MEMORANDUM
TO:
Mayor and City Council
FROM: Sandra Thackeray, City Clerk
DATE:
September 24, 1997
SUBJECT: Sunshine Depot
Staff has become aware that the Sunshine Depot's liquor liability
insurance has been canceled as of August 27, 1997. According to
State Statute 340A. 409 Subd. I and City Ordinance Section 800.26 (1),
"No retail license may be issued maintained, or renewed unless the
applicant demonstrates proof of financial responsibility." Because
Mr. Purmort does not carry liquor liability insurance, he no longer
has a liquor license to sell liquor. Violation of this law constitutes a
gross misdemeanor for the owner or anyone attempting to sell the
liquor.
The City will be sending a police officer to inform Mr. Purmort that
he does not have a license to sell liquor, and therefore, should cease
any sales of liquor immediately. The City has also informed Mr.
Purmort that a hearing by the Council has been scheduled for
October 6, to revoke, suspend or impose other penalties for sales of
intoxicating liquor without a license.
