regarding the City purchasing the balance of the youth recreation fields,
progress has been made on this issue. The school has directed John Bogart
to update the abstract and complete a survey of the area. This will
determine the exact acreage which the City desires to obtain. Along with this
property we also have to clean up a road easement situation in the northwest
for access into the park parking lot and deal with the ponding issue in the
south part of this property. Once the exact acreage is determined, we can
then proceed with negotiating a purchase price.
Regarding the lost soccer field, progress has been made to have additional
soccer fields provided. I have been advised that the Junior High varsity
football field (field #5) is going to be available for soccer on a trial basis. This
field is now going to be available because it is irrigated and the major
concern of damage to the field prior to its use for Junior High football has
lessened. The use of this field is conditioned upon the goal areas being
resodded so that grass can be reestablished prior the Junior High football
season... Additionally, some youth baseball fields and the Sauk-Vanderberg

Scheduling of youth baseball/softball activities will be an issue in making
this soccer field available, but this should be able to be accomplished through
coordination of activities with Jeff Asfahl... Finally, land is available at
Meadowvale School for the addition of one full size field. This will require
the relocation of a smaller size field. The school is making this land available
and the City is committing its manpower and equipment to completing the
work. Youth Soccer will be obligated to fund the capital investment into the
fields. It is estimated that this capital investment will be in the(~15,~
range.
Progress has also been made regarding the varsity field joint powers
agreement (JPA). Dr. Flannery has directed the school's attorney, Kim
Brandell of Terpstra-Black, to begin work on this varsity field JPA. Klm will
work directly with Peter Beck on an agreement that both parties will find
acceptable.
Except for the identification of two additional soccer fields that can be used
next season, nothing has been finalized at this time, but I am pleased to
indicate to the City Council that progress has been made on all three Oak
Knoll- ALC land use issues.

Issue
Consider Ordinance No. 97-__, rezoning approximately 20 acres from R4
(Multi-Family Residential) and I1 (Light Industrial) to Rlc (Single Family
Residential), and consider Resolution No. 97- , amending the
Comprehensive Land Use Plan from LI (Light Industrial) to MR (Medium
Density Residential).

Overview
The property considered for the rezoning and land use plan amendment
consists of approximately 20 acres and is currently occupied by the
community education facility, recreational fields and a parking lot for Oak
Knoll Park. The land use plan application was an issue raised by city staff as
part of the School District's application to develop the Alternative Learning
Center (ALC) on the southern end of the site adjacent to community
education. The property has two zoning designations of R4 (Multi-Family
Residential) and I1 (Light Industrial) and are not consistent with the current

use of park or institutional uses. Therefore, the suggestion to rezone the
property and amend the land use similar to the School District's other
facilities north of School Street and east of Proctor seemed like a logical
request. In addition, by rezoning the property this will eliminate the
possibility of multi-family development on the R4 zoned property.
Recommendation
It is recommended the City Council approve the following applications:

Resolution No. 97- , amending the land use plan from LI (Light
Industrial) to MR (Medium Density Residential); and,

Ordinance No. 97- ., rezoning certain properties from I1 (Light
Industrial) and R4 (Multi-Family Residential) to Rlc (Single Family
Residential) based on the following findings:
The rezoning will be consistent with adjacent residential zoning
district.
The existing land use of park and community facilities are
allowable uses under the Rlc zoning district.
The rezoning to Rlc gives a more accurate representation of the
long term land use needs for this area.
The rezoning eliminates the possibility of additional multi-
family being constructed in the vicinity of the Community
Education building.

A RESOLUTION AMENDING THE COMPREHENSIVE PLAN
TO CHANGE THE LAND USE FROM
LI (LIGHT INDUSTRIAL) TO
MR (MEDIUM DENSITY RESIDENTIAL
CASE NO. LU 97-5
WHEREAS, Minnesota Statutes, Chapter 462.355, Subdivision 2,
prescribes the procedure for amending the Comprehensive Plan, and
WHEREAS, the Planning Commission held a public hearing on August
26, 1997, and recommended approval regarding the Comprehensive Plan
amendment request for the property generally described as:
the property lying 400 feet west of Oak Field First Addition between
School Street and the 1884 Street alignment;
and,
WHEREAS, the City Council has reviewed the Comprehensive Plan
amendment request and finds the change to be in general conformance to the
adopted Comprehensive Plan.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River that the Land Use Plan be amended to change the property as
described above from LI (Light Industrial) to MR (Medium Density Residential.
PASSED by the City Council of the City of Elk River this 22na day of
September, 1997.

The City Council of the City of Elk River does hereby ordain as follows:
Section 1. The duly adopted Zoning Map of the City of Elk River is hereby
amended to rezone the property described as:
