ACTION REQUESTED
Staff recommends approval of the Conditional Use Permit for The Crossing Church, as shown on plans
dated June 6, 2011, with the following conditions:
1. All comments of the City Planner letter dated June 28, 2011 shall be addressed.
2. As a Conditional Use Permit is not a Building Permit, the applicant shall obtain all required
permits, including approvals from the Fire Chief, City Engineer and Building Official.
3. The development shall meet all applicable fire codes. The Fire Chief shall verify the location of
all fire hydrants, and may require additional hydrants necessary to preserve the health and safety
of the residents.
4. The standards for issuance of the Conditional Use Permit shall continue to be maintained.
5. Line of site drawings shall be prepared to illustrate the roof top units will be screened .from
adjacent public areas, including Lions Park and School and Jackson.
6. A letter of credit in the amount of $50,000 shall be provided to ensure compliance with grading,
erosion control, drainage, utility, hardsurface, and landscaping requirements prior to the
releasing of the building permit.

OVERVIEW
The Crossing Church proposes an expansion of their current facility, located on the south side of School
Street, south of the Elk River High School.
Phasing. The expansion is proposed in two phases, the first phase will include the improvement of a 547
space parking lot to the east of the existing church, a 14,232 square foot expansion primarily for an
auditorium, and a 11,406 square foot expansion on the south side of the building for a new lobby/
entrance area. Future phases will include the construction of 7,360 square foot addition for classrooms.
After all additions, the total area of the building will be 54,512 square feet, will provide seating for 1,500
in the auditorium, include a number of offices and classrooms, and parking for 547 cars.

Building improvements will be a mixture of glass, metal siding, and precast concrete panels. There are no
design standards applicable to the R-4 zoning district. Photo images of the materials will be provided at
the meeting.
Rooftop units. The applicant has indicated that the roof top mechanical units would be screened from
public view. Due in part to the highly visable location, Staff will review line of sight drawings once
locations of the roof top units have been identified.
Parking. Parking is often the biggest concern identified during the review of an institutional use. The
proposed Crossing Church will provide seating for 1,500 people in the main auditorium, requiring 500
parking spaces. The church proposes 547 spaces, including 25 already existing. This meets the
requirement. Access to the site will be via a new entrance east of the existing aparrn~ent building, and a
new access off of Jackson Avenue. Eventually, the access of Jackson will line up with 8~' Street. This will
occur when the property to the south develops. A third access is proposed, west of the building, and will
serve fire/emergency needs, garbage collection, and other deliveries only, no parking is provided.
Signage. This lot is permitted three freestanding signs; two area identification signs (8 feet high, 16 square
feet) and one free standing sign (96 square feet, 20 feet in height). The plans propose two area
identification signs, and one freestanding sign. These signs are consistent with the sign ordinance as
written, however, it is suggested that some attention be paid to the sign regulations, particularly its
definition of `development' as it appears to open up a loophole, allowing more signage than perhaps
intended. All signage will require a permit. Approval of the Conditional use permit is not an approval of
the sign package as shown.
Landscaping. Additional landscaping is being proposed based on the requirements of the zoning
ordinance. After review and minor modifications, it is staffs expectation that the landscaping plan will be
consistent with the landscaping requirements. This property is adjacent to a primary corridor, as
identified by staff and the Council. The Landscape plan has been reviewed accordingly.
BACKGROUND/PRECEDENT
Churches, classified as an Institutional Use, axe a conditional use in all residential, C-1, C-2,C-3, and DD
zoning districts. With the exception of the Elk River Lutheran Church approved in 2010, all of the
churches in Elk River are in Residential zoning districts.
The Crossing Church bought the former home of Alliance Church in 2009. Since then, their
congregation has grown, requiring an expansion.

APPLICABLE REGULATIONS
Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
7. Dill not endanger, injure or detrimentally affect the use and enjoyment of otherproperty in the immediate vicinity
or the public health, safety, morals, comfort, convenience orgeneral aa~elfare of the neighborhood or the city.
2. Weill be consistent with the comprehensive plan.
3. Weill not impede the normal and orderly development and improvement of surrounding vacantproperty.
4. Weill be served adequately by and will not adversely affect essential public facilities and services including streets,
police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and mill not, in
particular, create tra~c congestion or interference avith tra~c on adjacent and neighboring public thoroughfares.
5. mill not involve uses, activities, processes, materials, equipment and conditions of operation that ~arill be
detrimental to any persons orproperty because of excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Weill not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. LVill fully comply with all other requirements of this Code, including any applicable requirements and standards
for the issuance of a license orpermit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all of
these standards.
ANALYSIS
Staff has completed the review of the plans, and incorporated them into a comment letter dated June 28,
2011. It is staff's suggestion that these comments be addressed as appropriate, either as revised drawings
or noted conditions of approval. On July 6, 2011 a response was received, indicating acceptance of most
of the comments.

Conditional Use Permit
A. Water service connection. City Staff, including the Fire Marshall, have recommended that the water
service connection and a fire hydrant be connected to the watermain along Jackson Avenue. The
applicant objects, due to costs.
The recommendation is being made because in the event of a fire, the 8' main along School Street may
not be sufficient to serve School street developments and the building. Using the 16' main along Jackson
helps spread the demand to two areas.
B. Signs. In addition to the freestanding signs noted about, the building proposes a number of wall signs.
The ordinance permits 1 wall sign, not to exceed 96 square feet. Any signage less than 4 square feet is not
regulated, nor is signage located inside a window. The plans need to be adjusted to provide for an
allowable number of wall signage.

At the Site Plan Review Committee meeting on June 8`'', staff reviewed your application and
has the following comments:

3) The currently proposed access off of Jackson Avenue is temporary. When the property
to the south along Jackson is developed, access off of Jackson will be shared as it aligns with

4) The parking lot appears to be less than 10 feet from the property line, in particular the
property lines shared with the apartment building NE of the church building. In fact, it
appears that a portion of the proposed parking extended over the property line shared with
the apartment building. Please adjust.
Landscaping/Vegetation
5) Sheet 3 shows. a landscaped island in the main part of the parking lot, on the west side of
the drive from School street; a storm sewer line runs through this island. A tree is proposed
to be planted here, which is likely to cause conflicts.
The number of trees is consistent with the requirements of Section 30-934 (b)(3).
6) Please either relocate or provide street trees along School Street.
7) Please provide additional shrubbery along School Street and Jackson avenue for headlight
screening.
Fire Chief
8) Please provide a fire hydrant at the new front of the building, the south east entrance.
This hydrant supply shall come off of Jackson Ave because of placement of the west fire
lane and the water supply to that lane.

This property is unique, in that a portion of the project is located within the R-4 zoning
district (the building), and a portion of the project is located in the C-2 zoning district (the
parking lot). Where separate rules exist based on zoning district, the rules applied to the
district in which the principle structure is located is applied. The building is located on the
western portion of the property, on the lot that is currently zoned R-4.
Based on the sign ordinance, the development is permitted one area identification signs (per
Section 30-866 (8) These area identification signs are permitted 16 square feet and up to 8
feet in height. Per Section 30-866 (10), permitted non-residential uses are allowed one
freestanding and one wall business sign, not to exceed 96 square feet in total sign area.
Because the lot has more than 1,000 linear feet of combined street frontage, the total area
may be increased, not to exceed 192 square feet. The free standing sign may not be higher
than 20 feet.

9) I note that plans show three freestanding signs and 2 building wall signs. The detail on
sheet 7 that shows the area identification sign is consistent with the ordinance, although it is
unclear where this sign will be located. Sheet 2 identifies entry and monument signs. The
detail on sheet 7 that shows the monument elevation is consistent with the ordinance with
regard to size and height. Please adjust the plans to reflect the number of free standing signs
allowed, and clarify where each type will be located.
10) Finally, please clarify "Sermon Series Signage". I understand this are to be changeable
copy; if its electronic changeable copy, please provide a note on the plans.

11) I reviewed the building height. Although portions of the building wall exceed 40 feet
high, based.on the definition of height, the building height is permissible.
12) Please verify that all mechanical units, if mounted on the roof, will be screened from
public view, including the streets and Lions Park.
13) The permissible amount of lot coverage is 25%. Because the language of the ordinance
is unclear, we have interpreted that lot coverage calculation is applied to the building only,
not the parking lot. This is consistent with the application in the past, and amount to a lot
coverage area of approximately 14%.
14) Please provide color and material samples for review by the Planning Commission and
City Council.
Because of the lateness of these comments, it is not expected that changes occur prior
distribution of the Planning Commission packet on July 8a' for the meeting on July 12~',
2011. However, to facilitate discussion at that meeting, a response letter provided to my
office by July 6~' would be appreciated.
It is recommended that these commented be incorporated into revised drawings provided by
July 13r'', for inclusion in the City Council packet. The revised submittal should include five
full size sets as well as four 11x17 reduced sets for the Planning Commission review. A .pdf

Project Narrative for:
The Crossing Church
Conditional Use Permit
May 31, 2011
The Crossing Church is a rapidly growing church in the Elk River Community. Not your typical church, The
Crossing Church is "Church for People Who Don't Do Church". The Crossing Church has been doubling their
attendance annually after moving into their new home at 829 School Street and currently holding five worship
services on the weekend to serve their members. Their current worship space seats approximately 500
people and the need is huge to increase the number of seats in their worship space to reach more people.
The existing building at 829 School Street is approximately 21,514 SF with a worship space/auditorium that
seats 500 people. There is also youth space, youth classrooms, offices, restrooms, and a small lobby. The
existing parking lot has spaces for 122 cars.
Current hours of operation of The Crossing Church are Monday thru Friday, gam to 5pm. The Crossing
Church is holding five weekend services; 5pm and 6:45pm on Saturdays, and 9:30am, 11:15am and 1 pm on
Sundays. The peak use of the facility is obviously on the weekends with the weekdays being for general
church operation where the church currently employees approximately 30 people.
The Crossing Church has recently purchased the vacant property to the east which will be developed into
additional parking, complete with concrete curb & gutter, bituminous paving, parking lot lighting, and
landscaping to meet City of Elk River's zoning requirements. The new proposed design for the two combined
properties will have a maximum 547 parking spaces and will meet the parking demands of the proposed
project.
The proposed addition and remodel project for The Crossing Church includes doubling the size of the worship
space and adding much needed lobby space, youth spaces and classrooms. There is additionally significant
work proposed to bring the building up to current code compliance with sprinkler systems, elevator,
accessible restrooms, ramps, stairs, etc.
The proposed additions total 25,638 sf of additional space with an area reserved for a future 2 story
classroom addition of 7,360 sf. The new worship space/auditorium will seat 1500 people with room to expand
to the maximum occupants allowed by parking count constraints.
The exterior materials of the additions will be precast concrete panels, prefinished metal ribbed siding, glass
and aluminum curtain walls. The proposed additions will have flat (low-slope) roof structures with fully
adhered EPDM membrane roofs.
The signage for the building will include two building signs, one freestanding sign and two area identification
signs. The main building sign will be located on the north elevation along School Street to identify the
building. An additional building sign is shown on the east elevation to indentify the main entrance to the
building. The freestanding sign is located on the corner of School Street and Jackson Avenue. This sign will
be constructed of materials to match the new building facade. It will identify the church and allow an
opportunity for the church to display their sermon series which changes every four weeks. The area
identification signs are located at the entrances to the parking lot off School Street and Jackson Avenue.
These signs are sized to remain within the square footage requirements and shall be constructed of materials
to match the new building fagade.
Outdoor Storage consists of a trash enclosure suitably sized for two dumpsters, one for trash and one for
recycling. The materials of the trash enclosure have been selected to match the proposed additions and will
be constructed of precast concrete panels and prefinished metal ribbed siding.
