SR 09-24-1997EXTRACT OF MINUTES OF A MEETING OF THE CITY COUNCIL OF THE CITY OF ELK RIVER, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the City Council of the City of Elk River, Minnesota was held at the Elk River City Hall on September 24, 1997, beginning at 5:15 p.m. The following Council Members were present: and the following were absent: The City Clerk presented affidavits of posting and publication of a Notice of Election held in accordance with the resolution adopted on July 28, 1997, authorizing said election to vote on the question of borrowing money and issuing bonds in an amount not to exceed $2,000,000 for the purpose of defraying the expense of the acquisition, construction, equipping and betterment of public park and recreational facilities for the City, and also presented the official returns of the judges of election. (Attach Ballot) ~..lty of MEMORANDUM TO: Mayor and City Council FROM: Sandra Thackeray, City Clerk DATE: September 24, 1997 SUBJECT: Sunshine Depot Staff has become aware that the Sunshine Depot's liquor liability insurance has been canceled as of August 27, 1997. According to State Statute 340A. 409 Subd. I and City Ordinance Section 800.26 (1), "No retail license may be issued maintained, or renewed unless the applicant demonstrates proof of financial responsibility." Because Mr. Purmort does not carry liquor liability insurance, he no longer has a liquor license to sell liquor. Violation of this law constitutes a gross misdemeanor for the owner or anyone attempting to sell the liquor. The City will be sending a police officer to inform Mr. Purmort that he does not have a license to sell liquor, and therefore, should cease any sales of liquor immediately. The City has also informed Mr. Purmort that a hearing by the Council has been scheduled for October 6, to revoke, suspend or impose other penalties for sales of intoxicating liquor without a license. 13065 Orono Parkway · P.O.
