DRAFT COUNCIL MINUTES 06-13-2011CLOSED SESSION OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER CITY HALL ~ u=' TUESDAY, MAY 31, 201 I , { ~--`~~ ~,~~~ Members Present: Mayor Dietz, Counciltnembers Zerwas, Gumphrey, Westgaard and Motin Members Absent: None Staff Present: City Clerk Tina Allard, Environmental Administrator Rebecca Haug and City Attorneys Peter Beck, Sammy Clark, and John Baker Call Special Meeting to Order Pursuant to due call and notice thereof, the regular meeting of the Elk River City Council was called to order at 6:30 p.m. by Mayor Dietz. Mayor Dietz read the agenda statement outlining why the Council would be going into a closed session. 2. Adjourn to Closed Meeting Pursuant to due call and notice thereof, the closed meeting of the Elk River City Council was called to order at 6:31 p.m. by Mayor Dietz. 3. Closed Meeting-Attorney-Client Privilege The purpose of the closed meeting was to discuss the lawsuits involving the Elk River Landfill pursuant to MN Statute 13D.05, Sub. 3(b). 4. Adjourn Closed Meeting There being no further business, Mayor Dietz adjourned the closed meeting of the Elk River City Council at 7:30 p.m. 5. Re-open Special Meeting Mayor Dietz re-opened the regular meeting at 7:31 p.m. MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILMEMBER WESTGAARD AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE THE AGREEMENT THAT RELATES TO THE RESOLUTION OF ALL PENDING LAWSUITS BETWEEN THE CITY OF ELK RIVER AND THE ELK RIVER LANDFILL. MOTION CARRIED 4-1. Councilmember Gumphrey opposed. 6. Adjournment There being no further business, Mayor Dietz adjourned the regular meeting of the Elk River City Council at 7:35 p.m. Tina Allard, City Clerk John J. Dietz, Mayor
