TO: FROM: DATE: SUBJECT: Mayor and City Council Steve Ach, City Planner~~ October 20, 1997 Request by Phoenix Enterprises for Preliminary and Final Plat Approval (Hillside Crossing Five), Public Hearing Case No. P 97-14 Issue Phoenix Enterprises is requesting preliminary and final plat approval to subdivide approximately 7 acres into 2 commercial lots. The two lots will have a lot area of .8 acres and approximately 6.2 acres. The property was originally platted along with Hillside Crossing Two and was final platted as an outlot. The utilities to serve the two lots in the proposed plat were also installed with the Hillside Crossing Two public improvements. The fire chief has requested a water line and hydrant be extended to provide additional fire protection to Lot I along with the proposed development plans. THE PROPOSED DIMENSIONS ON LOT 1 COINCIDE WITH THE APPROVED SITE PLAN FOR THE PROPOSED CULVERS RESTAURANT. ANY AREAS DISTURBED AS A RESULT OF THE CONSTRUCTION ON LOT 1 BE SODDED/SEEDED AND EROSION CONTROL BE INSTALLED. PARK DEDICATION BE PAID IN THE AMOUNT REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT. Bo Resolution No. 97- ., granting final plat approval for Hillside Crossing Fifth with the conditions as outlined in the resolution. \\elkriver\sys\shrdoc\council\p97-14.doc RESOLUTION NO. 97 - CITY OF ELK RIVER A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR: Hillside Crossin.q Five Case No. P 97-14 WHEREAS, application has been made for final plat approval, pursuant to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Council; and WHEREAS, a preliminary plat of the Property was approved by the City Council on October 20, 1997; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, as follows: It is hereby determined by the City Council for the City of Elk River as follows: Ao The proposed subdivision is consistent with the Zoning Ordinance and conforms with all of its requirements. Bo The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Development Plan. Co The physical characteristics of the site, including, but not limited to, topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. Do The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. Eo The proposed subdivision will not cause substantial environmental damage. Fo The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. This final plat approval shall expire one year from the date of this resolution if the final plat is not recorded within that time. Box 490 Elk River, Mn 55330-0490 RE: HILLSIDE CROSSING FIVE Dear Mr. Ach: As requested, we have reviewed the proposed plat for Hillside Crossing Five. This is the replatting of Outlot A from Hillside Crossing Two. Lot 1 in Hillside Crossing Five is the location of the proposed Culver's Restaurant. Nothing is currently proposed for Lot 2. At the staff review meeting, Cliff Skogstad indicated that there is a no-build easement for the Menards Store to the north of this site. This no-build easement may affect a portion of Lot 2 in Hillside Crossing Five. As part of the Culver's Restaurant review, a hydrant is proposed to be located in an island on that site. This plat should provide the necessary easements to cover the watermain extension and hydrant location. We also question whether or not cross-access agreements for parking and entrance into and out of the site will be necessary. These may not be necessary if Mr. Foster retains ownership of both lots and just leases the Culver's site. If you have any questions regarding these comments, please call. Sincerely, Howard R.
