Overview
Culvers Restaurant is proposing to construct a 3,500 sq. ft. Class II
restaurant. The proposed restaurant will be located in the northwest corner
of Outlot A in Hillside Crossing Two. The parcel which Culvers would like to
occupy is a .8 acre parcel which will be considered with the preliminary and
final plat of Hillside Crossing Five. The proposed restaurant will include a
98 person seating area along with a drive-through window as well as an
outdoor patio area. Culvers Restaurant specializes in "Butterburgers" and
smooth frozen custard.

Site Plan Review
Staff has reviewed the proposed development plans by Culvers Restaurant
and have completed a list of comments which are made part of the Planning
Commission report. Please refer to that report for additional information.
Two issues which stood out at the Planning Commission meeting centered
around the drive-through lane and the access driveway off of Evans Street.
Culvers has made the appropriate changes to the drive-through allowing a
stacking distance of 5 vehicles which is required by city ordinance. However,
staff has pointed that any vehicles beyond 5 will have the possibility of
obstructing the entrance into the Culvers Restaurant. Culvers has indicated
their business is much different than a McDonalds or Taco Bell, whereby 65
percent of their traffic is walk-in while 35 percent utilizes the drive-through
window.
The second issue discussed by the Planning Commission and staff related to
the entrance drive off of Evans Street. This entrance drive will not only
provide access to Culvers Restaurant but also to the future commercial
building on the adjacent lot. The future building may have a square footage
of approximately 30,000 s.f. based on the available parking that is left once
the Culvers is developed. The developer has indicated a secondary driveway
further to the south off of Evans Street would be preferred to allow for
additional opportunities to access the site. The location of this driveway will
need to be strategically located so it is not too close to Sax Foods' driveway or
the proposed driveway for Culvers. The concern relating to the proposed
access drive off of Evans Street is the conflicting movements of vehicles
backing in and out from the Culvers Restaurant with the traffic entering the
site through one of the primary drive aisles to the future commercial
building. Typically, commercial developments which have pad sites within a
parking lot try to create some separation to give identity to the business and
reduce traffic problems. For example, Arbys and Midas Muffler in Elk Park
Center are adjacent to driveways to the development; however, do not have
parking areas backing up to those drive aisles.
Recommendation
If the City Council has no problems with the proposed site plan submitted by
the developer and Culvers Restaurant, staff would recommend the following
conditions:
THE MONUMENT STYLE SIGN MAY BE ELEVATED WITH THE USE OF A BERM IF THE BERM
IS EXPANDED IN SIZE AND MADE PART OF THE OVERALL LANDSCAPING. THIS WILL BE

REVISED SITE PLAN
Dear Mr. Ach:
As requested, we have reviewed the revised Site Plan submitted for the proposed Culver's
Restaurant. As you are aware, at the last Planning Commission meeting the Commissicners
were concerned about primarily two issues, the first being the drive-thru isle, and the second
being the general flow of traffic onto and off of the site from Evans Avenue. Based on our
review of the revised Site Plan and other information, we would offer the following comm._.nts on
these two issues:
VVith regard to the drive-thru isle, staff had recommended that a concrete median be
extended outward from the building site to define the drive-thru isle and to meet the City
ordinance which requires stacking of a minimum of five vehicles from the menu board.
At the Planning Commission meeting, the representatives from Culver's raised concern
about having a drive-thru isle that was completely closed in. Their studies had indicated
that the public shied away from drive-thru isles which were that restrictive. As a
compromise, the revised Site Plan does two things: first, it moves the menu board
further around the side of the building to provide for more stacking in the actual drive-
thru isle. The second thing they have done is move their parking spaces further to the
west and define by a concrete island the entrance to the drive-thru area while still
maintaining two lanes of traffic, one in and one out, around the parking spaces. Ti3i$
now meets the City ordinance as far as capacity of the drive-thru isle. The one co:3cern
we would have is if the drive-thru were busier than expected, .the cars would back into
the parking area drive isles. At the last Planning commission meeting, the Culver's
representatives indicated that their customer base was significantly different from a
Burger King or McDonalds in that their drive-thru customers represented only 35% of
their total customer base, with the remainder being inside customers. VVith this
information, the potential for the drive-thru isle to block'the parking traffic lanes may not
be a concern.

The second issue that the Planning Commission questioned was the potential for
conflicting traffic movements with vehicles entedng the site off of Evans Avenue and
Culver's customers parking and backing out of parking stalls immediately adjacent to this
drive isle off of Evans Avenue. As you are aware, this site has the potential to hoic
approximately 30,000 square feet of general retain in addition to the Culver's site. One
potential solution that was discussed at the Planning Commission meeting was to move
the driveway on Evans Avenue further to the south and allow only that driveway access
to serve the entire site. In looking at this solution, we have done two things. First, we
have tried to estimate the total number of trips that this site could possibly generate. We
have assumed that, after the Culver's restaurant is constructed, the remaining area
could support approximately 30,000 square feet of retail. Based on 30,000 square feet
of general retail, the a.m. and p.m. peak hour traffic could be up to 150 vehicles plus
Culver's traffic. This would appear to be more than one driveway could adequatety
service. We also had a meeting to discuss the potential of one driveway access versus
two with the Developer, Mr. Rick Foster. Mr. Foster has indicated that he would prefer
that there be two driveway points into this site from Evans Avenue to service the future
development of the site.
This poses a potential problem if we assume that the site needs two driveway accesses,
either because of the Developer's wishes or the amount of traffic generated. If the
currently proposed driveway is moved one parking row, or 40 feet, to the south, this will
start to cramp a second access into the site, remembering that the most northerly Sax's
Foods driveway is just south of the lot line. It is our feeling that, with two driveways, off of
Evans Avenue and an interconnect between this site and the Sax's Food site, the
potential conflicts between the vehicles entering the site and parking at the Culver';;
restaurant site would be minimal. Therefore, we would recommend that it be
constructed as proposed with one exception. We would recommend that the driveway
access onto Evans Avenue be widened from 24 feet to 30 feet, and the drive isle
between rows of parking for this access point also be maintained at 30 feet. Typically,
these drive isles would be 24 feet wide.

Overview

Culver's Restaurant speciahzes in butter burgers and smooth frozen custard.
Site Plan Review
As with all of the developments in the commercial planned unit
developments, a conditional use permit and site plan review is required for
each project. The following are a list of comments staff has regarding the
proposed Culver's Restaurant:
Parking and Circulation
According to the City's parking ordinance, Culver's is required to have
30 parking stalls. The proposed plans submitted include a parking
area much larger than required by City ordinance. The Culver's
property will include approximately 45 parking stalls. Therefore,
according to the ordinance their parking requirements will be satisfied.
City ordinance requires a stacking distance from the menu board of
five vehicles. Based on the proposed site plan, a stacking distance of 3
vehicles can occur before vehicles begin blocking one of the entrance
drives. Therefore, staff is recommending the drive-through lane be
redesigned and extended to accommodate the stacking of five vehicles
from the menu board without obstructing incoming traffic.
If the entire parking lot is not be built at this time, a bituminous curb
shall be provided along the southern border of the parking lot to
control drainage and prevent further erosion.
Staff raised some concern with having the parking stalls serving the
Culver's Restaurant within the same drive aisle that will serve the
future building (30,000-40,000 sq. ft.) on the same property. This has
been discussed with Culver's and the developer and they believe there
would be no problem with traffic circulation under the proposed
design. This drive aisle could receive a lot of traffic depending upon
the type of business. Ideally, if Culvers had a landscaped area
separating their site from the balance of the site, the traffic circulation
could be controlled better.
Landscaping
Ail of the proposed landscaping is located on the northern portion of
the site. Staff would recommend moving some of the landscaping

around to include plantings at the proposed entrance off of Evans, as
well as the curbed islands immediately as you enter the parking lot.
All landscaped areas will need to be irrigated with underground
irrigation.
3. All disturbed areas will have to be sodded.
Drainage and Utilities
Please refer to Terry Maurer's letter for information on these two
issues.
Signage
As set forth in the Hillside Crossing Two Planned Unit Development
Agreement, a monument style sign is required. Culver's has provided
a detail of a monument style sign that would fit within the guidelines
of the Hillside Crossing Two sign requirements. This is a monument
style sign they have used in other facilities.

It appears as though the proposed sign is located on a 6 foot high earth
berm. As with other applications, this sign should not be artificially
elevated by placing it on a bermed area.
Pedestrian Circulation
Staff has recommended on other projects to connect these commercial
facilities to the pedestrian systems that are being constructed along
the frontage roads. Therefore, it is recommended a sidewalk be
continued from the restaurant out to Evans Street to encourage the
pedestrian use of the sidewalk.
Hillside Crossing Two Concept Plan
Attached is a copy of the Hillside Crossing Two concept plan that was
approved by the Planning Commission and City Council. Superimposed on
that concept plan is the Culver's Restaurant, as it will help the Planning
Commission visualize how this restaurant will be developed on the subject
site. The developer has indicated that the future building that is located on
the eastern portion of the property will probably shift about 85 feet to the
east and the parking lot will be expanded further to the south. Ideally, it
would be helpful if a revised concept plan was submitted illustrating the
second entrance drive to the site off of Evans Street and the new building

location. Without such a plan, we were able to just make some assumptions
on how the overall traffic circulation in and out of the site will complement
the traffic generated by the proposed Culver's Restaurant.
Recommendation
It is recommended the Planning Commission recommend approval of the
conditional use permit for Culver's to construct a Class II restaurant in the
Hillside Crossing Two Planned Unit Development, with the following
conditions:
1. ALL OF THE COMMENTS OUTLINED IN TERRY MAURER'S MEMO BE INCORPORATED
INTO THE REVISED SITE PLANS.
2. THE SITE PLAN BE REVISED TO EXTEND THE DRIVE UP LANE TO ACCOMMODATE THE
STACKING OF 5 VEHICLES WITHOUT OBSTRUCTING TRAFFIC ENTERING THE SITE.
3. THE MONUMENT STYLE SIGN SHOULD NOT BE PLACED ON AN ELEVATED BERM.
4. LANDSCAPING BE PROVIDED AT THE ENTRANCE OFF EVANS AS WELL AS THE TRAFFIC
CONTROL INSLAND NEAREST THE ENTRANCE DRIVE.
5. A FIVE FOOT WIDE SIDEWALK BE PROVIDED FROM EVANS STREET TO THE SIDEWALK IN

As requested, we have reviewed the submittal prepared for the proposed Culver's Restaurant.
The restaurant is proposed to be located in Outlot A of Hillside Crossing Two. As you are
aware, this outlot is being proposed to be replatted as Hillside Crossing Five. Based on our
review, comments received at the staff review meeting, and meeting with the Developer of the
Hillside Crossing area, we would offer the following comments:
The information submitted was prepared by Landform Engineering Company and c:~nsisted
of a set of plans containing an Existing Conditions Plan, Preliminary Site Plan, Preliminary
Grading Plan, Preliminary Utility Plan, Floor Plan, and building elevations. They also
submitted a drainage calculation for the site. In our meeting with Mr. Rick Foster,
Developer of the Hillside Crossing area, he indicated that it is not his intent to construct the
entire parking area shown on the Landform Engineering Company plans. He indi~,~ted that
he intends to construct the access off of Evans Street and everything lying north of that
line. The remaining part of the parking lot would be constructed in the future when
additional development occurs in this area.
The Drainage Plan submitted will work fine with the revised construction which Mr. Foster
has indicated will take place. If the entire area were to be built according to the Landform
plan, we feel that there is too much drainage sheeting across the entire parking area. As
Mr. Foster has indicated the phase construction, they will be able to sheet drain a portion of
the parking lot to the south and will then need some type of rock swale leading to the
existing ca;ch basin on the site. In the future, when further development occurs.
strategically p;aced catchbasins will be required to pick up the drainage.
3. We have the following comments on the Preliminary Site Plan:
The access off of Evans Street is shown as 24 feet wide. Perhaps this could be
widened slightly to 30 feet to provide additional room for vehicles to pass.
The parking stalls shown adjacent to the building site are 19 feet in depth. According to
City ordinance, these could be 18 feet because of the allowable overhang at the curb
side. However, the parking shown away from the building site needs to be expanded
from 38 feet for back-to-back parking to 40 feet, because there is no allowable
overhang.

Overview
At the Planning Commission meeting of September 30th, the Commission
discussed the proposed Culvers Restaurant and highlighted the primary
concern being traffic entering the site off of Evans Street and the drive-up
window design. Staff spoke with representatives from Culvers who agreed to
the conditions outlined in the staff report as presented on September 30th.
The one issue which Culvers and the developer do not feel will be a problem
is having an access off of Evans Street in a location which mixes restaurant
traffic with another commercial use. The Commission originally discussed
the concern of having the traffic from the Culvers Restaurant conflicting with
the vehicle movements entering and leaving the site from the primary
building site which has no specific user identified at this time.

The Commission did discuss the possibility of having one centrally located
access point to serve this entire parcel. The parcel would also have a
secondary driveway connecting with the Sax Foods Store immediately to the
south. The developer has indicated he would like an additional access drive
further to the south end of the site off Evans to serve this site.
Drive-Thru Lane
The attached plan represents a redesign of the drive-thru lane to meet the
five car stacking distance. This design maintains a standard curb-cut of one
lane in and one out. The drive-thru can be entered from Culvers' property
and not from the drive aisle. Obviously, ff there is more than five cars in the
drive-thru lane, the line would extend into the entrance to Culvers. This
design meets City ordinances; therefore, if Culvers anticipates a queuing
distance of more than five vehicles, an alternative design should be
considered.
Recommendation
If the Planning Commission is comfortable with the revised plans submitted
by the developer of Hillside Crossing and Culvers Restaurant, staff would
recommend the following conditions:
